I, PEDRO AQUINO , of legal age, married, and living at Ortouste St., Rosary Heights 6, Cotabato City, unemployed, petitioner in this case, after having been duly sworn, his eby attests that:
PRELIMINARY STATEMENT
The person examining me is ATTY. LAPU LAPU with office address at Door 1, AAA Bldg., Sinsuat Avenue, Cotabato City. The examination is being held at the same address. I am answering his questions fully conscious that I do so under oath and may face criminal liability for false testimony and perjury.
PURPOSE: This affidavit/testimony of petitioner PEDRO AQUINO is being
offered to prove that the judicial affidavit entered into last March 6,2020 for the purposes of substituting direct examination was made in good faith and duly notarized before a notary public. That the petitioner’s inability to answer during the cross examination was due to age and weak health.
1. Q. Please state your name and other personal circumstances for the record. A. PEDRO AQUINO
2. Q. Are you the same PEDRO AQUINO, the petitioner in this case? A. Yes sir.
3. Q. How old are you sir Pedro?
Page 1 A. I am already 73 years old.
4. Q. Why were you unable to answer the questions during the cross examination? A. It was because I could not hear properly as well as understand what the lawyer was saying.
5. Q. If you were asked again the same question properly, would
you be able to answer? A. Yes attorney, I believe I can answer if asked properly.
6. Q. Do you remember making a judicial affidavit?
A. Yes sir.
7. Q. Do you remember the date you made a judicial affidavit?
A. It was around March 2, 2020 sir,monday.
8. Q. Why did you say on the cross examination that it was made on March 3, 2020? A. It was because I went to the law office on monday sir but I returned back on tuesday to finish everything.
9. Q. Why did you not finish it on monday?
A. Because my health cannot carry on sir, I felt tired and dizzy.
10. Q. Why did you feel tired and dizzy while making the judicial affidavit? A. It’s because I am very old already sir. My body is not healthy anymore.
11. Q. Is this the same judicial affidavit that you finished on tuesday? A. Yes sir, that is the one made on tuesday.
12. Q. Do you remember having the document notarized?
A. Yes sir, I remember after preparing the document, we
immediately went to a public notary nearby to have it notarized.
13. Q. What are you asking this court with respect to this case?
A: I am praying that the Honorable Court would accept my
explanation that I was not able to answer purely because I wasn’t able to
