Dave Hester can move forward with the wrongful termination portion of his wide-ranging lawsuit against A&E and the producers of Storage Wars, judge ruled today. In a hearing Tuesday in La Superior Court, Judge Michael Johnson rejected the network’s attempt to dismiss the wrongful termination aspect of the former reality cast member’s nearly 10 month old legal action. Citing the First Amendment, A&E had argued that Hester’s suit would effectively hand him control over who they could put on the hit reality show. Johnson didn’t agree. “Plaintiff’s contract expressly states that Defendants had no obligation to use Plaintiff on the program during the term of their agreement. Popular A&E reality show "Storage Wars" is back in the spotlight this week, as Radar Online has published a report that three cast members of the storage bin-bidding program have been left out of extra episodes.
Reportedly, bidder Darrell Sheets (pictured) and auctioneers Dan and Laura Dotson were kept out of some extra episodes that were shot for the current season.
A source tells Radar, "They lived up to Darrell's contract, but then shot more episodes that weren't covered by his contract and kept him out of those. He was not happy to say the least."

It was the biggest payout in the history of "Storage Wars." Darrell Sheets invested $3,600 into a storage locker, which is a lot of money to take on a gamble. But the show clearly saved the best for last, as the season finale revealed a find no one could have anticipated.
The locker was filled with original art by Frank Guttierez. An expert estimated that the collection was worth approximately $300,000, flooring Darrell.
"How old on just a minute," he marveled. "$300,000? Bam!"
But is it too good to be true? In light of Dave Hester's suit claiming that the show is faked, some viewers online were skeptical.
Darrell took to Twitter to reveal that the locker turned out to belong to Guttierez, and he'd been in contact with the author. Further, he suggested that something is in the works with the show to debunk Hester's claims.

Darrell Sheets really paid for one locker on this week's "Storage Wars." The unit was literally filled to the ceiling with furniture, electronics and other items, making it a hot commodity at the auction.
Of course, it didn't help that Dave Hester was gleefully getting into a bidding war with him, seemingly with no intentions of actually winning.
"I love making Darrell pay," Hester laughed.
But it didn't matter. Sheets wound up paying $7,250 for the locker -- which is the most he'd ever paid for one -- but quickly started to feel better about the gamble.
"This is better than I even dreamed," he said as more and more pristine items came out of the unit. In the end, Sheets estimated the value of his purchase at over $10,000.

This only builds our curiosity of the fascinating Mozzie, who we never know what he’s up to on any given moment, as well as how he acquires some of his antiquities. Now we know. Dave Hester, star of A&E's hit reality series Storage Wars, and rapper/singer Trey Songz have settled the lawsuit over who gets to say "Yuuup!" on television. Last November, Hester sued Songz (born Tremaine Neverson) and sought a court order that would bar the rapper from "interfering" with his use of "Yuuup!" Both Hester and Songz each argued that the exclamation was a signature catchphrase. Storage Wars found its formula rather early on in its first season, and it hasn’t changed at all since. The second season follows the same pattern, with the first half of each episode devoted to the four teams bidding on abandoned storage units, and then the second half sees them scrounging through hoping to find treasures buried within that will make their investment worthwhile. The same groups remain front and center: the egotistical mogul, Dave Hester; idiotic, redneck braggart, Darrell Sheets and his son Brandon; the amusing bickering couple, Jarrod Schulz and Brandi Passante; and colorful, bored collector, Barry Weiss. Occasionally other parties will muscle in on their fun, like the bullying Mark Balelo or cunning Nabila Hannis, but they’re usually never around for too long (though Nabila might be in the next season).

I recently took a trip to the Us for a holiday and, as I tend to do when on holiday in America, I found myself flicking through the many television channels available on the hotel TV – and, as also tends to happen when having so much choice, I stopped upon the strangest shows I saw and wouldn’t you know it the majority of those were (shudder) reality television. Most of the fun of 'Storage Wars' (Wednesdays, 10Pm on A&E) is the detective work pf figuring out what a storage unit might be worth without being able to dig in and look around. Dave Hester is one of the best at that, and on Wednesday's episode, he saw something about a particular unit at Mission Hill Self Storage that he couldn't resist.
Hester saw a locker full of what looked like unopened boxes marked "Made In China," all with one company's imprint on them. "I know what it costs to ship merchandise from overseas," said Hester. "This would be four to five thousand bucks. So whatever is in here has to have value." Hester had to fight off Mark Balelo, a bidder who had been running up prices all day, to win the locker for $9,000.
