RAPE AND DEFILEMENT;ARE SENTENCING LIMITS ADEQUATE
INTRODUCTION;
Rape is not just a crime to humanity,no it is not,it is a crime against

individuality;the victim bears all the agony not the entire society as many
claim.The shame,horror and torment of being forcefully and sexually exploited by
a man or gang of men all lies on the victim.It is not just a physical trauma but a
psychological and mental one.Rape is a scourge which haunts every part of the
world.
THE BIG MISCONCEPTION;
Many have misconceived the issue of rape and defilement,as both words are
usually seen as one.This is a big misconception,defilement involves the despicable
act of pedophilia where children are the main victims;a sexual perversion in which
children are the preferred sexual subject.In this situation an adult;relative or non
relative has sexual fantasies about a prepubescent.
Both words(rape and defilement)are different,but some authors use Child rape to
indicate defilement,as heinous as it sounds,child rape.There is surely a big
difference between a lady and a little girl,a sixteen years old girl and a five or two
years old girl.
Defilement,I will categorize to be one of the most heinous crimes.Cases have

been reported of a man about 50 years of age having carnal knowledge of a three
year old girl,unbelievable?How about a two years old girl or a year old baby,
believe it or not,this is what is happening around this part of the world,though
these does not make the headline anymore because of the spate of insurgency in
the states.There are paedophiles amongst men,out on the streets,at homes or
even in school as teachers.This crime is not like any other crime,it devours the
dignity of the society dolorously.
The victim of an armed robbery who is just robbed of his properties or even killed
is not in per with the victim of defilement.The former is shown sympathy by the
members of the community and most time compensations are rewarded to some
victims.This is not the case with rape and defilement victims,these people feel
ashamed of themselves, dejected from other members of the society to the
extent that victims were reported to have resorted to suicide mostly in India and
other countries where rape and defilement has become a terrible norm amongst
criminals.These victims could not stand the shame of people knowing about their
sexual and individual status in the society,and many do keep this secrets to
themselves because of the stigma and helplessness of the law.It is not a blatant
lie,rather it is a clear picture of the subsistence.The society truly does see shame
in the peope not because of sympathizing but because of the status they carry
along with them.If you ask me for example how I feel when I talk to a victim of
such act or parents of the victim of defilement, of course I will not feel the same
way talking to a non victim.I will be sad and full of empathy for these
people,whether rich or poor.This is a daily routine for the victims of this vile act.
LEGAL IMPLICATIONS
The main punishment for rape and other sexual assault related cases including
defilement are spelt out in the two major Laws of the federation;The Penal Code
and The Criminal Code Act.
The Penal Code Act is majorly adopted by almost all the northern state while the
Criminal Code Act is adopted by all the states in the southern part of the
country.Both laws are not in disparity on the punishment for rape and defilement
because no major distinction is made between both crimes by the Codes.Life
Imprisonment is the peak of all sexual related assault,be it rape or defilement,
sometimes murder may also be among the counts charged against the
accused.These sentences are at per with various laws of countries such as the US,
Germany, Canada and others.
India,Nigeria and DR Congo top the list of the countries with high rate of rape and
defilement cases, reported and unreported.
Rape and Defilement is in everyway against dignified human existence,it is an

internal war.Many have condemned the provisions of the law regarding these
crimes and suggested that capital punishment should be melted out on culprits,
punishments such as castration or amputation or electrocution, especially for
defilement related cases.Suprisingly,these advocations are met with bitter
criticism and condemnation;they claimed these are barbaric and are alien to
civilization and against the Democratic nature of Democratic countries.The say it
is islamic and thus, barbaric and cruel to nature.
However,the crime to begin with absolutely distinguished itself from other

criminal activities,it is not just a cruel and barbaric crime,it is condemnable in all
manners.
The main subscribers of this ideology are the so called Human Rights International
Organizations and the media, basically the western based media house.They
denounce the use of capital punishments for such criminal acts,they call it
barbaric and inhumane.The narrow minded activists all in the name of civilization
are hypocritical and dubious.They put out false information about countries that
are not in par with the European and American lifestyle.They spread News which
are false and lying propagandas,this is far way possible because many countries
use satalites and internet and social media networks,these are major tools used
to put out false information and hypocritical defend criminals.Malcom X once
advised his followers from the dangers of media,where the victims is portrayed as
the culprit and the culprit,turns the victim.This was the same thing that happened
in Libya,Vietnam.They taint the Muslim leaders as narrow minded and enemies of
the democracy whereas they are the true enemies of the system that works for
all.Muslim countries such as Saudi Arabia,Iran , Pakistan where rape and
defilement is highly regarded as a heinous crime, capital punishment such as
flogging publicly of the culprit,and in some cases, executing the criminal at the
spot once convicted,without any adjournment.
In Pakistan,the prime minister,Imran Khan said he wanted rapists to be chemically
castrated or publicly executed after the rape of a woman on a highway sparked
protests.
In Iran,a country Amnesty International (AI) is seriously condemning of

inhumanity in there criminal laws because of death and other capital punishment
prescribed for those accused of rape and defilement.
According to a court document obtained by Amnesty International,Farhad Salehi

Jabehdar has been sentenced to death for"forced male-male defilement of a 10-
year old boy.However,this act was highly condemned by the so called
International Organization.
These Organization criticize the public flogging and execution of culprits by

countries such as Saudi Arabia,but they laid the judgement passed by American
and European countries on rape and defilement.America is seen as an abode of
rape and defilement,child porn and child prostitution. Paedophiles are not
dejected or harmed but rather they are considered and accommodated in such
societies.Such is the reality of the obnoxious Media and Human Rights
Organization based in the West.This is so because of the hatred and religious,
economic and social resentment they have for such societies.
For instance the North Korea is targeted by many media houses and human
rights group.They make false and misleading documentary on this particular state
just to bring up an internal dispute so as to bring the country to it's knees.
CONCLUSION
Life imprisonment is not at all times adequate punishment for rape and
defilement.Especially were the rate of these cases is becoming a spate in the
society,the punishment must change drastically, capital punishment should
suffice.These low minded activists and media houses claim that if such measures
are taken,would it deter potential rapist from committing or would it reduce the
spare of such criminal activity in the society.The answer to this is a positive one
depending on the adequacy of the judiciary of such state.And also no punishment
prescribed by man has ever automatically deter men from commiting
crimes.Crimes are seen as daily basis routines, despite the congestion of the
prisons,this is the very nature of man.Hence the law will stand even if it is not
respected or recognized by criminals.
Imprisonment has caused high decongestion of prison yards and for this criminals
are been pardoned and brought back again to the society.
