Description Of Job--
Annual Thorough Examination and load test of 5Ton, l0 Ton, 60 Ton and 20Ton EOT Cranes of KW as per
as per rule 55 of West Bengal Factories rules, 1958 and issuance of certificate thereafter. Separate
Certificate to be issued for each crane after testing.
Scope of work:
1. The party have to carry out inspection, Testing and Certification of the all EOT Cranes as per W.B.
Factories rules, 1958 by a competent person registered by Directorate of Factories, Govt, of West
Bengal. The competency shall remain valid on the date of certification. Crane wise load test
certificate to be provided for each crane along with test report with stamping of bottom block Hook.
To and fro transportation for testing of Bottom block with hook shall be within the scope of
contractor.
2. Note: Joint inspection and site visit is compulsory before submission of quotation. Joint inspection
report (JIR) in the following format to be attached with techno commercial bid (Price bid would not
be open at all without Joint Inspection report). To avoid future complications site inspection and
joint inspection report in the following format is required to be submitted.
Declaration: I/ we have been shown and explain all the parameter associated with the job and we are
submitting our quotation being fully aware of all particulars of the job.

1. Work to be carried out at BCL Clive works, 5, Hide Road, Kolkata 700043 and Victoria Works, P-
61, C.G. Road. BCL will provide required loads.
2. The party have to carry out inspection, Testing and Certification of the all EOT Cranes as per W.B.
Factories rules, 1958 by a competent person registered by Directorate of Factories, Govt, of West
Bengal. The competency shall remain valid on the date of certification. Crane wise load test
certificate to be provided for each crane along with test report with stamping of bottom block
Hook along with lifting tools & tackles. To and fro transportation for testing of Bottom block
with hook shall be within the scope of contractor.
3. All necessary testing and the Certificate shall be as per prescribed guideline and forma, given in
Rule 55 of factory Act 1958 and the latest amendment thereon.
4. The job to be carried out within 3 months on receipt of P.O.
5. Interested party shall Visit BCL to see the Cranes Jointly with Manager/Maintenance or BCL’s
Representative and a JIR to be Submitted with their offer declaring that they have seen and
understand the whole job as per tender.
6. For any further Query party may contact with Manager (Maint.)- KW or CWM
(1)Earnest Money Deposit (EMD) : : Rs. 5000/- (Rupees Five Thousnd only)
EMD shall be submitted either in the form of DD / Pay Order drawn in favour of `BRAITHWAITE & CO.LTD.’
payable at Kolkata or in the form Bank Guarantee. Firms SSI units registered with NSIC, MSME and PSU
units may be exempted from submission of EMD.
The earnest money is liable to be forfeited if the tenderer withdraws or amends impairs or derogates from
the tender in any respect within the period of validity of this tender.
Earnest Money lodged by unsuccessful tenderer shall be refunded to them immediately after finalization of
a tender. In case of the successful tenderer, the same shall be retained by the Company, till submission of
security deposit or if so decide by the tenderer adjusted against Security Deposit for the said job.
(2) Security Deposit: @ 3% of the order value only in the form of DD/ pay order/ Bank Guarantee from
Indian Nationalized Bank to be submitted by the successful bidder within 15 days from the date of receipt
of Purchase order. However, exempted for NSIC, MSME & DGS&D registered vendors & PSU bidders
However SD can be submitted 50% by the bidder & balance 50% can be adjusted against their R/A Bills.
Security Deposit will be discharged and returned to the supplier only after successful completion of
supplier’s obligation under the contract.
As and when an amendment is issued to the contract, the supplier / contractor shall within 15 days of the
receipt of such an amendment furnish to the purchaser an amendment to the security deposit and / or Bank
Guarantee rendering the same valid for the contract as amended.
Security deposit will be discharged and returned to the supplier / contractor on completion of supplier’s /
contractor’s obligations under the contract including any warranty obligation as specified in the contract.
(3) Performance Bank Guarantee: The Party shall submit a Performance Guarantee @ 3% of contract
value in the form of Bank Guarantee obtained from a Nationalized / Scheduled Bank in a prescribed format
of BCL before the receipt of payment. The PBG shall remain valid up to Guaranty / Warranty period. The
Security Deposit, if submitted may be converted to Performance Bank Guarantee and no separate PBG is
required to be submitted. PBG shall be refunded /returned only after successful completion of obligations
under the contract.
Note: (a) In case Security Deposit / Performance Guarantee is not submitted in time, a penalty of 1.5% of
vale of SD/PBG per month or per thereof will be applicable for the delay period which will be deducted
from party’s bills. & (b) MSME vendors may opt for submission of SD or PBG as per their choice

(1) The Offer should be completed in all respects duly signed and shall have no discrepancies.
(2) All corrections (if any), must be signed at the appropriate place by the signatory of the bidder,
otherwise tender will be considered as invalid.
(3) BCL reserves the right of postpone the due date of the tender / to cancel the tender at any stage.
(4) Tender will be cancelled if the documents required for Part-I & Part-II bids are not placed in
respective/proper envelope.
(5) Offer shall remain valid for 90 days from the date of opening the tender.
(6) Bidder shall submit copy of PAN, GST Registration Certificate along with their techno-commercial
bid.
(7) Payment Terms: Payment shall be made with 30 days credit from the date of completion of the
ordered job/ submission of GST compliant invoice with all relevant documents. However, BCL
reserves the right to keep the payment of GST amount to the party on hold till the receipt of ITC by
BCL MSME vendors may avail their payment through TReDs platform.
(8) Bill Certifying Authority: Manager (Maint.) /CWM or their authorised representative - Kolkata Works
of BCL.
(9) Delivery/Completion Period: Within 90 days from the date of receipt of PO. The ordered job shall be
supplied at General Stores, Braithwaite & Co. Ltd, Kolkata Works, 5, Hide Road, Kolkata 700 043.
(16) Risk Purchase: In the event of failure on the part of the supplier / contractor to complete the job within
the reasonable period of time as decided by the Purchaser, the purchaser reserves the right to get the
job done by other Agency / Agencies as per the order on Risk Purchase basis and shall recover the
extra cost thereof, if incurred, from the contractor.
(17) Arbitration: All questions, disputes or differences whatsoever shall, arise between the purchaser and
the supplier / contractor upon or in relation to or in connection with the contract, either party may
forthwith give to the other notice in writing of the existence of such question, dispute or difference
and the same shall be referred to the adjudication of sole arbitrator. MD / CMD – BCL shall have the
right and authority to appoint an arbitrator who is not connected with either party in any way. The
parties to the dispute will share equally the cost of arbitration as intimated by the Arbitrator.
Such a reference submitted to the Arbitrator shall be deemed to be the submission to the Arbitrator
within the meaning of the Arbitration and Conciliation Act, 1996 statutory modification thereof. The
proceedings of the Arbitration shall be held in Kolkata.
(18) Any legal dispute that may arise will be settled within the jurisdiction of court of Kolkata.

(19) Evaluation & Mode of Ordering: Evaluation of lowest bid (L-1) shall be made on the basis of lowest
Grand Total Amount (all inclusive) as per price bid format. There shall be no splitting of the job and
the entire work shall be awarded on one Party.
(21) Rate should be quoted/submitted strictly as per price bid format. No discount will be taken into
consideration during price bid evaluation.
(22) The party should submit their rate as per prescribed format.
