Whereas, in line with the principle of parens patriae, the government

shall protect and promote the moral, spiritual and intellectual development of
the youth.

Whereas, the natural and primary right and duty of parents in the
rearing of the youth shall receive the support of the local government;

Whereas, it is the duty of the local government to foster the education of


every child in the municipality. Thus, the local government shall establish and
maintain a system of scholarship grants, student loans programs, subsidies
and other incentives which shall be available to deserving students in both
public and private schools, especially the underprivileged;

Whereas, experience dictates that the reward or incentive system will


make people work harder and strive for the betterment. Therefore, the system
shall encourage students to be better and aim for excellence;

Whereas, it is just and right to commend those students or persons who


have brought sense of pride in the municipality.

Hence, this Ordinance.

ORDINANCE NO. ______________

Section 1. Title. This ordinance shall be known as “An Ordinance Granting


Incentives to Students who Excel in Academic Competition and Academic
Excellence and Appropriating Funds thereof”.

Section 2. Scope. This ordinance shall be applied to all residents of the


Municipality of Laguindingan.

Section 3. Academic Competitions. For the purpose of this ordinance,


academic competitions shall refer to the academic related competitions in the
local, regional or national level by and are duly organized by local or national
government agencies.
Section 4. Academic Competitions within the Municipality. Incentives
or rewards shall be given to students who placed gold, silver or bronze (1 st, 2nd
or 3rd place) in an academic competition which is organized by the local
department of education and is conducted within the Municipality

Section 5. Academic Competitions outside the Municipality. Incentives


or rewards shall be given to elementary or secondary students who represent
the Municipality or the School located within the Municipality placed gold,
silver or bronze (1st, 2nd or 3rd place) in an academic competition duly organized
by the government authorities.

Section 6. Awards of Excellence. Incentives or rewards shall be given to


college students who graduated as Cum Laude, Magna Cum Laude or Suma
Cum Laude irrespective of schools in which they have attended.

Section 7. Top-notchers. Incentives or rewards shall be given to any person


residing in the municipality who placed Top Ten (10) in any board or licensure
examination regulated by the Professional Regulatory Commission.

Section 8. Amount of Incentives. The following are the amounts of


incentives entitled to the grantees:

Section 9. Residency Requirement. A grantee must be a bona-fide resident


of the municipality for 2 years before the date of the competition or award and,
except for minors, must be a registered voter of the Municipality. However,
when the participant is a non-resident but he had represented the School
located in the municipality, the reward shall be given to the school.

Section 10. Resident but Outside. A student, elementary or secondary,


who receives an award from an academic competition but representing a school
located outside Laguindingan shall receive an amount equivalent to one-half
(1/2) of the reward/incentive due to a student who studies in Laguindingan as
provided in Section 8.

Section 11. The Board. There is hereby established a Board of Incentives of


the Municipality of Laguindingan which shall be composed of the following:

Chairman : Municipal Mayor

Co-Chairman, Municipal Vice Mayor

Vice-Chairman : SB Member, Chairman of Committee on Education

Member : Municipal Budget Officer

SK Federation President, if any

Schools District Supervisor

School Heads

Municipal Treasurer

Representative from COMELEC

2 NGOs Representatives

(Preferably, youth oriented organizations)

Section 12. Powers and Functions. The Board shall implement the
provisions of this ordinance and shall exercise necessary powers or functions
for the effective implementation hereof. It shall also recommend any
amendment or revision of this ordinance.
Section 13. Procedure of Claim. Any student or person who intends to
claim an incentive shall undergo to the following procedures:

a. The grantee send a letter to the Municipal Mayor expressing his


intent to avail or claim the incentives herein provided and shall
present or attach the following :

i. Certificate, documents or other proofs of his


award/achievement;

ii. Barangay Certificate;

iii. Voters ID or Certification from the COMELEC except minors;


and

iv. School ID

v. Transcript of Records (For Excellence Award only)

b. The Municipal Mayor shall within 10 days call for a special


meeting or shall convene the Board for the purpose of validation of
the claim;

c. The Board shall issue a resolution whether or not the applicant is


entitled with the claim.

d. The Municipal Budget Officer shall be responsible for the


preparation of documents for the remuneration.

Section 14. Prospectivity of Ordinance. This ordinance shall apply


prospectively and shall not apply to cases or events occurred prior to its
effectivity.

Section 15. Separability Clause. Any provision of this ordinance which is


in effect or declared as in violation of the Constitution, laws, regulations or
ordinances shall not affect those provisions which are valid.

Section 16. Effectivity. This ordinance shall take effect on January 1,


2018.
