VERALLO unto this Honorable Office most respectfully alleges:
1. That he specifically denies the material allegations in the
charge sheet against him for simple neglect of duty for being not around during the second round inspection at MacDonalds Police assistance desk at about 8:00 o’ clock in the morning of September 29, 2019 as the basis thereof was a result of misapprehension of facts, the truth of which are those alleged in his special affirmative defenses;
SPECIAL AFFIRMATIVE DEFENSES
Respondent hereby repleads and incorporates the above
allegations insofar as they are relevant thereof and further allege:
2. That on September 29. 2019 at around 5:30 in the
morning during the first round of inspection by Police Captain JOSE B GALLANES JR. (SDO), he verbally asked permission from said SDO that he may be permitted to leave his post in order for him to accompany his son who was taking the PRC LET examination on that day and to return to post thereafter which the former consented;
3. That after said permission, he left from his post (Mc
Donald PADS) to fetch his son, Aldriniel Verallo, Jr., at their residence at Brgy. 91, Kassel City, Tacloban and accompanied him to his 2
assigned examination center at Sagkahan National High School then
returned to his post thereafter;
4. That however, while on duty, at around 7:00 am in the
morning of same date, he received call and text messages from his son that his admission slip was left inside the drawer in his house. In his haste, he informed his buddy on duty at that time, PCpl Esmeraldo Ripalda, about his son’s predicament and immediately went home and retrieved the admission slip and went back to Sagkahan National High School and it handed to his son at the gate at around 7:45 am, as shown by his affidavit hereto attached as Exhibit “1” and made integral part hereof;
5. That due heavy merging traffic at that time, he was only
able to return to his post of assignment at about 8:45 am of same date and at about 9:00 am the incoming duty was already on post;
6. That based on the aforesaid facts, it is his humble
submission that his absence during the second round of inspection did not violated any lawful order tantamount to simple neglect of duty but rather due to urgent circumstances that arose that time beyond his control;
7. That in his more than twenty three (23) years of police
service, he was never been administratively penalize for any wrongdoing and recipient of numerous awards and commendations as shown by the General Orders hereto attached as Exhibit “2” and series and made integral parts hereof ;
8. That he also attended several trainings, lectures and
seminar as shown by the certificates hereto attached as Exhibit “3” and series and made integral parts hereof;
9. That respondent hereby manifest that he himself and his
son, Aldriniel Verallo, Jr, are his only witnesses and both of their addresses is at Blk5 Lot 21 Iloilo St., Kassel City Subdivision, Tacloban City; (note: Brgy. 91 San Jose Tacloban ha affidavit of explanation)
10. That his documentary evidence in support of this answer
are as follows, to wit:
