I, AMBROSE OCHUKA ABONG’O Advocate practicing in the name and style of Ochuka,
Onacha, Chelangat & Maiyo Advocates, Westlands Arcade, 3rd Floor, Waiyaki Way, P.O.
Box 37592 – 00100 Nairobi within the Republic of Kenya and a resident of Nairobi City County
do hereby make oath and state as follows;

1. THAT I make complaint on the grounds set forth herein below against the conduct of a
one GEORGE CHRISTOPHER ODHIAMBO OKULLO Advocate of telephone numbers
0721 655 410 OR 0755 693 701 and who practices in Nairobi City County within the
Republic of Kenya.

2. THAT on 24th May, 2020, I was instructed by a one FREDRICK SHERA BWOYERE to
attend to him after he had been arrested and presented to KAHAWA SUKARI POLICE
POST on allegations of having obtained money by false pretense from a one
SHERADEENE WANJIKU REBO and JOEL NDUNGU.

3. THAT I attended the said police post and encouraged my client to agree to settle the
matter amicably by compensating the complainants, where it was agreed that my client
would report to the Investigating Officer, a one PC LAGAT on daily basis until the
amount is settled.

4. THAT on or 5th June, 2020 at 16:05 HRS, GEORGE CHRISTOPHER ODHIAMBO


OKULLO contacted me via telephone call through his cell phone number 0755 693 701
where he represented to me that he is an advocate of the high court of Kenya and that
he had been instructed by the said SHERADEENE WANJIKU REBO and JOEL
NDUNGU to engage me in negotiations for a possible amicable and faster settlement.

5. THAT during the course of the said engagement, his said clients had obtained the cell
phone numbers to my client’s mother after which they had proceeded to call and
threaten her as a means of making my client pay the alleged outstanding amounts.

6. THAT after back and forth arguments on the same, the said advocate agreed to advise
his clients to withdraw the said statements which were done. However, the Advocate
represented to me that if I would not manage to have my client pay the amount, then he
would be unable to prevent his clients from taking any further unethical steps towards
coercing me and my clients to settle the claimed amount.

7. THAT on 10th June, 2020, to my shock and surprise, the Advocate’s said clients, while
operating twitter account named “Papa Joe R” and Facebook account name “Rebo
Sheradeene” published and posted information to the said accounts to the following
effect;
“Shame on the se conmen. Fredrick Bwoyere and Ambrose Abongo. After
working diligently for a month they have denied me payments. Police have
been of no help at all I am not the only victim they have extorted! Twitter
please shame them and at least save their next victim!”

8. THAT the said posts also had a copy of my photograph alongside the photograph of my
client. (Annexed herewith marked AOA-01 is an extract of the said tweet.)
9. THAT I brought this issue up with the Advocate who represented to me that he would
“help” me by advising the client to pull the post down but that he needed to ”help him
by having my client pay the said outstanding amount.” I refused to engage further
for as long as the post was still active.

10. THAT the post was temporarily pulled down from the said twitter account.

11. THAT a few days prior to 24th June, 2020, the said advocate called me via his cell phone
number 0755 693 701 and expressly told me that since I had not managed to have my
client pay the outstanding sum, “whatever happens to me and my client from then
on is up to me” and that “they will no longer make reference to us.”

12. THAT on 24th June, 2020, at about 21:56 hours, I came across a post by SHERADEENE
WANJIKU REBO through her account name REBO SHERADEENE on Facebook
posted on a public page group with more than 149,000 membership with photographs
of myself and my contact details to the effect as hereunder;

“[…] the second picture is of his cousin lawyer AMBROSE ABONGO


OCHUKA 0707600077 a very arrogant man who came to his rescue
brandishing his law society of Kenya card. Fred paid 10k and bribed his
way home nothing happened to him. The lawyer AMBROSE promised to
top up the amount but became mute the moment he left the station.
Apparently this two work together whenever Fred has conned someone, he
rescues him and talks a lot of rubbish when you call him ...”

13. THAT the post caused me embarrassment, shame and ridicule and exposed me to
danger and threats as I have been receiving calls and text messages from unknown
persons regarding the said post. (Annexed herewith marked AOA – 03 is proof
thereof.)
14. THAT the said Advocate has since been elusive, refusing to pick up my calls and despite
bringing this post to his attention, he only stated “will call you.”

15. THAT I now have sufficient reasons to believe that the said advocate advised his clients
to post my name and photograph in the said public page as a means of attempting to
coerce me into making the said payments.

16. THAT the said advocate, in any event, failed to advise his client otherwise despite being
in at a point of strong influence towards his client. This position of influence is
demonstrated by the fact that he had earlier on caused his clients to pull down twitter
and other Facebook posts.

17. THAT I have carefully perused the Law Society of Kenya Code of Standards of
Professional Practice and Ethical Conduct (June 16th Edition) and noted the following
conducts by GEORGE CHRISTOPHER ODHIAMBO OKULLO Advocate constitute
professional misconduct;

a. Breach of the requirement that an Advocate shall at all times demonstrate


professional courtesy and respect to his/her colleagues when handling a
matter or undertaking a transaction, including a non-contentious
transaction – by advising his client to make such posts on social media, the
Advocate breached this requirement. Further, the advocate intentionally failed to
advise the said client against such actions even after I had approached him.

18. THAT I swear this Affidavit in accordance with section 60(2) of the advocate act laying
out basis upon which GEORGE CHRISTOPHER ODHIAMBO OKULLO Advocate
should be found guilty of professional misconduct and pray that he be admonished and
ordered to pay damages to myself for ordeal I have suffered owing to his actions and
inactions.
19. THAT what is deposed to hereinabove is true to the best of my knowledge, belief and
information.
