What is International Humanitarian Law?

War not only destroys infrastructure or takes human lives, it effects


on whole society and causes collapse in every structure of country.
And even war has limits, essential limits-there are the rules of
humanitarian law.
International Humanitarian Law (IHL) is a set of rules that seek to limit the consequences
and effects of armed conflict

Origin of IHL - international humanitarian law is rooted in ancient civilizations and


religions, universal codifications of IHL began in nineteenth century.

Where is international humanitarian law to be founded?

Major part of IHL is contained in the four Geneva conventions of 1949 . conventions have
been developed by two additional protocols added in 1977 and they are related to the
protection of victims of armed conflicts.

Other agreements

1. The 1954 convention for the protection of cultural property in the event of armed
conflict
2. The 1972 biological weapons convention; the 1993 chemical weapons convention
3. The 2000 convention on the rights of the child on the involvement of children in
armed conflict.

When does IHL apply?

International humanitarian law applies only to armed conflicts, it does not cover any other
cases, for example isolated facts of violence. The law applies after a conflict has begun, and
then equally to all sides regardless of who started fighting.

International and non-international armed conflict

 International Armed Conflicts are those in which at least two states are involved
 Non-international Armed Conflicts- are conflicts on the territory of a single state,
involving either regular armed forces fighting groups of armed dissidents, or armed
fighting each other.
IHL seeks to strike a balance between two main principles :

 Principle of military necessity permits use of force that is necessary to achieve the
aim of a conflict, but with limits which are connected to the loss of human life and
resources .
 Principle of humanity- forbids the actions which are connected to suffering injury, or
destruction, which would be unnecessary to win the war.
This two principles shape the entire body of International Humanitarian Law.

IHL covers two areas:

1. Hague Law – restricts the methods of warfare- certain limitations about the weapons
that can be used in armed conflicts – restrictions on weapons and tactics under IHL
All those methods are banned which cause unnecessary suffering and cause long-term
damage to the environment. Use of many weapons, including exploding bullets,
chemical and biological weapons, blinding laser weapons are banned.

2. Geneva Law – protects people in armed conflicts, such as military personal and
civilians who are no longer participating in hostilities. IHL protects those who do not
take part in the fighting, such as civilians, medical and religious military personal, it
also protects those who can’t continue taking part in conflict, such as wounded and
sick combatants and prisoners of war. It is forbidden to kill or wound an enemy who
is unable to fight. Medical personal, supplies, hospitals and ambulances must all be
protected. There are also detailed rules about the conditions of prisoners of war, this
includes the provision of food. Shelter and medical care, and the right to exchange
messages with their families

Important symbols set by IHL

The law sets out a number of clearly recognizable symbols which can be used to identify
protected people, places and objects. The main emblems are red cross, the red crescent and
the symbols identifying cultural property.
