BARANGAY

SECRETARY

LEGAL BASIS:
(RA 7160, Section 387)

There shall be in each barangay:


* A punong barangay
* 7 sangguniang barangay members
* Sangguniang kabataan chairman
* Barangay secretary
* Barangay treasurer

APPOINTMENT:
appointed by the Punong Barangay
with the concurrence of the majority of
all the sangguniang barangay members
the appointment of the barangay
secretary shall not be subject to
attestation by the CSC

APPOINTMENT:
Q: Pending concurrence by the Sangguniang
Barangay, may the appointee already perform
the functions of the barangay secretary?

YES. Pending concurrence, the appointee


shall be allowed to discharge and
perform the powers, duties and
responsibilities pertaining to the office
and they shall be considered to be
holding a temporary appointment (Art II,
Sec 4, DILG MC No. 2002-150)

APPOINTMENT:
The appointee may assume the duties
and functions of a barangay secretary in
an acting capacity pending concurrence
However, once the Sangguniang
barangay expresses officially its nonconcurrence to the appointment, the
barangay secretary shall not be
anymaore allowed to perform her duties

APPOINTMENT:
Q: What is the extent of the power of
concurrence of the Sangguniang Barangay?
Power only to determine if the appointee
possess all the qualifications and none of the
disqualifications prescribed by RA 7160
If the appointee possesses all the qualifications
and none of the disqualifications, the
Sangguniang Barangay has to issue the
concurrence. (DILG Opinion No. 17-2009,
March 25, 2009)

APPOINTMENT:
Q: What if the Sangguniang barangay
refuse to act on the appointment?
Pursuant to Section 5 of RA 6713 (Code
of Conduct and Ethical Standards for
Public Officials and Employees), the
Sanguniang barangay shall act on the
appointment within 15 working days
from receipt of the appointment as
submitted by the Punong barangay
(Art II, Sec 5, DILG MC No. 2002-150)

QUALIFICATIONS:
of legal age
a qualified voter

an actual resident of the


barangay concerned.

DISQUALIFICATIONS
No person shall be appointed barangay
secretary if:
he is a sangguniang barangay member
a government employee
a relative of the punong barangay
within the fourth civil degree of
consanguinity or affinity

POWERS,
DUTIES and
FUNCTIONS

Keep custody of all records of the


sangguniang barangay and the
barangay assembly meetings
Prepare and keep the minutes of all
meetings of the sangguniang
barangay and the barangay
assembly

Prepare a list of members of the


barangay assembly, and have the
same posted in conspicuous places
within the barangay;

Assist in the preparation of all


necessary forms for the conduct
of barangay elections, initiatives,
referenda or plebiscites, in
coordination with the COMELEC

Assist the municipal civil registrar


in the registration of births,
deaths, and marriages

Keep an updated record of all


inhabitants of the barangay
containing the following items
of information: name, address,
place and date of birth, sex,
civil status, citizenship,
occupation, and such other
items of information as may be
prescribed by law or ordinance

Submit a report on the actual number


of barangay residents as often
as may be required by the
sangguniang barangay

Exercise such other powers and


perform such other duties and
functions as may be prescribed
by law or ordinance.

Secretary of the Lupon ng Tagapamayapa
(Sec 403)
Declare the quorum during sessions of
the Sangguniang Barangay

QUORUM
Q: What constitutes quorum?

A majority of all the members of the


sanggunian who have been elected
and qualified shall constitute a
quorum to transact official business.
(Sec 53, LGC)

QUORUM
Q: What constitutes majority?

That which is greater than half of


the membership of the body.

in the determination quorum?

YES.
