This is to certify that the chamber that the internship


dairy report on semester break programme was
prepared and submitted by Rashmi Yadav under the
supervision of Adv. Bharat singh Thakur, Session court
Mhow.
It was done in partial fulfiillment of the requirement of
the compeletion of the degree of BA.LLB , University,
Institute of the law and legal studies, Sage university ,
comprises only general work and due
acknowledgement has been made in the text to all
matter used. Neither the same work, nor any part
therefor , has earlier been submitted to any university

guidance , I have successfully completed my internship
completed . I have gained a lot from this experience ,
adv. Bharat singh Thakur whose guidance helped me
learn by way of direct exposure.
I am also thankful to the entire law faculty for inspring
guidance , supervision , expert suggestion and
encouragement which helped me understand the
actual practice of law.
INTRODUCTION

The diary gives the details of the internship program


with Adv. Bharat singh Thakur under whose guidance,
I have completed my internship. it was a great learning
experience for me. The internship gave me the
opportunity to have an insight the judicial system and
its working. I visited district and session court, indore
regarding the different, matters fixed in courts, where
I got an opportunity to observe court proceedings .
It was a valuable insight into the actual working of
courts a a lawyer’s. I was able to learn about working
of a lawyer’s office, study of case files of running as
well as old cases which had already been decided.
It was a rich experience with the advocate from 16th
may 2024 to 15th june 2024 his chamber is located in
the mhow session court . from the very first day , I was
given a chance to observe how office work is carried
out . I was advised note anything that was worth
nothing happening in the room.
INTERNSHIP DAY 1
THE COUNSELING SESSION OFFERED AN INTERESTING
INSIGHT INTO THE EXPECTATIONS OF CLIENT WHO
WANTS TO OPT FOR LITIGATION ASA A SOLUUTION TO
THE DISPUTE. THE CLIENT SEEMED TO VE HOSTILE TO
THE IDEA OF AN AMICABLE SETTLEMENT AND
APPERARED TO BE USING THE PROPERTY DISPUTW TO
INTIMIDATE THE OTHER CLAIMANTS AND GAIN AN
UPPER HAND. HOWEVER, SIR TRIED HIS BEST TO
CONVINCE THE CLIENT A REACH A MUTUALLY
AGREEABLE SOLUTIN SINCE BOTH PARTIES WERE
KNOWN TO HIM THROUGH FAMILY CONNECTION. BUT
IN THE END. SIR AGREED TO TAKE UP THE CASE.

INTERNSHIP DAY 2
WE REACHED THE DISTRICT COURT INDORE THE NEST
DAY, WE FIRST HAD TO GO THE COURTROOM OF A
SESSION ‘S JUDGE TO SEE IF A WITNESS IN ONE OF THE
CASES WAS PRESENT. THE ROOM WAS CROWED AND
ASKING AROUND WAS FUTILE. WE WERE THEN
INFORMED BY ANOTHER ADVOCATE PRESENT THAT
WE COULD GATHER OUR INFORMATION BY LOOKING
AT COURT DAIRY. HE IS SUPPOSED TO MAINTAIN THE
RECOED OF EVERY WITNESS’S APPERANCE OR NON
APPEARANCE AND HAS TO CALL OUT WITNESSES WHO
ARE PRESENT TO TAKE THE STAND BEFORE THE
JUDGES.

INTERNSHIP DAY 3
IT WAS SATURDAY, THE DAY WAS SPENT AT THE
OFFICE BY GOING THROUGH CASE FILES WE OBSERVED
THAT AT THE BEGINNING OF EVERY CASE FILE, AN
“URGENT APPLICATION “HAD BEEN FILED. THE
APPLICATION IS TO BE NOTED. HOWEVER, IT WAS LEFT
BLANK IN EVERY APPLICAYION WE ENCOUNTERES.
WHEN WE ASKED THE ASSOCIATION WE ENCOUNTERS
. WHEN WE ASKED THE ASSOCIATES AT THE OFFICE ,
THEY TOLD US THAT HAD THEY NOT FILED THE SAID
APPLICATION THE FRIT HEARING IN EVERY CASE
WOULD HAVE BEEN SCHEDULED AT LEAST TWO EARS
AFTET THE FILLINGOF THE SIUTS. THEREFORE, THEY
RESORTED TO THE TACTIC TO EXPEDITE THE PROCESS
TO LITIGATION.
WE ALSO GIVEN THE INFORMATION ABOUT HE
VAKALATNAMA . ITS FORMAT QUITE SIMILAR TO THAT
OF A POWER OF ATTORNEY. IT AUTHORIZES THE
PLEADER APPEARING FOR A LITIGNAT WHO IS THE
PRINCIPAL IT SEVERAL ACTS AS AN AGENT AND
CONSEQUENTLY BIND THE LITIGANT WHO, IS THE
PRINCIPAL ITS SPECIFIES THE SCOPE OF DELEGATES
AUTHORITY AND THE TERMS AND CONDITIONS OF
SUCH DELEGATES. THE VKALATNAMA IS AFFIXIED ON
THE LAST PAGES OF THE PLAINT ON WRITTEN
STATEMENT.

Court of Ms. Bhawna singh , Judicial Magistrate of the


First Class ,Court no. 16, Session court Mhow
IN THE MATTER OF:
STATE V/S ABHISHEK AND OTHERS
MATTER IS:
It was a matter of threat and grevious hurt for which
the victims is present in the court and giving his
statement .
Stage of the matter:
Examination –in- chief of witnesses
Act and sections involved:
Section 503 IPC
Section 320 IPC
Section 506,326 IPC
 Before entering in the courtroom advocate sir
checked the causelist on the outer wall of the
courtroom in which all the matters held for today
were listed.
 After entering in the courtroom advocate sir
reached to reader side siting in front of the judges.
 Two or the more witnesses were also present from
the accused side an two i.e, father and his
daughter were present in the courtroom.
 Investegating officer was also present as her
presence was crucial for the court
proceeding.
 The public prosecutors started with her
presence was crucial for the court proceeding.
 The public prosecutor started the with her
remarks by starting the facts of the cases.
 Then after the due permission of the hon’ble judge
the public prosecutor started asking the question
with one of the victims and the victims statement
is recorded within the provisions of the crpc.
 The father of the victim in his statement said that
he consficated the phone of one of the accused
associates later he received a threat call on the
same phone as the accused was aware of the
situation.
 The statement was given out in hindi but was tran
scripted into the english by the judge and typed
down by the writer steno.
 After the all the statement was given the public
prosecutor gave the narrations of the matters
himself and prayed before the hon’ble judge to
give proper punishment to all the accused.
OBSERVATION AND LEARNING :
 In the chamber advocate sir asked the junior to
prepare a bail bonds/ surety bond for a client.
 The format was printed by using office laptop then
the name and the amount were put . the amount
50,000 so with the copy of registry documents of a
vechicle with estimate value on insurance more
than that of 50,000 and identity proof were
attached to it.
 This application was to be signed by two sureties
and once its as done the same was taken by junior
for applying it in the court.
 In the morning each occupant of the chaMber had
some tasks to do. So I am a intern assisted them
with the tasks and learned the ways of working of
the office during a busy day.
 Juniors were busy getting the exemption prepared
applying them in the courts.
 I observed that a ticket is to be stamped on the
application and it acted as the court fee. Such
ticket was dated with pen with the dates on which
it is applied. Advocates sir was busy preparing the
cross for a case set for today.
 After some time, I went along with the advocate
sir to the courtroom on third floor.
Duties of the internship :
 I was assigned to read minimum of four case files to
learn how files are maintained and how the records are
maintained.
 I was assigned to observe the proceeding during
the examination in-chief and final agruements.
 Supporting the lawyers that comes into the officers and
program. Siting in on meting and appintments and
offering required assistance.
 Office tyoe organization work – photocopying ,
organizing papers, keeping files in order, organizing the
desk.
 Reading any suggstes law related materials for my
own benefits.
 helping clients if possible and if I am able to since I don’t
now much about the field yet.
 Interacting to various lawyers in our office.
 Research on judgements that are related to facts of
case.
