editHello Marchjuly, I have a question about image copyright, hope you can help. This photo and this one are both in the Gardiner, Arthur Z. collection. The author says that the US government has copyrighted this material, I'm not sure if the General Lê Văn Kim.jpg file has the correct image tag; if so, then similar photos like this one and this one — also in the same collection — can be uploaded with the same PD-USGov tag, right? - This might be a good thing to ask about at c:COM:VPC. I'm not sure whether content published by presidential libraries automatically is in the public domain because I think such libraries are often run by private foundations or other organizations and not necessarily the US federal government; for example, the Wikipedia article about the Harry S. Truman Presidential Library and Museum states it was built using private funds even though it's being administered by the National Archives and Records Administration. So, it's possible (I guess) the library is hosting photos taken by persons who weren't working for the US federal government. If, however, the photos were taken by a US federal government employee as part of their official duties, they probably would be within the public domain regardless of where they're found online. Finally, even though the library seems to be selling prints/files of such photos, they also don't seem to be claiming copyright ownership over them because of the statement "The Library is unaware of any copyright claims to this item; use at your own risk." The library seems to be essentially just charging a fee for sending out of files/copies of the photos and perhaps some associated documentation, but not for a license to use the photos. -- Marchjuly (talk) 06:02, 16 October 2024 (UTC)
