3. The legal basis for the imposition of such fees and charges is pursuant to
Section 152 (b) of Republic Act No. 7160 or otherwise known as the Local
Government Code of 1991 which states that:
Section 152. Scope of Taxing Powers The barangays may levy taxes,
fees and charges, as provided in this Article, which shall exclusively
accrue to them:
(b) Service Fees or Charges barangays may collect reasonable fees or
charges for services recdered in connection with the regulation or the use
of barangay-owned properties or service facilities such as palay, copra, or
tobacco dryers;
4. The purpose of this barangay for such imposition fees and charges is to raise
additional funds for essential development and projects;
5. During the Committee Hearing and upon review of the provisions with respect
to the rates imposed, the committee held that the same were not excessive,
thus reasonable. The Committee ruled that the Barangay Ordinance passed
by Barangay Dumoy is consistent with law;
Recommendation
6. This Committee recommends that a resolution be passed approving to Barangay
Ordinance No. 2014-01, Series Of 2014 Of The Barangay Council Of Dumoy,
Talomo District, This City, Entitled An Ordinance Imposing Fees And Charges On
The Usage Of Barangay Multi-Purpose Hall And Other Government-Owned
Facilities Under The Control And Ownership Of The Barangay.

WHEREAS, Barangay Tax Ordinance No. 2014-01, Series of 2014 of the Barangay
Council of Dumoy, Talomo District, Davao City is consistent with law and city
ordinances;
WHEREAS, there is a need that the subject Barangay Tax Ordinance be approved in
this regard;

WHEREAS, the legal basis for the imposition of such fees and charges is pursuant

NOW THEREFORE, be it resolved as it hereby resolves approving Barangay
Ordinance No. 2014-01, Series Of 2014 Of The Barangay Council Of Dumoy, Talomo
District, this City, entitled An Ordinance Imposing Fees And Charges On The Usage
Of Barangay Multi-Purpose Hall And Other Government-Owned Facilities Under The
Control And Ownership Of The Barangay.
RESOLVED FURTHER, that copies of this Resolution be furnished to the Office of
the City Mayor, Office of the Vice Mayor, and Local Government, and to all other
pertinent government agencies, departments and/or offices for their guidance and
information.
