A 19. EMERGENCIA SANITARIA (COVID-19) - PRÓRROGA SUSPENSIÓN DE TRANSPORTE

AÉREO DE PASAJEROS A DETERMINADOS DESTINOS - NUEVOS REQUISITOS SANITARIOS
Se comunica a la comunidad aeronáutica que, según lo establecido por el Decreto de Necesidad y Urgencia N°
411/2021 y por la Decisión Administrativa N° 643/2021, ambas normas del 25/06/2021 (publicadas en el Boletín
Oficial de la República Argentina –B.O.R.A.- el 26/6/2021), desde la fecha de su publicación y hasta el 9/7/2021
inclusive, resultan de aplicación las siguientes medidas:
1°. - La prórroga del cierre de fronteras. El MINISTERIO DE SALUD determinará los puntos de entrada al país,
trayectos y lugares que reúnan las mejores capacidades básicas para responder a la emergencia sanitaria por
COVID-19 declarada internacionalmente.
2°. - Excepcionalmente, la DIRECCIÓN NACIONAL DE MIGRACIONES podrá autorizar el ingreso de personas al
territorio nacional por medio de otros pasos fronterizos cuando concurran especiales y acreditadas razones
humanitarias que así lo ameriten, dando la correspondiente intervención a la autoridad sanitaria y al MINISTERIO
DE RELACIONES EXTERIORES, COMERCIO INTERNACIONAL Y CULTO.
3°. - Los gobiernos provinciales y de la Ciudad Autónoma de Buenos Aires podrán establecer lugares en los que
deberán realizar la cuarentena quienes ingresen al territorio nacional entre el 1/7 y el 31/8/2021. El costo asociado
a la estadía deberá ser asumido por las personas que ingresan al país.
4°. - Se prorrogan los requisitos que deberán observar las personas autorizadas a ingresar al territorio nacional
durante la vigencia de la emergencia pública en materia sanitaria en virtud de la pandemia declarada en relación
con la COVID-19, sean ellas:
a) transportistas o tripulantes de cualquier nacionalidad;
b) nacionales y residentes en la República Argentina, cualquiera sea su lugar de procedencia;
c) extranjeros autorizados expresamente por la DIRECCIÓN NACIONAL DE MIGRACIONES para desarrollar
una actividad laboral o comercial, o para cumplir con una misión oficial diplomática, o para participar en
eventos deportivos, o para su reunificación familiar con argentinos o residentes o;
d) extranjeros declarados en tránsito hacia otros países con una permanencia en el aeropuerto internacional
menor a VEINTICUATRO (24) horas.
Tales requisitos son:
1- Declaración Jurada Electrónica para el ingreso al territorio nacional.
2- Cumplir con la prueba de diagnóstico PCR 72 horas previas al viaje internacional con resultado negativo para
COVID-19 y acompañarla a la Declaración Jurada Electrónica, excepto:
a) los transportistas y tripulantes internacionales y los nacionales o extranjeros en tránsito hacia otros países
con una permanencia menor a 24 horas en aeropuertos nacionales;
b) quienes hayan presentado COVID-19 en los 90 días previos al ingreso al país, confirmado por laboratorio;
en tal caso, deberán acreditar los resultados de las pruebas diagnósticas para SARS-CoV-2 y agregar el alta
médica luego de haber pasado más de diez días del diagnóstico y
c) quienes no puedan realizar la prueba PCR en origen por una causa debidamente justificada deberán contar
con una certificación médica que acredite que no tienen síntomas compatibles con COVID-19, emitida también
al menos 72 horas antes de viajar, que deberá agregarse a la declaración jurada electrónica y además
deberán realizar el estudio PCR en el lugar de destino. Cuando el test PCR se hizo en origen y se demora el
vuelo, se admite la extensión del plazo de vigencia del resultado del test por 24 horas prorrogable luego, sólo
si la empresa aérea garantiza la trazabilidad y aislamiento de los pasajeros durante ese mayor tiempo.
3- Realizar una prueba para SARS-CoV-2 al arribo al país y otra al séptimo día del ingreso como condición de
finalización del aislamiento obligatorio.

A 19. (COVID-19) SANITARY EMERGENCY - EXTENSION OF THE SUSPENSION OF AIR
TRANSPORT OF PASSENGERS TO CERTAIN DESTINATIONS - NEW SANITARY REQUIREMENTS
The aviation community is hereby informed that, in accordance with the provisions of the Decree of Necessity and
Urgency No. 411/2021 and of Administrative Decision No. 643/2021, both of them of 25 June 2021 (published in the
Official Gazette of the Republic of Argentina –BORA– on 26 June 2021), since the date of their publication and until
9 July 2021, including that date, the following measures shall be applicable:
1st - Extension of border closure. The MINISTRY OF HEALTH shall determine which are the points to enter the
country, itineraries and places having the best basic capacities to respond to the internationally declared sanitary
emergency due to COVID-19.
2nd - Exceptionally, the NATIONAL DIRECTORATE OF MIGRATION may authorize the entry of persons into the
national territory through other border crossings in case of special and accredited humanitarian reasons, when
necessary, with the corresponding intervention of the sanitary authority and of the MINISTRY OF FOREIGN
AFFAIRS, INTERNATIONAL TRADE AND WORSHIP.
3rd - The governments of the provinces and of Ciudad Autónoma de Buenos Aires may establish places in which
those entering the national territory between 1 July and 31 August 2021 shall stay in quarantine. The costs associated
with such stay shall be borne by the persons entering the country.
4th - The requirements to be complied with by the persons authorized to enter the national territory during the period
of validity of the public sanitary emergency due to the pandemic declared in relation to COVID-19 are also extended,
being such persons:
a) carriers or crew members of any nationality;
b) nationals and residents of the Republic of Argentina, regardless of their place of origin;
c) foreigners expressly authorized by the NATIONAL DIRECTORATE OF MIGRATION to develop a work or
commercial activity, or to comply with an official diplomatic mission, or to participate in sport events, or to
gather with their relatives, either nationals or residents in our country; or
d) foreigners declared to be in transit to other countries with a stay in the international airport of less than
TWENTY-FOUR (24) hours.
These requirements are as follows.
1- Electronic Affidavit for entering into the national territory.
2- Comply with the PCR diagnostic test 72 hours prior to the international trip with a negative result for COVID-19,
and attach it to the Electronic Affidavit, except:
a) international carriers and crewmembers and nationals or foreigners in transit to other countries with a stay
of less than 24 hours in national airports;
b) those who have presented laboratory-confirmed COVID-19 in the 90 days prior to entering into the country;
in such case, they must accredit the results of the diagnostic tests for SARS-CoV-2 and add the medical
discharge more than ten days after the diagnosis, and
c) those who cannot perform the PCR test at origin for a duly justified reason must have a medical certification
proving that they do not have symptoms compatible with COVID-19, also issued at least 72 hours before
traveling, which must be added to the electronic affidavit, and they must also undergo the PCR study at place
of destination. When the PCR test was performed at origin and the flight is delayed, the extension of the validity
period of the test result for 24 hours is allowed, which can be extended later, only if the airline ensures the
traceability and isolation of the passengers during such longer period.
3- Perform a test for SARS-CoV-2 upon arrival in the country and another one on the seventh day of entry as a
condition for the completion of mandatory isolation.

4- Quienes resulten negativo en la prueba realizada al arribo deberán cumplir con el aislamiento obligatorio en los
lugares que las autoridades provinciales y de la Ciudad Autónoma de Buenos Aires indiquen al efecto por el término
de SIETE (7) días desde la toma de la muestra del test realizado al momento de ingreso al país. De resultar positivo
el test practicado al séptimo día de arribo al país, el laboratorio interviniente deberá arbitrar los recaudos para que
la autoridad nacional competente secuencie genómicamente la muestra y la autoridad sanitaria local realice el
inmediato rastreo de los contactos estrechos de esos viajeros.
5- El costo de las pruebas deberá ser asumido por la persona que ingresa al país y deberá efectivizarse en la forma
que establezcan las autoridades competentes.
5°. - Continúan exceptuados de cumplir cuarentena en la medida que cumplan los protocolos establecidos:
a) Los transportistas y tripulantes internacionales en exclusivo ejercicio de su actividad;
b) Los diplomáticos y los funcionarios exclusivamente para cumplir una misión oficial, autorizados por la
DIRECCIÓN NACIONAL DE MIGRACIONES, bajo supervisión del MINISTERIO DE RELACIONES
EXTERIORES, COMERCIO INTERNACIONAL Y CULTO o el Ministerio competente;
c) Los deportistas solo en los casos de eventos deportivos debidamente autorizados por la DIRECCION
NACIONAL DE MIGRACIONES, con protocolos propuestos por los organizadores, aprobados por la autoridad
sanitaria nacional y supervisados por el MINISTERIO DE TURISMO Y DEPORTE;
d) Los extranjeros no residentes autorizados expresamente por la DIRECCIÓN NACIONAL DE
MIGRACIONES para desarrollar una actividad laboral o comercial esencial y;
e) Los nacionales o extranjeros en tránsito hacia otros países con una permanencia menor a 24 horas en
aeropuertos nacionales.
6°. - Además, los operadores y las terminales de transporte continúan obligados a difundir las restricciones y
recomendaciones para viajeros y se les encomienda el estricto cumplimiento de los protocolos sanitarios; sobre sus
aislamientos, trazabilidad y restricciones; la realización de los testeos y controles sanitarios periódicos que pudieran
fijarse, mediando con acuerdos interjurisdiccionales internacionales y/o nacionales para prevenir su innecesaria
duplicación; limitarles viajes sin test PCR o cuarentena cuando exceden su permanencia en el lugar de destino de
más de 24 horas, si no acreditan la trazabilidad de sus desplazamientos, o su aislamiento mientras no operan o
tripulan un medio de transporte y mantener las restricciones de relevos de tripulaciones internacionales.
7°. - Las tripulaciones aéreas internacionales compuestas por personas extranjeras deben cumplir con los
protocolos que defina la autoridad sanitaria nacional, para asegurar su trazabilidad y movilizarse dentro del país bajo
la modalidad burbuja, con estricta supervisión de los operadores de transporte respectivos.
8°. - Las tripulaciones aéreas internacionales compuestas por personas nacionales o residentes en el país deben
someterse a testeos con antígenos al menos cada QUINCE (15) días o plazo menor que podrá estipular la línea
aérea.
9°. - Los operadores de transporte internacional están obligados a hacer cumplir a los respectivos tripulantes y
transportistas las exigencias indicadas. La autoridad sanitaria, de acuerdo con la situación epidemiológica existente
en origen y/o destino, podrá, de conformidad con la normativa dispuesta en el marco de la emergencia sanitaria,
pautar obligaciones adicionales.
10°. - Cuando se constate la existencia de infracción al cumplimiento de las medidas establecidas para la protección
de la salud pública en el marco de la emergencia sanitaria, se procederá a hacer cesar la conducta infractora de
inmediato y se formularán las denuncias penales pertinentes.
11°. - La ADMINISTRACIÓN NACIONAL DE AVIACIÓN CIVIL (ANAC) dispondrá y mantendrá la suspensión de las
autorizaciones y de los permisos que se hubieran dispuesto relativos a las operaciones de transporte aéreo de
pasajeros en vuelos directos que tengan como origen o destino el REINO UNIDO DE GRAN BRETAÑA E IRLANDA
DEL NORTE, la REPÚBLICA DE TURQUÍA y países del continente africano y como origen la REPÚBLICA
FEDERATIVA DE BRASIL, la REPÚBLICA DE CHILE y la REPÚBLICA DE INDIA, ante el nuevo linaje en la
secuenciación de muestras locales, respecto del ingreso de personas. El MINISTERIO DE TRANSPORTE, a través
de la ANAC, podrá ampliar o reducir la nómina de países, o establecer excepciones al presente artículo, con el fin
de atender circunstancias de interés nacional.
12°. - La ANAC, actuante en el ámbito del MINISTERIO DE TRANSPORTE, dispondrá un cupo de SEISCIENTAS
(600) plazas diarias en vuelos para el reingreso al territorio nacional de los argentinos y residentes que se encuentren
en el exterior. Además, podrá ampliar, disminuir o eliminar el citado cupo, previa intervención de la autoridad sanitaria
nacional. La ANAC, en coordinación con la DIRECCIÓN NACIONAL DE MIGRACIONES, adoptará los recaudos
para mantener dicho flujo diario.

4- Those who may obtain a negative result in the test performed upon arrival shall comply with the mandatory
isolation in the places that the authorities of the provinces and of Ciudad Autónoma de Buenos Aires indicate for that
purpose for a period of SEVEN (7) days since the sample collection of the test performed when entering the country.
In case of a positive result in the test performed on the seventh day upon arrival in the country, the laboratory involved
shall take the measures so that the competent national authority can sequence the genome of the sample, and the
local sanitary authority can immediately trace the close contacts of the traveler.
5- The costs of the tests shall be borne by the person entering the country and shall be carried out in the manner
established by the competent authorities.
5th - The following persons are still exempt from complying with the quarantine as long as they comply with the
protocols established:
a) International carriers and crewmembers, exclusively if they are fulfilling their specific duties;
b) Diplomats and officials exclusively to fulfil an oficial mission with the authorization of the NATIONAL
DIRECTORATE OF MIGRATION, under the supervision of the MINISTRY OF FOREIGN AFFAIRS,
INTERNATIONAL TRADE AND WORSHIP or the competent ministry;
c) Sportsmen and sportswomen only in the case of sport events duly authorized by the NATIONAL
DIRECTORATE OF MIGRATION, with protocols suggested by the organizers, approved by the national
sanitary authority and supervised by the MINISTRY OF TOURISM AND SPORTS;
d) Non-resident foreigners with the express authorization of the NATIONAL DIRECTORATE OF MIGRATION
to develop a working or comercial essential activity;
e) Nationals or foreigners in transit to other countries staying less than 24 hours in national airports.
6th - In addition, transport operators and terminals continue to be obliged to disseminate the restrictions and
recommendations for travelers, and are entrusted with the strict compliance of sanitary protocols; on their isolations,
traceability and restrictions; the performance of periodic sanitary tests and controls that may be established,
mediating with international and/or national interjurisdictional agreements to prevent their unnecessary duplication;
limit their trips without PCR test or quarantine when they exceed their stay in the place of destination for more than
24 hours, if they do not prove the traceability of their movements, or their isolation while they do not operate or crew
a means of transport and maintain the restrictions of international crew reliefs.
7th - Any international flight crew with foreign members must comply with the protocols defined by the national
sanitary authority to ensure the traceability and to move within the country under the “bubble” modality, with the strict
supervision of the respective transport operators.
8th - Any international flight crew with nationals or residents in the country must undergo antigen tests at least every
FIFTEEN (15) days or in a shorter period that may be stipulated by the airline.
9th - The international transport operators are bound to make the respective crewmembers and carriers comply with
the indicated requirements. The sanitary authority, according to the epidemiological situation existing at origin and/or
destination, may establish additional obligations, in accordance with the regulations stipulated within the framework
of the sanitary emergency.
10th - When it is proved that the measures established for the protection of public health within the framework of
the sanitary emergency are not complied with, the offender shall be asked to cease immediately his/her infringing
conduct, and the pertinent criminal charges may be presented.
11th - The NATIONAL CIVIL AVIATION ADMINISTRATION (ANAC) shall establish and maintain the suspension of
the authorizations and permits that may have been granted in relation to the operations of air transport of passengers
in direct flights that have as origin or destination the UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN
IRELAND, the REPUBLIC OF TURKEY and countries of the African continent, and as origin the FEDERATIVE
REPUBLIC OF BRAZIL, THE REPUBLIC OF CHILE and the REPUBLIC OF INDIA, in view of the new lineage in the
sequencing of local samples, with respect to the entry of persons. The MINISTRY OF TRANSPORTATION, through
ANAC, may expand or reduce the list of countries, or establish exceptions to this title, in order to meet circumstances
of national interest.
12th - ANAC, acting within the scope of the MINISTRY OF TRANSPORT, shall maintain an availability of SIX
HUNDRED (600) seats per day for the re-entry into the national territory of nationals and residents in the country
who are abroad. It may also enlarge, reduce or eliminate such number of seats with the previous intervention of the
national sanitary authority. ANAC, in coordination with the NATIONAL DIRECTORATE OF MIGRATION, shall adopt
the measures to maintain said daily flow.

13°. - Para el ingreso gradual al país, el MINISTERIO DE TRANSPORTE, a través de la ANAC, la DIRECCIÓN
NACIONAL DE MIGRACIONES y la autoridad sanitaria nacional coordinarán las acciones para determinar los
parámetros a aplicar a las operaciones de servicios de transporte internacional de pasajeros según las capacidades
operativas de los pasos internacionales habilitados. La ANAC y la DIRECCIÓN NACIONAL DE MIGRACIONES, en
sus respectivos ámbitos de competencia, podrán establecer otras excepciones con el fin de atender circunstancias
de necesidad.
14°. - Sin perjuicio de ello, el efectivo ingreso de personas y/o medios de transporte autorizados estará supeditado
al estricto cumplimiento de las condiciones vigentes al momento del ingreso.
15°. - Se suspenden en todo el país los viajes grupales de egresados, jubilados y de estudio, para competencias
deportivas no oficiales, de grupos turísticos y de grupos para la realización de actividades recreativas y sociales.

13th - For the gradual entry of passengers to the country, the MINISTRY OF TRANSPORT, through ANAC, the
NATIONAL DIRECTORATE OF MIGRATION, and the national sanitary authority shall coordinate the actions to
determine the parameters to be applied for the operations of international services for the transportation of
passengers according to the operational capacities of the authorized international crossings. ANAC and the
NATIONAL DIRECTORATE OF MIGRATION, in their respective areas of competence, may establish other
exceptions in order to meet circumstances of interest.
14th - Notwithstanding the foregoing, the effective entry of persons and/or authorized means of transportation shall
be subject to strict compliance with the conditions in force at the time of entry.
15th - Group trips for graduates, retired people and students, for non-official sport competitions, for tourist groups
and groups for recreational and social activities are suspended throughout the country.
