Once notice is given, the employer can insist that the employee leave immediately without
finishing the remaining time. If an employee resigns, no severance is payable but the
employee is entitled to payment for a proportional Christmas bonus, 14th month and accrued
vacation time.
Dismissal:
An employer may dismiss an employee at any time, for any reason (except pregnancy) and
without giving the employee any notice whatsoever. The legal issue then becomes whether the
employer had a “just” reason for dismissing the employee or whether the reason was legally
“unjust”. It should be remembered that these definitions are legal ones, and in no way reflect
