    CONTRACT FOR SCHOOL CANTEEN OPERATION

    KNOW ALL MEN BY THESE PRESENTS:

    This Contract made and executed this 19 th day of September 2022 at Carig Norte,
    Tuguegarao City by and between:

    The CARIG NORTE ELEMENTARY SCHOOL (CNES) hereinafter referred to as CNES, a


    government institution duly organized and existing under and by virtue of the laws of the
    Philippines, with office address at Stoops Boulevard, Carig Norte, Tuguegarao City represented by its
    OIC-School Head, GINA B. REYMUNDO;
    -and-

    GLORIA REYES, of legal age, married, Filipino citizen, a resident of Carig Norte, Tuguegarao
    City, and authorized representative of MT AQUINO STORE, FOOD MANUFACTURER, hereinafter
    referred to as CANTEEN OPERATOR.

    WITHNESSETH THAT:

    WHEREAS, CNES is in need of Canteen Operator to provide canteen services to the school;

    WHEREAS, The Bids and Awards Committee requested for proposal from interested bidders;

    WHEREAS, the Bids and Awards Committee recommended the award of contract to
    CANTEEN OPERATOR, having the highest rated proposal;

    WHEREAS, CANTEEN OPERATOR has represented and warranted to CNES that it is engaged
    in the business of providing manufactured products and providing cooked food items for breakfast,
    lunch, snacks and dinner and has the necessary expertise, manpower, equipment and facilities to
    comply with the canteen requirements of CNES;

    WHEREAS, CANTEEN OPERATOR warranted that it will secure the necessary government
    registration/license in providing canteen services under applicable laws, rules and regulations;

    NOW, THEREFORE, for and in consideration of the mutual covenants, representation and
    warranties, the parties hereto agree to the terms and conditions set forth below:

    A. OBLIGATION OF CNES:
    1. Provide canteen space to CANTEEN OPERATOR located at CNES Campus;
    2. Ensure that the CANTEEN OPERATOR exclusively provides canteen services within the
    Campus except for special school activities;
    3. Guarantee that NO teacher/s shall be involve selling any form of items/foods in the
    classroom;
    4. Assure that no ambulant vendors is present inside and outside the CNES premises;
    5. Assure that teachers and parents will not intervene in the operations of the school
    canteen, but they can suggest improvement if there are any;
    6. Monitor and supervise the operation of the canteen thru the School Canteen Manager
    to conform with agreed guidelines as regards to the kinds of foods to be served and
    coordinate with the SDRRM Coordinator as to the cleanliness, sanitation and health
    protocols in the canteen;
    7. Offer water and electric utilities, tables and chairs; and

    B. OBLIGATION OF CANTEEN OPERATOR:
    1. Operate the school canteen;
    2. Pay rent to CNES in the amount of FIVE HUNDRED PESOS (P500.00) per day;
    3. Served nutritious, safe, clean and affordable snacks and meals to the pupils, teachers
    and school visitors at the canteen;
    4. Cause the ouside and inside improvement of canteen area, dining area to include
    washing and waste facilities, and adequate lightning;
    5. Provide party treat to employees during Teacher’s Day and Christmas Celebration;
    6. Maintain cleanliness and sanitation of the canteen;
    7. Maintain IATF health protocols;
    8. Secure all the necessary health permits, health certificate of its employees and other
    required documents to operate the canteen.

    C. TERMS AND CONDITIONS


    1. The CANTEEN OPERATOR shall not sublease all or any part of the canteen;
    2. Any permanent improvement done by the CANTEEN OPERATOR during the period of
    contract shall remain property of CANTEEN OPERATOR, unless it is desired for donation;
    3. CNES has the right to unilaterally terminate this contract if and when the CANTEEN
    OPERATOR fails to comply with any of the stipulated obligations or violates any of the
    terms and conditions set herein, provided that a 60-day notice be given to the CANTEEN
    OPERATOR; and
    4. This contract shall start for school year 2022-2023 starting on September 19, 2022 and
    ending at school year 2028-2029.

    AFFIRMATION

    We, CNES and the CANTEEN OPERATOR hereby attest that we have read the above
    obligations, terms and conditions, and agree to abide by said obligations, terms and conditions.

    IN WITNESS WHEREOF, we hereto set our hands on this 19 th day of September 2022 at Carig
    Norte Tuguegarao City, Province of Cagayan, Philippines.
