What is MARRIAGE?

It is defined as a formal and durable sexual union


of man and woman, which is conducted within a
set of designated rights and duty.

Marriage becomes formal when it is accepted and


sanctioned by society and that relationship is
characterized by permanence.

It is both a “contract” and a “status”.

1 It becomes a contract when a man and a woman


sign into agreement a permanent union that can
only be dissolved by death unless annulled.

institution which is a foundation of the family.
Requisites for MARRIAGE
1. Legal capacity of the contracting parties – Parties must be male
and female or of different sexes for the procreation of life.

2. Consent of the contracting parties – Consent should be freely


given in the presence of an authorized solemnizing officer. The
couples presence is essential in the marriage ceremony.

3. Valid marriage license – minimum age requirement is eighteen


(18) years of age for both male and female.
Dissolution of Marriage
1 Divorce – a complete dissolution of marriage in which
both parties can marry again. Most of the grounds for
divorce have existed after the marriage. It is
implemented in the U.S and other countries except in
the Philippines.

2 Annulment – It is a process by which marriage is


considered null and void due to its defectiveness that
has existed on or before marriage. In annulment, the
marriage is set aside and the parties can marry again. It
is the Philippines’ version of divorce.

• Abandonment
• Incarceration
• Impotency or physical inability to engage in sexual
intercourse
• Adultery
• Incurable insanity
• Drug addiction
• Refusal or neglect to provide suitable support for the
spouse
• Irreconcilable differences

of Marriage
• Lack of parental consent
• Insanity of one parties
• Fraud
• Force, intimidation
• Impotency
• Affliction of sexually transmissible disease
