To put a legislatively referred constitutional amendment before voters, a two-thirds (66.67%) vote is required in both the Montana State Senate and the Montana House of Representatives.

The amendment was introduced to the Montana State Senate on March 28, 2023. The amendment passed the Senate by 40-10 on April 4, 2023. The measure was not passed in the House before the state legislature adjourned its 2023 session.[1]
