REQUIREMENTS FOR THE ISSUANCE/CONFIRMATION OF DEED

OF ABSOLUTE SALE
(for closed bank buyers fully paid prior to closure)

a. Letter (by the buyer or duly authorized


representative, duly designated SPA) requesting
for the issuance of Deed of Absolute Sale; (To be
addressed to: Ms. Imelda A. Barro, Deputy
Receiver/Liquidator of closed bank)

b. Certified copy of the Original/Transfer Certificate of


Title issued by the Registry of Deeds

c. Official Receipt issued by the Registry of Deeds in


securing letter b.

d. Official Receipt issued by the Bank representing full


payment of the asset purchased.

e. Copy of Deed of Condition Sale executed between the


buyer and the bank or any document evidencing
the purchase agreement, or

f. Previously issued Deed of Absolute Sale, if any, for


confirmation of PDIC

g. Duly notarized Affidavit (pro-forma attached); and

h. Photocopy of two (2)Valid identification Cards


(government issued ID); and

i. Special Power of Attorney for the authorized


representative.

AFFIDAVIT

I/We, Sps. EmilioP. Abayon , Jr. and Mary Ann S.


Abayon , of legal age, Filipino, married/single with residence
and postal address at Marianos, Numancia, Aklan , after
having duly sworn to in accordance with law, hereby depose
and say:

1. That I/we purchased a property under Tax


Declaration No. 05-004-00276 (new) /TD No. 93-
004-0176 (old) from the closed Cooperative Rural
Bank of Aklan, (CRBAklan), presently under
Receivership/Liquidation by the Philippine Deposit
Insurance Corporation (PDIC) on January 30, 2008
for the sum of PESOS: Forty thousand only
(P40,000.00);

2. That I/we executed on July 14, 2005, a Deed of


Absolute Sale between the closed CRBAklan (Bank)
covering the property particularly described under
Tax Declaration No. 05-004-00276 (new)/Tax
Declaration No. 93-004-0176 (old) of the Registry of
Deeds for the Province of Aklan;

3. That the property was fully paid to CRB AKlan


(Bank) on July 13, 2005 per Official Receipt No.
3333 and the Deed of Absolute Sale and the Tax
Declaration No. ARP/TD No. 93-004-0176
were released to me/us by the closed CRB Aklan
(Bank);

4. That I/we hereby further agree to hold the closed


CRB Aklan (Bank) or PDIC free and harmless for
any claim, loss or damage that may arise from the
Issuance of the Deed of Absolute Sale or
unauthorized use of the said Deed of Absolute Sale.
Should the closed CRBAklan (Bank) and/or PDIC
incur any loss or damage from the representations
hereof, I/we hereby agree to indemnify the closed
CRB AKlan (Bank) and/or PDIC for the same, in
addition to my/our other liabilities, civil or criminal,
that may arise herefrom;

5. That upon verification from the Municipal Assessor


of Altavas, Aklan, I was informed that the Tax
Declaration was registered in the name of Catmon
Catholic Chapel was issued basedby virtue of on
the actual a survey done conducted by the
Municipal Assessor of AltavasAssessor;

6. It was verified with the Municipal Assessor of


Altavas That there exists is no Deed of Donation in
favor of Catmo atholic Chapel nor a Deed of Sale on
file with the Municipal Assessor of Altavas,
Aklanwhich might serve as basis for in the
issuance of a new Tax Declaration;

7. That we were aware/knowledgeable of the


existence of the chapel when we purchased the
said lot;

8. That upon visitation of the property, I found out


that the chapel is made up of light materials
(bamboo) only.

9. That I/we hereby further agree to hold the closed


CRB Aklan (Bank) or and PDIC free and harmless for
any claim loss or damage that may arise from the
ownership and existence of the subject chapel.
Should the closed CRBAklan (Bank) and/or PDIC
incur any loss or damage from the representations
hereof, I/we hereby agree to indemnify the closed
CRB AKlan (Bank) and/or PDIC for the same, in
addition to my/our other liabilities, civil or criminal,
that may arise herefrom;

10. That I/we was/were not able to secure the


confirmation of Deed of Absolute Sale because were
both out of the country;

11. That I/we have no outstanding obligation with


the closed CRB Aklan (Bank) and if it should have
been discovered that I/we have unpaid obligations
with the bank, I/we undertake to pay the same to
the closed CRB aklan (Bank);

12. That I/we am/are executing this affidavit to


secure the Deed of Absolute Sale and Cancellation
of Real Estate Mortgage on Tax Declaration No. 05-
004-00276 (new)/ TD No. 93-004-0176 (old) from
the Receiver/Liquidator of CRB Aklan. (Bank), and
to attest to the truth and veracity of the above
allegations.
