THIS INDENTURE IS EXECUTED ON THIS THE_________DAY OF

SRI RAJESH JAIN, Son of Amit Jain, Hindu by faith, Business by occupation,
resident of Champasari Devidanga Anchal, Post Office Champasari, Police
Station Pradhan Nagar, District Darjeeling (W.B.) - hereinafter called the FIRST
PARTY/TRANSFEREE (Which expression shall mean and include unless
excluded by or repugnant to the context her heirs, executors, administrators,
representatives, successors, and assigns) of the ONE PART.

SRI PRABHAT BARMAN, Son of Sri Bhabendranath Barman, Hindu by faith,


Business by occupation, resident of Jyotirmoy Colony, Post Office Siliguri Bazar,
Police Station Bhaktinagar, District Jalpaiguri (W.B.) - hereinafter called the
SECOND PARTY/ TRANSFEROR (Which expression shall mean and include
unless excluded by or repugnant to the context his heirs, successors, legal
representative, executors, administrators and assigns) of the OTHER PART.

WHEREAS the Second Party abovenamed is the owner-in-physical possessor of a


piece of land measuring 2(Two) Kathas together with residential house structure
standing thereon fully described in the Schedule below.
A N D

WHEREAS the Second Party abovenamed due to the urgent need of fund for her
family obligation has offered to transfer the physical possession of the Scheduled
below land and house. The First Party being in need of suitable Land for her
business purpose approached the Second Party and expressed her desireness to
have the physical possession of the scheduled below Land and structure. The
Second Party demands of Rs. 5,00,000/- (Rupees Five Lac) only as full and final
consideration money for the said Land and structure.

NOW THIS INDENTURE WITNESSETH that in pursuance of the aforesaid


offer, acceptance and also in consideration of the said sum of Rs. 5,00,000/-
(Rupees Five Lac) only paid by the First Party/Transferee to the Second
Party/Transferor hereof (the receipt whereof the Second Party/Transferor does
hereby acknowledge and grant full discharge from the payment thereof) the
Second Party/Transferor does hereby grant transfer unto the First Party/Transferee
the possession of the said land and structure described in the schedule below and
make over possession thereof to the First Party/Transferee TO HAVE AND TO
HOLD the same absolutely by the First Party/Transferee forever peaceably and
quietly without any interference or interruption from the Second Party/Transferor
or any person or persons claiming under her.

THE Second Party/Transferor does hereby covenant with the First


Party/Transferee that if for any act done or suffered to be done by the Second
Party/Transferor, the First Party/Transferee is deprived of possession thereof the
possession hereby transferred or any part thereof in future, the Second
Party/Transferor shall be liable to return to the First Party/Transferee the full or
proportionate part of the said amount paid by the Purchaser/Second Party as the
case may be together with interest from the date of such deprivation or
dispossession and the Second Party/Transferor shall also be liable to pay adequate
compensation to the First Party/Transferee for any other loss or injury which the
First Party/Transferee may suffer therefrom.

THE Second Party/Transferor do hereby further declare that the Second


Party/Transferor at the request and costs of the First Party/Transferee, do execute
or cause to be done such acts, deeds or things whatsoever if the First
Party/Transferee so required in future for peaceful enjoyment and possession of
the said land and structure hereby transferred by the Second Party/Transferor by
these presents.

THE First Party/Transferee shall hereafter peaceably and quietly hold, use,
occupy, possess and enjoy the aforesaid land as fully mentioned in the schedule
below as her own land without any hindrance, interruption, claim or demand
whatsoever by or from the Second Party/Transferor or any other persons or person
whomsoever claiming through or under her.
SCHEDULE OF THE LAND

All that piece or parcel of land measuring 2(Two) Kathas, situated at Jyotirmoy
Colony, Ward No. 32 of S.M.C., Post Office Siliguri Bazar, Police Station
Bhaktinagar, District Jalpaiguri (W.B.)
The said land and house is butted and bounded as follows:
North : Pipe Line,
South : Land of Prafulla Barman;
East : Land of Priya Nath;
West : Land of Lakkhikanta Mandal.

IN WITNESS WHEREOF THE TRANSFEROR HERETO HAVE SET AND


SUBSCRIBED HIS HAND ON THE DAY, MONTH AND YEAR FIRST
ABOVE WRITTEN.
