The State of Louisiana is one that has made no bones about the illegality of Internet Gambling within the state and specifically has a Constitutional Amendment to make gambling by computer illegal.
Committing the crime of gambling by computer can result in jail time of up to six months, a fine of up to $500, or both under 90-3-D of the code.
Three individuals from Seattle who operated a gambling website called Betcha were arrested in Louisiana and faced charges of, ‘Gambling by computer,’ when an officer placed bets at their site.
However, despite these arrests, all legal action taken under the, ‘Gambling by computer,’ statutes have focused on operators rather than players, although, it is still illegal to gamble online in Louisiana pursuant to the letter of the law.
Furthermore, a bill to legalize daily fantasy sports in the state died a Legislative death earlier this year.
Because there is no question that merely participating in online gambling is illegal in the state of Louisiana, it must be construed as banned.
