There is no commercial freedom of panorama in Abkhazia. The building was built in 1947 and designed by architects Цинцабадзе С. and Камоев Н. (source) who might not be dead for more than 70 years. Using Georgian freedom of panorama is of no use too as it is also non-commercial, but non-commercial license is not accepted on Commons.

No evidence that the image is under an acceptable free licence. This picture is scanned from a Book that is publicly available and the original photographer is unknown
This photograph and the book are available in many magazines,articles,and newspapers both online and offline !!
As a novice editor when I uploaded I wasn't able to find any suitable section under which I can place this picture on Wikimedia Commons ,
So I placed it under own work section since there was no other suitable section that I can place it to.
One think I can assure is that it is copyright free since it is already in use from decades in books,articles etc with no mention about the photographer
Further I found many more photographs on commons lablelled as own work which actually are very old and either scanned or digitalised from various online sources,So as a newbie I thought that if their is no other option we have to by default put it in the OWN WORK section
I request you, with all sincerity if possible you can chnage authorship to any relevant section or suggest me a section so that I can edit the authorship ,by your experience and guidance ,instead of deleting a valuable and historically important asset from Wikimedia.
I have said all I can,and I assure that whatever may be the decision which respected administrators take regarding this photograph, I will abide by it and even if they need to suspend/ban my account I will accept their decision with utmost respect .

These images were all uploaded by myself. I transferred from Flickr via #flickr2commons. At first, I batch uploaded photos by Tran Anh Khoa (zorrotran) because I thought most of those are images of inanimate objects. I didn't expect there were so many photographs of people. While I don't think there are copyright issues, I think there might be some ethical issues. Some of these pictures might also be out of scope. And if there is a reason to show up the reading of the pronounced word, there is a special {{Pronunciation file}} template on Commons which contains an IPA field for adding the IPA transcription for the word. JoBu1999, the problem is not with the rights of the gallery. There is the copyright of the painter protected until 70 years after his death. So legally you can upload this picture after January 1 of 2028, not earlier, - or provide the permission from the painters heir whoever he or she is. Theoretically, this would fall under WP:FREER, but then that'd likely be interpreted in a way that supports deletion and would thus require a Wikipedia/Wikimedia contributor to acquire a dark blue Royal Marines beret, photograph it, and publish the photo on Wikipedia/Wikimedia (I've just hopped onto eBay and can see several examples for under £20 - money's a bit tight on my end at the moment, so unfortunately I can't personally help out) or some British Armed Forces militaria collector with a dark blue Royal Marines beret to publish photos of their wares under a Wikimedia-compatible licence (and if that was the case for at least one such collector, there'd be far, far more photos of British military kit on this site...).

About law: no FoP in France and no FoP in Russia, so it's the same. About de minimis IMHO it's. The statue is really huge, the figure itself measures 52 metres (170 feet) and the sword 33 metres (108 feet), 87 metres (279 feet) from the tip of its sword to the top of the plinth (from en.Wiki). South Africa does have FoP for videos actually, just not photos. The photos look like they are focusing on the building to me, except probably File:At Cape Town (MP) 2018 114.jpg, which is a bit wider scene. However... if the building is from the 1920s, it would only be elements added later which would have a longer copyright -- the copyright on the entire building doesn't get extended. What were the 2017 modifications? If a photo is focusing on those modifications, then it could be a problem it sounds like. But if not, then technically a photo of the otherwise-PD building could be a "wider scene" itself which unavoidably captures those modifications ("incidental"). Presuming the original building is out of copyright, I would probably keep most. Copyright cases of building photos being ruled derivative are few and far between, though we know of at least one, so they do exist. However, they would seem pretty much on the edge of how far copyright extends. I don't know of any court case examples of photos of buildings where only renovations are under copyright, though if a photo is focusing on those in particular, it's a reasonable case to be made. But we often do keep photos which are of a larger scene, where the copyrightable work is just an unavoidable part (there have been rulings along those lines). As such, to me, any photo which is mainly focusing on the building, and not the renovations in particular, we should probably keep. You could make the case for deletion on File:At Cape Town (MP) 2018 103.jpg, and maybe File:At Cape Town (MP) 2018 112.jpg and File:At Cape Town (MP) 2018 113.jpg, as focusing more on the new windows, but I would  Keep the rest. If the original building is still under copyright, probably everything except File:At Cape Town (MP) 2018 114.jpg would be a problem unfortunately. South Africa is 50pma, but if the architect is anonymous, it would have expired 50 years after it was built, so in the 1970s, so the architect's name would have had to be known before that time in order for it to be based on their lifetime.     • I agree it's a derivative work, but more than simple de minimis. Per the Ets-Hokin decision, a photograph would not be derivative (of the windows) unless it was actually focusing on them. In that decision, a photograph of a bottle would not be derivative of a copyrightable label on the bottle, unless focusing on the label in particular. I think that is the situation here for several of the photos -- yes the additions would have their own copyright, and photos focusing on them are not OK (and there are a couple of those too), but (similar to the French cases), a photograph of a wider scene which happens to contain a copyrighted object is still OK, even if prominent. A photograph of the full building would then be a "wider scene" to me, with the windows being "incidental". We mention this on Commons:De minimis, particularly in the French section, but it's a different concept than actual legal de minimis (since copyrighted elements can be front and center, and far from de minimis, in such photos yet still be OK).       • In my opinion the entire upper half is part of the new architects' creative work; for example, though the grid is original, they made an architectural choice to leave it and juxtapose it with the central segments, resulting in a new design not created by the original architect. So IMO any photos which have the upper half as a primary element exceed COM:DM.         • In general, you only get a copyright for expression you add -- leaving someone else's work there is still someone else's work. It may be a choice, but that's not what creates copyright. From the U.S. Copyright Office, The copyright in a derivative work covers only the additions, changes, or other new material appearing for the first time in the work. Protection does not extend to any preexisting material, that is, previously published or previously registered works or works in the public domain or owned by a third party. It's hard to argue a selection and arrangement copyright either, since the placement of the existing work stayed the same. Similarly, just changing a color might be a choice, but it's not a copyrightable change either. The visual impact of a work is also not used in determining a copyright -- only the expression that they actually added. From the same document, the use of the public domain material in a derivative work will not prevent anyone else from using the same public domain work for another derivative work. So using existing parts may make the new building look more attractive, but it can't prevent someone else from using the older parts as, say, part of their photograph either.           Thanks, seems I'm wrong about the borders. However I still believe the new component is more significant than de minimis, making up the majority of the surface area of the central focus of most of these images (excluding the 3 I mentioned above).
          Re: "it can't prevent someone else from using the older parts" - this is true only if it's possible to use the older parts without infringing on the newer parts. In effect it's similar to if a large professional mural were drawn on the building - photos in which the mural is a significant component won't be allowed, even if the building might be PD and if a similarly framed photo would have been OK prior to the mural. -M.nelson (talk) 23:19, 11 December 2021 (UTC)[reply]
          I agree it's more than de minimis. However, the situation in the French photographs, and the Ets-Hokin decision, were a different legal theory than de minimis. They are basically saying there is a balance between the photographer's rights versus those of the underlying works -- there is a dividing line between what is a derivative photograph, under control by another author, versus one that simply happens to contain another work but which is not "based" on it enough to be derivative. We do not delete pictures of people wearing clothes which have a copyrightable pattern on them, for example. The French case was pretty much exactly that -- the copyrighted building was a significant part of the photo (more than de minimis), but since the photo was of a larger subject where the building was unavoidably contained, it was not a derivative photo. There was a somewhat related discussion recently, at Commons:Village pump/Copyright/Archive/2021/11#Misuse_of_de_minimis_on_Commons. Nothing in this area is easy, but all the cases I know of follow roughly that distinction -- a photo of a larger subject (bottle, street, motorcycle) means items which are unavoidably present (label, building, artwork), do not cause the photo to be derivative even if fairly prominent. A photographer should have the right to make a photo of a PD building, even if certain elements are newer and still under copyright. For photos focusing on a copyrighted work in particular, or going out of their way to intentionally include a copyrighted element (even if not so prominent), those can be problems. I just don't see it here, other than the three that I mentioned that seem to be focusing on the windows themselves -- most seem to be of a larger subject than the new works. @Liuxinyu970226: What sculpture are you talking about? There is a metal industrial element attached to the building, but it was apparently part of the original grain silo workings -- there is a 1924 photo on this page which shows it there, so it has simply been preserved. So it's old, and not a sculpture. And even if it was, the same principle would apply -- the photos are not focusing on that item, so it's just part of a wider scene I would think. Kept: most per Carl Lindberg (though most of his arguments seem to be based on US precedents, but do we have any better?), deleted the three he mentioned. I couldn't find the architect of the original building, so I'm not sure if it is still protected or not. South Africa has 50 years pma though, which means {{PD-old-assumed}} is 100 years instead of the usual 120, so I'll go with that instead. --Rosenzweig τ 19:09, 28 April 2022 (UTC)[reply]
