2022 Motion to Dismiss Statement of Election Contest, and Plaintiffs’ November 28, 2022
Response to Contestee’s Motion to Dismiss.
Discussion is held regarding legal issues, including the deadline for certification, the
potential timeline of a recount, and the timeliness of the filing of this case.
Oral argument is presented to the Court regarding the parties’ positions on the timeliness
of the filing of this case, as discussed in the Motions to Dismiss and Plaintiffs’ Response.
Plaintiffs request the opportunity for interested parties to file amicus briefs on these issues.
Discussion is held regarding whether an evidentiary hearing should be set at this time and
the possible procedural issues regarding same.

IT IS ORDERED that, no later than November 29, 2022, Plaintiffs shall provide to
Defendants and file a list of documents that are requested under the Arizona Rules of Civil
Procedure.
IT IS FURTHER ORDERED that, no later than December 6, 2022, the parties shall
file simultaneous briefs regarding the issue of whether and to what extent discovery is or should
be permitted in an election contest.
