Martial Law

1971-1986
•Martial Law
-is the imposition of direct
military control of normal civilian
functions by a
government,especially in response
to a temporary emergency such
as invasion or major disaster,or
in an occupied territory.
Martial Law in the Philippines
(BAT‘AS MILITAR SA PILIPINAS)
• Refers to several intermittent periods in the
philippine history,wherein the philippine head
of state(such as the president)places an area
under the control of the Armed Forces of the
Philippines and its predecessor bodies.Martial
Law is declared either when there is a near-
violent civil unrest or in cases of major natural
disasters,however most countries use a
different legal construct like’’state of
emergency’’
Typicaly,the imposition of martial
law accompanies curfews,the
suspension of civil law,civil
rights,habeas corpus,and the
application of extension of military
law or military justice to
civilians.Civilians defying martial law
maybe subjected to military
tribunals(court martial)
• In September 1972 Marcos declared martial
law,claiming that he was the last defense
against rising disorder cause by
increasingly violent student
demonstrations,the alleged threats of
communist insurgency by the new
Communist Party of the Philippines
(CPP),and the muslim separatist movement
of the Moro National Liberation
Front(MNLF).One of his first actions was to
arrest opposition politicians in Congress
and Constitutional Convention.Initial public
reaction to martial law was mostly
favourable except in muslim areas of the
south,where a separist rebellion ,led by the
MNLF,broke out in 1973.

Explanations for the declaration of
Martial Law:
• Numerous explanations have been put
forward as reasons for Marcos to declare
martial law in September 1972,some of which
were presented by the Marcos administration
as official justifications,and some of which
were dissenting perspectives put forward by
either the mainstream political opposition or
by analyst studying the political economy of
decision.
• By declaring martial law,Marcos
suspended the writ of habeas
corpus and also 1935
Constitution,dissolved Congress
and padlocked the doors to the
Batasang Pambansa,and
assuming both legistative and
executive powers.Proclamation
No.1081 was dated 21
September 1972 but it was
Marcos’ September 1972 proclamation
of martial law and had major repercussions for the
1971 Constitutional Convention .Marcos arrested the
leadership of the opposition bloc of the convention
which wanted to make sure Marcos would not stay in a
power longer than two terms allowed him under 1935
constituion.Eventually,a group of Marcos supporting
delegates led by Gilberto Duavit came up with an
entirely new draft of the constitution,which they
submitted to Malacang for the ratification within only 2
months of the proclamation of martial law.
When Marcos became president
in 1965,Philippine policy and
politics functioned under a
Post-World War 2 geopolitical
framework .

would reserve decree-making
