A Lusaka businessman
is seeking an injunction,
restraining Lands Minister
Jean Kapata, from
demolishing structures built
on the land he sold to other
individuals.
Aaron Mulope cited

Mr Mulope stated that
sometime in 2019, he
executed a contract of sale
in respect of a piece of land

TLN574/167 which he
offered to various individuals,
who have now developed
structures.
According to his statement
of claim filed in the Lusaka
High Court, Ms Kapata
instructed all occupants
to vacate the property
purporting to hold title to the
land.
“Ms Kapata obtained the
said title using her authority
as Minister of Lands as
she had never developed
the property within the
requirements of the offer
terms and was very aware
that the land was in fact
offered to Mr Malaika and
developments had been
effected,” Mr Mulope claimed.
He contended that the title
was fraud and was intended
to deprive the genuine
occupants, insisting that Ms
Kapata was using her political
position.
Mr Mulope accused the
Minietr of having hired agents
to demolish structures built
so far.
“The act of demolishing
the structures is likely
to prejudice me and my
intended beneficiaries who
have spent colossal sums of
money to develop and may
not be atoned for by way of
damages,” he said.
Mr Mulope now wants the
High Court to make an order
that Mr Malaika executes all
deeds that relates to transfer
of the land in question and
an order that the certificate
of title held by Ms Kapata be
cancelled.

ka and got away with

Njase has confirmed.
Mr Njase said the in-
cident happened on
Wednesday around
01:30 hours in Isoka
Township along the Old
Great North Road.
He identified the vic-
tim as Samuel Mbale of
Katonga village in Chief
Kafwimbi's area.
According to details,
Mr Winner Mugala, aged
70 another watchman at
the shop reported that
his colleague was shot
dead by unidentified
people.
Mr Mugala said he
heard a gunshot and
found his friend lying in
a pool of blood on the
Old Great North Road.
"The brief facts are
that Winner Muga-
la and Samuel Mbale
are watchmen whose
guarding points are the
shops located along the
Old Great North within
Isoka Township.
"Then on 01/07/2020
at around 01:30 hours
Winner Mugala heard a
gunshot about 100 me-
tres from his guarding
point,” he said.
Mr Njase said a team
of officers rushed to the
scene, but the suspects
had already gone.
Officers found Mr
Mbala’s body lying in a
pool of blood along the
Old Great North Road.
Mr Njase said the
body had multiple bul-
let wounds on the face,
chest and stomach pal-
lets are stuck on the
body and some on the
shirt of deceased.
"An expanded emp-
ty plastic cartridge was
found at the scene and it
has since been collected
by the officers and kept
at the police as an ex-
hibit,” he added.
He said it is believed
that after shooting the
watchman, the suspects
broke into the shop and
stole cash K300.00, $150
US dollars (K2, 700) and
20 Tanzanian Shillings
(K140) all amounting to
K3,140.
