DEED OF ABSOLUTE SALE

OF ROAD RIGHT OF WAY

KNOW ALL MEN BY THESE PRESENTS:

This Deed is made and entered by:

1. JOSE GALBAN, Filipino, of legal age, married to Pilar Libres and a resident of
Tomoc, San Miguel, Bohol;

2. CLAUDIO GALBAN, Filipino, of legal age, married to Diosa Bastasa and a resident of
Tomoc, San Miguel, Bohol;

3. CESARIO GALBAN, Filipino, of legal age, married to Lucila C. Galban and a resident
of Moto Norte, Loon, Bohol, herein represented by CLAUDIO GALBAN by virtue of
Special Power of Attorney attached herewith as “ANNEX A”;

4. SUSAN GALBAN CEBALLOS, Filipino, of legal age, married to Jemelito Ceballos and
a resident of Moto Norte, loon, Bohol, herein represented by CLAUDIO GALBAN by
virtue of Special Power of attorney attached herewith as ANNEX “A”;

5. VIRGINIA G. GALBAN, surviving wife of Eduardo Galban, Filipino, of legal age,


widow and a resident of Loon, Bohol, herein represented by CLAUDIO GALBAN by
virtue of Special Power of Attorney attached herewith as ANNEX “A”;

-IN FAVOUR OF-

THE LOCAL GOVERNMENT UNIT (LGU) OF SAN MIGUEL, BOHOL, a Public


Corporation duly organized under the laws of the Republic of the Philippines, as duly represented
by Hon. ATTY. VIRGILIO L. MENDEZ, the Municipal Mayor, Filipino, of legal age, married and a
resident of Bayongan, San Miguel, Bohol, Philippines, hereinafter referred to as the “VENDEE”;

WITNESSETH-That:

WHEREAS, the VENDORS are farmer beneficiaries of CARP under ORIGINAL


CERTIFICATE OF TITLE NO. 5069 containing an area of ONE HUNDRED TWENTY-SEVEN
THOUSAND THREE HUNDRED NINETY (127,390) SQUARE METERS, more or less; and were duly
awarded with parcels of land and were issued Certificates of Land Ownership Award (CLOA) and
their respective Transfer Certificates of Title over Lot Nos. 3414-A to 3414-AA all located at
Tomoc, San Miguel, Bohol, Philippines;

WHEREAS, the aforementioned VENDORS caused Main Road in the Consolidation-


Subdivision Plan of their respective parcels of land and the resulting Consolidation-Subdivision;

WHEREAS, the proposed road right of way designated as Main Road in the
Consolidation-Subdivision Plan passes through the following portions of a parcel of land under
Transfer Certificate of Titles and Tax Declarations in the following manner to wit:

1) TCT NO. CARP2020000018 and Tax Declaration No.2016-38-0018-00532, Lot No.3414-K


registered under the name of Claudio Galban containing area of TWO THOUSAND FIVE
HUNDRED THIRTY-SIX (2,536) SQUARE METERS, more or less;

2) Tax Declaration No.2016-38-0018-00531, Lot No. 3414-J under the name of Jose Galban,
et.al containing an area of ONE THOUSAND THREE HUNDRED EIGHTY-SIX (1,386)
SQUARE EMETERS, more or less;

3) TCT NO. CARP2020000023 and Tax Declaration No.2016-38- 0018-538, Lot No.3414-Q
registered under the name of Susan Ceballos containing an area of FIVE THOUSAND
FIVE HUNDRED THIRTY-NINE (5,539) SQUARE METERS, more or less;

4) TCT NO. CARP2020000024 and Tax Declaration No.2016-38-0018-00539, Lot No.3414-R


registered under the name of Claudio Galban containing an area of SIX THOUSAND FIVE
HUNDRED THIRTY-FOUR (6,534) SQUARE METERS, more or less;

5) TCT NO. CARP2020000026 and Tax Declaration No.2016-38-0018-00541, Lot No.3414-T


registered under the name of Cesario Galban containing an area of THREE THOUSAND
SEVEN HUNDRED FORTY-SIX SQUARE METERS, more or less;

6) TCT NO. CARP2020000027 and Tax Declaration No.2016-38-0018-00542, Lot No.3414-U


registered under the name of Cesario Galban containing an area of EIGHT THOUSAND
SEVEN HUNDRED FIFTY-TWO (8,752) SQUARE METERS, more or less;

7) TCT NO. CARP2020000028 and Tax Declaration No.2016-38-0018-00543, Lot No.3414-V


registered under the name of Cesario Galban containing an area of TEN THOUSAND
EIGHTY (10,080) SQUARE METERS, more or less;

8) TCT NO. CARP2020000029 and Tax Declaration No.2016-38-0018-00544, Lot No.3414-W


registered under the name of Susan Ceballos containing an area of THIRTEEN
THOUSAND FOUR HUNDRED THIRTY-FOUR (13,434) SQUARE METERS, more or less;

9) TCT NO. CARP2020000030 and Tax Declaration No.2016-38-0018-00545, Lot No.3414-X


registered under the name of Virginia Galban containing an area of TWELVE THOUSAND
ONE HUNDRED EIGHTY (12,180) SQUARE METERS, more or less;

10) TCT NO. CARP2020000031 and Tax Declaration No.2016-38-0018-00546, Lot No.3414-Y
registered under the name of Jose Galban containing an area of TEN THOUSAND EIGHT
HUNDRED EIGHT (10,808) SQUARE METERS, more or less;

11) Tax Declaration No.2016-38-0018-00547, Lot No.3414-Z registered under the name of
Jose Galban, et al. containing an area of TEN THOUSAND NINETY-ONE SQUARE
METERS, more or less;

WHEREAS, the aforementioned VENDORS desired to SELL the proposed right of way
designated as Main Road 8.00m of the said Consolidation-Subdivision Plan containing an area of
THREE THOUSAND FIVE HUNDRED FIFTY (3,550) SQUARE METERS, more or less;

WHEREAS, the VENDEE also wants to buy MAIN ROAD of the said Consolidation-
Subdivision Plan of real property for public use and/or purpose;

NOW, THEREFORE:

FOR AND IN CONSIDERATION of the sum of ONE HUNDRED NINETY–EIGHT


THOUSAND EIGHT HUNDRED FIFTY–SIX PESOS (Php 198,856.00) Philippine Currency,
receipt of which is hereby acknowledge by the VENDORS, the said VENDORS do hereby
ABSOLUTELY SELL, TRANSFER and CONVEY Main Road Lot 6 of the aforementioned
Consolidation-Subdivision with a total area of THREE THOUSAND FIVE HUNDRED FIFTY (3,550)
SQUARE METERS, more or less including all improvements found and standing thereon, unto the
VENDEE, her heirs, successors and assigns;

The VENDORS do hereby undertake that their heirs, successors and assigns shall warrant
and defend the title to the real property subject of this Deed against all claims of all persons or
entities. The VENDORS also guarantee the right of the VENDEE to take possession of the
property subject of this agreement upon the signing and execution of this agreement and will
defend the latter against all judicial or administrative actions for eviction.

This Deed shall be valid and binding not only on the parties herein but also on their
heirs, agents, representatives, successors and assigns.

ACKNOWLEDGMENT

appeared the above-named VENDORS with their proof of identity whom I have identified
through competent evidence of identity and who represented to me that their signatures on the
foregoing instrument were voluntarily affixed by them for the purposes stated in the instrument
and who declared that they executed the foregoing instrument as their free and voluntary act
and deed.

This Instrument consists of THREE (3) pages including this page in which this
acknowledgment is written, duly signed by the parties and their witnesses on each and every
page thereof.
