Philippines Legal Basis


Access to Quality Education. The State shall ensure that disabled persons are
provided with access to quality education and ample opportunities to develop their
skills. It shall take appropriate steps to make such education accessible to all
disabled persons. It shall be unlawful for any learning institution to deny a disabled
person admission to any course it offers by reason of handicap or disability. The
State shall take into consideration the special requirements of disabled persons in
the formulation of educational policies and programs. It shall encourage learning
institutions to take into account the special needs of disabled persons with respect
to the use of school facilities, class schedules, physical education requirements, and
other pertinent consideration. The State shall also promote the provision by learning
institutions, especially higher learning institutions of auxiliary services that will
facilitate the learning process for disabled persons. (CHAPTER II EDUCATION, RA

WHEREAS, the national government recognizes responsibility to provide the
handicapped with the fullest measure of protection and assistance to help develop
their abilities in all fields of endeavor and to promote their integration into the
mainstream of society, as well as its primary duty for the prevention of physical and
mental disabilities; (Presidential Decree 1509. OFFICE OF THE PRESIDENT OF

States Parties recognize the right of persons with disabilities to education.
States Parties shall ensure an inclusive education system at all levels, and life-long
learning, directed to:
(a) The full development of the human potential and sense of dignity and self
worth, and the strengthening of respect for human rights, fundamental freedoms
and human diversity;
(b) The development by persons with disabilities of their personality, talents and
creativity, as well as their mental and physical abilities, to their fullest potential;
(c) Enabling persons with disabilities to participate effectively in a free society.
