Divided and this application'March 28, 1956, Serial The present invention relates to a clip and cap assembly for writing instruments, such as ball point pens, mechanical pencils, fountain pens, and the like, and more particularly to a novel spring-loadedtclip and manner of mounting one end of the clip in the cap.

Among the objects of the present invention is to provicle a novel clip assembly for writing instruments in which the body of the clip is of rigid construction and spring-mounted at one end in the outer end of the cap whereby the shankand exposed retaining end of the clip are spring-biased to exert a positive gripping action against the cap, but readily yields for attaching the clip to the clothing when the writing instrument is not in use, or for. detaching the clip and removing the writing instrument from the pocket when intended for use.

Another and important object of the present invention is the provision of a novel clip assembly for a writing instrument, and novel means for spring-loading the clip and tensionally retaining it in operative position.

The present invention further comprehends a novel ciipand cap assembly for positively mounting and retaining the clip upon the cap, one end of the clip projecting into the interior of the cap through a longitudinally extending slot in the side wall of the cap adjacent its closed or outer end, and a novel means and manner of pivotally and tensionally mounting the end of the clip in said cap.

Further objects are to provide a construction of maximum simplicity, efficiency, economy and ease of assembly and operation, and such further objects, advantages and capabilities as will later more fully appear and are inherently possessed thereby.

Referring more particularly to the disclosure in the drawing in which is disclosed an illustrative embodiment of the present invention, the writing instrument 10 is shown provided with a cap 11 adapted to be mounted on the outer end of the barrel or body 12 of a writing instrument, such as a ball point pen, mechanical pencil, fountain pen and the like having a barrel provided with a writing point.

The cap is provided with a pocket clip 13 adapted to be attached to the pocket or other part of the clothing where the writing instrument is retained when not in use. To prevent accidental or unintentional removal of 2,837,801 Patented June 10, 1958 ICC" the writing instrument from the pocket or other support or part of the clothing, the clip 13 is adapted to yieldingly grip the material of the pocket or other support but permit ready removal when the writing instrument is intended for use.

The clip 13 is provided with a shank 14 having at its free end a rounded tip or engaging end 15 and at its other end is provided with a shoulder 16 on its pivotally mounted or fulcrumed end or enlargement 17. To mount the pivotal or fulcrumed end 17 in the upper or outer end 18 of the cap 11, the end 17 is contoured to be projected through a longitudinally extending slot 19 in the wall of the cap shell 21 and anchored in the cap 11. This enlarged end 17 is provided with a notch or recess 22 to conformably receive an edge 23 of the cap shell 21 at the upper or outer end of the slot 19 and fulcrum about this edge as the rounded end or engaging tip 15 on the free end of the shank 14 is moved toward or away from the shell 21 of the cap 11.

The upper or pivotal end 17 of the clip is provided with another notch or recess 24 disposed at the lower edge of the end 17 into which projects a lip 25 on a projected part or extension 26 of a clamp member 27 mounted in the outer or upper end of the cap 11. A liner 28 is also provided in the cap shell 21. This clamp member 27 has a substantially cup-shaped base 29 provided with the rearwardly extending projection 26 substantially conforming to the internal surface contour of the cap shell 21. Thuswhen the cap, 11 is assembled with the projection or extension 26 aligned with the slot 19, the reduced end or lip 25 is bent over and anchored onto the cap shell 21 at the lower end of the slot 19 as shown in Fig. 3.

Spaced approximately 180 from the projection 26, the clamp member 27 is provided with inwardly projecting, elongated and spaced flanges 31 adapted to provide a longitudinally extending channel for receiving and retaining a coil spring 32, the lower orinner end of which spring seats against or abuts the base 29 and the upper or outer end of this spring bears against the shoulder 16 on the pivotally mounted or fulcrumed end 17 of the rigid pocket clip 13.

As will be evident from Fig. 3, when the end or lip 25 projects through the slot 19 in the cap and is bent onto the cap shell 21, the enlarged or fulcrumed end 17 of the clip 13 is locked in the cap 11. Then as the free end or rounded tip 15 of the spring-loaded clip 13 is moved away from or toward the cap 11, the enlarged end 17 of the clip fulcrums or pivots about the edge 23 of the cap shell 21. r

From the above description and the disclosure in the drawing, it will be apparent that the present invention comprehends a new form of clip and cap assembly for writing instruments and a novel means and manner of spring-loading the clip and retaining it in operative position.

Having thus disclosed the invention, we claim:

1. In combination, a hollow cap for a writing instrument, said cap being closed at one end and adjacent said closed end having a longitudinally extending slot, a liner for said cap, a clamp member mounted at the upper end of the liner within and fitting conformably in the cap and having a part projecting through the slot and anchored to the adjacent edge of the cap, spaced flanges at one side of the clamp member, a rigid clip having an enlargement at its one end anchored in the cap by said clamp member and said enlargement having an offset portion at one end providing a shoulder, and a coil spring mounted between the spaced flanges of the clamp member within the cap and beneath the offset portion and engaging said shoulder on the enlargement for tensionally retaining the other end of the clip in operative position,

In combination, a hollow cap for a writing instrument with the cap closed at one end and adjacent said closed end provided with a longitudinally extending slot, a clamp member mounted Within the end of the cap adjacent the slot and'provided with a substantially cupshaped base and a lip projecting through the slot and bent over the inner end of the slot to anchor the clamp member in the cap, spaced flanges at one side of the clamp member to provide a longitudinal channel, a rigid clip having a shank and rounded end at the exterior of the cap and an enlargement projecting through and fulcrumed in the slot of the cap and retained by said lip, said enlargement having a reduced part at its inner end projecting to the inner wall of the cap opposite said slot and providing a shoulder, and an expansion spring housed within the cap in the channel of the clamp member and engaging the shoulder for sprin -loading the clip.

3. A clip assembly for a writing instrument, comprising a hollow cap closed at one end and adjacent said closed end provided with a longitudinally extending slot, a clamp member mounted within the end of the cap adjacent the slot and having a cupped base fitting conformably in the cap and a part projecting through the slot and anchored to the cap at the end of the slot, one side of said clamp member having spaced, longitudinally extending flanges, a rigid clip having a shank and rounded end at the exterior of the cap and an enlargement projecting into the cap through the slot and fulcrurned in the slot of the cap and retained therein by the projecting part on the clamp member, a reduction on the inner end of the enlargement providing a shoulder, and a spring housed within the cap and between the flanges of the clamp member with one end of the spring engaging the shoulder on the enlargement for spring-loading the clip and tensionally retaining its shank and rounded end in close proximity to the exterior of the cap.

In combination, a hollow cap for a writing instrument, said cap being closed at one end and adjacent said closed end having a longitudinally extending slot, a liner for said cap, a clamp member mounted'at the upper end of the liner within and fitting conformably in the cap and having a part projecting through the slot and anchored to the adjacent edge of the cap and having spaced flanges providing a longitudinally extending channel, a rigid clip having an enlargement at its one end anchored in the cap by said clamp member and said enlargement having an ofifset portion at one end providing a shoulder, and a coil spring mounted within the channel of said cap and beneath thc offset portion and engaging said shoulder on the enlargement for tensionally retaining the other end of the clip in operative position.

5. In combination, a hollow cap for a writing instrument with the cap closed at one end and adjacent said closed end provided with a longitudinally extending slot, a clamp member mounted within the end of the cap adjacent the slot and provided with a transverse base and a lip projecting through the slot and bent over the inner end of the slot to anchor the clamp member in the cap, a rigid clip having a shank and rounded end at the exterior of the cap and an enlargement projecting through and fulcrumed in the slot of the cap and retained by said lip, said enlargement having a reduced part at its inner end projecting to the inner Wall of the cap opposite said slot and providing a shoulder, a longitudinally extending channel provided in and at one side of said clamp member adjacent said shoulder, and an expansion spring housed Within the cap in the channel of the clamp memher and seating at one end on the base of said clamp member and at its other end engaging the shoulder on said enlargement for spring-loading the clip.
