NOTICE OF HEARING

PLEASE TAKE NOTICE that pursuant to 235 ILCS 5/7-5 and § 4-4-280 of the Municipal
Code of Chicago, a hearing will be held REMOTELY via Cisco Webex software, on
Wednesday, Apri128, 2021 at 9:30 a.m. in connection with disciplinary proceedings regarding
the City of Chicago regulated business (hotel) license, liquor license, and all other licenses issued
to you for the premises located at 660 North State Street, Chicago, Illinois, upon the following
charge(s):

1. That on or about January 15, 2021, the licensee, by and through its agent, permitted
smoking of cannabis on the premises, in violation of 410 ILCS 82/15.

2. That on or about January 15, 2021, the licensee, by and through its agent, permitted
smoking of cannabis on the premises, in violation of Municipal Code of Chicago § 7-32-
015.

3. That on or about January 15, 2021, the licensee, by and through its agent, failed to obey
Order 2020-9 issued by the Commissioner of Health of the City of Chicago, to wit:
licensee permitted or allowed employees and/or patrons to violate the City order that all
persons must maintain social distancing on the premises, specifically, in the elevators, in
violation of Municipal Code of Chicago § 2-112-340.
4. That on or about January 16, 2021, the licensee, by and through its agent, failed to obey
Order 2020-9 issued by the Commissioner of Health of the City of Chicago, to wit:
licensee permitted or allowed employees and/or patrons to violate the City order that all
persons must maintain social distancing on the premises, specifically, in the elevators, in
violation of Municipal Code of Chicago § 2-112-340.

5. That on or about January 17, 2021, the licensee, by and through its agent, failed to obey
Order 2020-9 issued by the Commissioner of Health of the City of Chicago, to wit:
licensee permitted or allowed employees and/or patrons to violate the City order that all
persons must maintain social distancing on the premises, specifically, in the elevators, in
violation of Municipal Code of Chicago § 2-112-340.

6. That on or about January 17, 2021, the licensee, by and through its agent, failed to obey
Order 2020-9 issued by the Commissioner of Health of the City of Chicago, to wit:
licensee permitted or allowed employees and/or patrons to violate the City order that all
persons must maintain social distancing on the premises, specifically, 10 persons in room
2401, in violation of Municipal Code of Chicago § 2-112-340.

7. That the licensee's business is or creates a nuisance, pursuant to Municipal Code of


Chicago § 4-4-313 (a) (i), because within any consecutive 12 months, not less than three
separate incidents occur on the licensed premises, on or in the licensed premises' parking
facility, or on adjacent property, involving illegal acts; specifically:

a. On or about October 16, 2020, a patron or patrons of the licensee committed


aggravated unlawful use of a weapon by possessing a firearm on the licensed
premises, in violation of 720 ILCS 5/24-1.6;

b. On or about December 4, 2020, a patron or patrons of the licensee committed


aggravated unlawful use of a weapon by possessing a firearm on adjacent
property, in violation of 720 ILLS 5/24-1.6;

c. On or about December 8, 2020, a patron or patrons of the licensee committed


aggravated unlawful use of a weapon by possessing a firearm on the licensed
premises, in violation of 720 ILLS 5/24-1.6;

d. On or about December 8, 2020, a patron or patrons of the licensee committed


armed robbery on the licensed premises, in violation of 720 ILCS 5/24-1.6;

e. On or about December 12, 2020, a patron or patrons of the licensee lost a firearm
and failed to report the loss to the local law enforcement agency within 72 hours,
in violation of 720 ILCS 5/24-4.1;

f. On or about December 12, 2020, a patron or patrons of the licensee lost a firearm
and failed to report the loss to the Chicago Police Department within 48 hours, in
violation of Municipal Code of Chicago § 8-20-280;

g. On or about December 28, 2020, a patron or patrons of the licensee lost a firearm

and failed to report the loss to the local law enforcement agency within 72 hours,
in violation of 720 ILCS 5/24-4.1;

h. On or about December 28, 2020, a patron or patrons of the licensee lost a firearm
and failed to report the loss to the Chicago Police Department within 48 hours, in
violation of Municipal Code of Chicago § 8-20-280;

i. On or about January 1, 2021, a patron or patrons of the licensee committed


aggravated unlawful use of a weapon by possessing a firearm on adjacent
property, in violation of 720 ILCS 5/24-1.6;

j. On or about January 1, 2021, a patron or patrons of the licensee unlawfully


possessed narcotics on adjacent property, in violation of 720 ILCS 5/24-1.6;

k. On or about February 12, 2021, a patron or patrons of the licensee lost a firearm
and failed to report the loss to the local law enforcement agency within 72 hours,
in violation of 720 ILCS 5/24-4.1;

1. On or about February 12, 2021, a patron or patrons of the licensee lost a firearm
and failed to report the loss to the Chicago Police Department within 48 hours, in
violation of Municipal Code of Chicago § 8-20-280;

m. On or about February 18, 2021, a patron or patrons of the licensee committed


criminal sexual assault on the licensed premises, in violation of 720 ILCS 5/11-
1.20;

n. On or about February 18, 2021, a patron or patrons of the licensee committed


aggravated domestic battery on the licensed premises, in violation of 720 ILCS
5/12-3.3;

o. On or about March 7, 2021, a patron or patrons of the licensee committed


aggravated unlawful use of a weapon by possessing a firearm on adjacent
property, in violation of 720 ILLS 5/24-1.6;

p. On or about March 7, 2021, a patron or patrons of the licensee committed


aggravated unlawful use of a weapon by possessing a firearm on the licensed
premises, in violation of 720 ILCS 5/24-1.6.

8. That the licensee corporation is ineligible to hold a City of Chicago Regulated Business
(Hotel) License, or any other City of Chicago license, because the licensee corporation is
not in good standing in violation of Municipal Code of Chicago § 4-4-050(a)(2)(vii).

The licensee is advised that for the limited purpose of assessing the severity of the penalty that
could be imposed, when applicable, the City may present evidence of previous acts of
misconduct which have resulted in disciplinary action against the licensee, along with any other
citizen, police, or governmental agency complaints.

The licensee is advised that pursuant to an order of the Commissioner of the Department of
Business Affairs and Consumer Protection all license disciplinary hearings shall be conducted
remotely via Cisco Webex software until further notice.

The licensee is advised that parties appearing remotely, or their attorneys, must submit their
names, addresses, phone numbers, and email addresses to BACP-
Prosecutions@cityofchicago.org.

The licensee is advised that the latest version of the Rules of Procedure for Contested Hearings
Before the Mayor's License Discipline Commission of the Department of Business Affairs and
Consumer Protection and the Local Liquor Control Commission along with instructions, tips,
meeting links, and call in numbers/access codes for accessing remote hearings via Cisco Webex
software can be found at https://Chicago.gov/city/en/depts/bacp/provdrs/pros_adj.html.

The licensee is advised that all exhibits or motions, including appearance forms, must be
submitted at least three (3) business days prior to the hearing date via email to BACP-
Prosecutions@CityofChicago.org with the case number and Hearing Officer's name in the
subject line of the email. Exhibits not submitted in compliance with this rule may not be allowed
or admitted.

The licensee is advised that any questions or concerns regarding the Cisco Webex software
should be directed to BACP-Prosecutions@cityofchicago.org.

The licensee is advised that pursuant to 235 ILLS 5/4-5, the licensee or President of licensee
corporation is required to appear at the remote hearing regarding these proceedings and may be
required to produce for examination books and records of the licensee.

PLEASE TAKE FURTHER NOTICE that at the hearing you may be represented by counsel
and may produce witnesses and introduce evidence on your behalf. IN CASE OF YOUR
FAILURE TO APPEAR VIA THE REMOTE HEARING PROCESS, A
DETERMINATION WILL BE MADE BY DEFAULT.
