Provision of Structural Underwater Inspection For Block PM8 (E) as specified below

SECTION I: INSTRUCTIONS TO BIDDERS
Bidder is required to adhere strictly to the instructions detailed herein. Deviation from these
instructions may result in Bidders Bid Disqualification.
1. Compliance to Tender
Bidder's Bid MUST comply with all the specifications, terms and conditions referred to in
this ITB.
Non-compliance to this requirement may result in Bidder being disqualified without any
advance notice.
2. Acknowledgement and Express Bidders Intention to Tender

Upon receipt of this ITB, Bidder shall within two (2) days using the Bid Acknowledgement
letter as provided in the Attachment 1-A Bid Acknowledgement Form, whether or
not Bidder intends to submit its Proposal by e-mail to Companys Tender Secretary at
TenderSecretary.Malaysia@EnQuest.com.
3. Format of Bidders Bid Proposal

Bidder shall prepare and provide its proposal in accordance with the proposal
organization as specified below:

4.3 Except under exceptional circumstances, no extension of the time and date by which
Bidders shall submit their Bid will be granted.
4.4 The closing date/time for this tender is 30 June, 2015@1400 HRS. Late
submission of proposal may be rejected. Failure to respond to this tender will be
interpreted as a rejection to participate in the bidding exercise.
5. Bid Query
5.1 Any questions regarding this tender shall be forwarded to the Tender Secretary at
TenderSecretary.Malaysia@EnQuest.com prior to the specified Closing Date. Any
further information, interpretation, advice or modification given by or agreed upon by
the Company shall be distributed to all Bidders by fax without revealing the identity of
the original enquirer.
5.2 Except as provided herein, Bidders are not permitted to contact or communicate
with any member of the Company staff or its consultants on any matter relating to
this Bid. Uninvited visits to the Company offices to discuss the Invitation to Bid are
not allowed. Bidders who violate this Instruction to Bidders should expect to
immediately and unconditionally be disqualified.
6. Compliance with PETRONAS License

Bidder shall possess a valid PETRONAS License, for the service(s)/product(s) contained
within this Enquiry prior to the Closing Date. Bidder shall provide a copy of the license
for the appropriate category with the Tender. Should Bidders PETRONAS license have
expired, Bidder shall provide all relevant documents evidencing license renewal
application and PETRONAS intent to renew. An award shall only be made to a Bidder
with a valid PETRONAS License.
7. Schedule of Prices
7.1 The CONTRACT price shall be as specified in Section 2, Exhibit II : Contract
Price Schedule and shall remain firm for the CONTRACT duration. No other
charges or payment are applicable.
7.2 Prices quoted shall be in Ringgit Malaysia (RM). No other currency is acceptable to
the Company unless agreed upon.
7.3 Any discount(s) offered shall be stated separate from Bidders unit price(s).
8. Bid Validity
Bids are to be valid for at least 90 days from the Closing Date.
9. Deviation and Exception

Deviation from the Companys requirement in Section 2, Exhibit I : Scope of Work of
this Bid is not allowed and is ground for disqualification. Proposals for alternate or
equivalent product(s) shall be supplemented with relevant technical information and
submitted together with the Bid.
10. Rejection of Bid

10.1 All information submitted by Bidder in the Bid should be clearly defined to avoid
ambiguity or misinterpretation. The Company hereby reserves the right to request
further information it may deem necessary to evaluate the Bid.
10.2 The Company reserves the right to accept ALL, PARTIAL or NONE of Bidders bid and
shall be under no obligation to explain the reasons thereof.
11. Suspension or Cancellation of Bid

The Company reserves the right to suspend or cancel, before or after the Bid Closing
Date and prior to the Award Date, this ITB in whole or part without specifying any reason
for its decision. The Company will be under no obligation whatsoever to make
compensation or any other payment to the Bidder or its sub-Contractor in connection
with such suspension or cancellation.
12. Right of Access

The Company or its authorized representative shall have the right of access to Bidder's
premises for the purpose of carrying out inspection and verification (Pre-award
equipment and materials inspection and acceptance) on the equipment and materials
being manufactured or serviced, if required. Bidder shall provide necessary assistance
or information required by the Companys employee or authorized agent.
13. Preparation of Bid

Bidder shall bear responsibility for and pay all costs and expenses and other charges
incurred in preparing the Bid or for any subsequent cost relating to the Bid.
14. CONTRACT General Terms and Conditions

If awarded, the terms and Conditions of this contract shall be per the Contract Form of
Section 2 Draft Contract Document.
15. Others
15.1 Bidder is required to complete the Bid in black/blue ink (typed or hand-written) and
shall be in the English language.
15.2 Bidder shall adhere to the highest standards of internationally recognized business
ethics and in particular, has established precautions to strictly prevent any of its
officers, employees or agents from making, receiving or offering any gifts,
vacations, entertainment, payment, loans, shares or other considerations which
may influence individuals in respect of this ITB.
15.3 Bidders adherence to these Instructions to Bidders is strictly required. Bidder

should expect to be disqualified for failing to strictly follow these Instructions to
Bidders.

dated 23 June, 2015.
(a) If awarded the Work, the undersigned agrees to enter into a contract with the Company
under the terms and conditions of the contract included in the above referenced ITB and
that the information submitted by Bidder in their bid will be incorporated into the
contract.
(b) Bidder agrees to that their bid constitutes a firm offer to the Company which cannot be
withdrawn Ninety (90) calendar days from the Bid Closing Date.
(c) Bidder confirms it has fully satisfied themselves as to the extent, the nature of the Work
to be performed and has not included any pricing information in their Technical Bid,
which will result in disqualification.
(d) Bidder confirms and accepts that the Company is neither bound to accept the lowest or
any bid received nor obliged to assign a reason for the rejection of any bid. Bidder
confirms that any cost incurred in the preparation of this bid is entirely for Bidders own
account.
(e) The undersigned certifies that it has examined and is fully familiar with all provision of
the DRAFT CONTRACT DOCUMENT, EXHIBITS/SECTIONS and APPENDICES attached
thereto and the Bid Documents and Supplements thereto and it has satisfy themselves

matters which can in any way affect the Work or cost and risk thereof.

the work is to be performed by a consortium or partnership, all such parties shall certify
that it has reviewed this ITB and acknowledges receipt, understanding, full consideration
and shall abide by the contents of this ITB by signing below as the Principal Company,
consortium member or partner.
(i) Bidder further certifies that it has not, and shall not at any time before the awarding of
the Contract:

Bidder shall use, where applicable, its best endeavors to observe the following in the
execution of the work:
a) The enhancement of effective Malaysian participation in equity, management, and
employment; and
b) The transfer of technology to Malaysian firms and companies with the objective of
developing their technical, operational, and managerial capabilities.
Bidder shall utilize local sub-contractors and suppliers (if applicable) who meet the
specifications and are licensed with PETRONAS.
