SUBJECT : Verification Report on the Project “CONSTRUCTION OF CONCRETE


ROAD – ACCESS ROAD LEADING TO TUWANG-TUWANGON FALLS,
BRGY. DURAN, DUMALAG, CAPIZ”.

The undersigned conducted verification of the project “Construction of Concrete Road –


Access Road leading to Tuwang-Tuwangon Falls, Brgy. Duran, Dumalag, Capiz” and herein
submits the report; to wit:

I. Contractual Data

Project Description : Concreting of gravel road with 300mm. slab including
slope protection, lined canal, cross drainage (RCPC)
and guardrails. Construction of 1-span Pre-Stress
Concrete Girder (PSCG) bridge.

Contract Amount (Revised) : Php 34,198,347.97

The objective of this project is to construct a durable concrete road and bridge, facilitating
convenient and safe passage leading to Tuwang-Tuwangon Falls, a tourist destination
situated in Brgy. Duran, Dumalag, Capiz.

II. Physical Accomplishment

The contractor has initiated the project implementation with only a 52.32% completion rate
as of the current date, which falls significantly short of the originally planned schedule.
Ideally, the project should have already been completed by this point.

The first project component, which involves road concreting, is nearing completion, with
only a small percentage remaining to reach full completion. On the other hand, the second
project component, which pertains to the bridge, has not even commenced, although four
reinforeced concrete piles (RC-Piles) have been delivered to the site. The contractor has
taken steps to identify the required locations for these concrete piles; however, no actual
construction progress has been observed on this component as of today.

Simultaneously, there's an ongoing installation of reinforcement for the proposed spillway,


intended to serve as a detour during the bridge construction. Unfortunately, the project is
significantly behind schedule, and activities that should have already been completed by
now, have not even started. Consequently, the project has experienced an alarming
increase in negative slippage, and the contract has already reached its expiration.

With regard to the project's progress, a Negative Slippage notice (1st Warning - Early
Warning Stage) was issued on October 14, 2022, indicating a (-) 5.20% slippage. They were
directed to provide a detailed "catch-up" plan on a biweekly basis to rectify the slippage.
Despite receiving this notice on October 17, 2023, the contractor failed to respond.

A subsequent Negative Slippage notice (Final Warning - ICU Stage) was issued on October
25, 2022, reflecting a (-) 13.01% slippage. They were instructed to submit a more
comprehensive activity schedule with weekly physical targets and the necessary additional
resources to address the slippage. It was received by their office dated October 27, 2023,
however, no response was received from the contractor to this notice either.

On November 7, 2022, a notice to Terminate the Contract (Terminal Stage) was formally
issued, citing a concerning (-) 20.41% slippage. Their office received this notice on
November 9, 2023. The contractor was granted seven (7) calendar days from the receipt of
the notice to provide a "Show Cause" explanation regarding why the contract should not be
terminated. Unfortunately, no response was received from the contractor.

A letter issued on April 4, 2023, further informed and reiterated the contractor about their
slow performance on the project, which had incurred substantial negative consequences.
Despite favorable weather conditions, no additional progress was made during the specified
period as scheduled. The job site lacked sufficient laborers, and equipment was evidently
limited.

On May 8, 2023, a notice to Terminate the Contract (Terminal Stage) was once again issued
due to an increasingly severe negative slippage of (-) 73.93%. The contractor was given
another seven (7) calendar days from receipt of the notice to provide a "Show Cause"
explanation for why the contract should not be terminated. Regrettably, no response was
received.

Lastly, a letter dated September 12, 2023 was issued, again highlighting the contractor's
sluggish performance on the project, the substantial negative slippage incurred, and
informing them that the contract has already expired. Their office received this letter on
November 9, 2023, along with an invitation to a meeting, which would include their
technical personnel, in an attempt to find a possible resolution to this ongoing issue.
Regrettably, no response was received from the contractor.

III. Recommendation

This Office recommends the termination by default of the project because the contractor has
a very slow performance despite the increasingly negative slippages incurred, no additional
physical accomplishments was seen on site despite the favorable weather condition, and no
response was received from them regarding their show-cause, comprehensive activity
schedule with weekly physical targets, and catch-up program.
