    AFFIDAVIT

    I, TERESITA V. OLIS, of legal age, Filipino, single and residing at Purok-5, Lapasan,
    Clarin, Misamis Occidental, on oath, depose and state:

    That I am the mortgagor-borrower of the BANK OF HOPE, INC. (A RURAL BANK)


    with office address at Purok-5, Looc Proper, Plaridel, Misamis Occidental;

    That I, TERESITA V. OLIS and the BANK OF HOPE, INC. (A RURAL BANK)
    entered into a Real Estate Mortgage recorded in the Notarial Register of Atty. Diogenes B. Apao,
    Jr. as Document No. 115; Page No. 24; Book No. 314; Series of 2018 dated May 17, 2018
    covering a parcel of land, together with all improvements therein, identified as Lot No. 171-C,
    Psd-07-068065 located at Banilad, Bacong, Negros Oriental with an area of 526 square meters
    and declared under Transfer Certificate of Title No. 42094 before the Registry of Deeds for the
    Province of Negros Oriental;

    That in addition to the special power stipulated in the above-mentioned Real Estate
    Mortgage which appoints the mortgagee as Attorney-In-Fact with special power to take
    possession of the mortgaged property among others, I hereby manifest and declare that the
    mortgagee, BANK OF HOPE, INC. (A RURAL BANK) is likewise appointed as attorney-in-
    fact of the mortgagor, with full power and authority to take actual possession of the mortgaged
    property at once, and to forthwith foreclose the mortgage judicially, or to sell the subject
    property/ies extra-judicially in accordance with Act No. 3135, as amended, and to take such
    other action(s) as he may be deem necessary to recover the amount due; and in the event of such
    judicial or extra-judicial foreclosure or other legal action, the mortgagee shall be entitled to
    compensation for expenses, attorney’s fees and costs of collection, which is stipulated to be
    twenty five percent (25%) of the indebtedness then unpaid but not less than Php50,000.00;

    That the above stipulation and special power is hereby declared and expressly
    incorporated in the above-mentioned Real Estate Mortgage with full force and effect same as that
    all other terms and conditions; and

    That I am executing this affidavit to attest the foregoing facts and that I manifest that I
    am fully aware of the contents thereof and I understand the consequence of the same.

    IN WITNESS WHEREOF, I have hereunto set my hand this ____ day of April 2021, at
    Oroquieta City, Philippines.
