Subject : RCC work for building A-2 , in our project Maharaja gardens, located at plot no 4, S. no. 234/3,
Ambedkar nagar, Goregaon, Mumbai.

With reference to your quotation dated 21/01/15 , & discussions we had with you , we are
placed to award you the work order RCC work of Sub structure & Super Structure of Building A-2, in
our project Maharaja gardens, at plot no 4, S. no. 234/3, Ambedkar nagar, Goregaon, Mumbai, on Labor
basis.

The detailed terms & conditions of the work order are as follows:

DETAILED TERMS AND CONDITIONS:

1.Project details:

The project & building details for which this work order has been allotted are as follows:

Project name: Maharaja gardens

2. SCOPE OF WORK :

The contract shall mean the construction, completion and maintenance during defects liability period ,
provisions of all labour for shuttering, lifting, cutting and tying of reinforcement, concreting as per
specified grade, all the shuttering materials, tools and machinery as mentioned herein.

The contract shall include the following works:

Entire R.C.C work in sub structure & super structure of the building including side rail fixing and centre
line marking, PCC below footing / Plum concrete below footing upto 12”, murum filling, compacting ,
and soling up to 12” for plinth , footings , plinth beams , plinth PCC , columns , beams , slabs, slab
projections at beam bottom or top, double height slabs for alternate level attached terraces , staircase ,
staircase pardi , attached terrace pardi , 4ft column extension above top terrace slab , chajjas , lift duct ,
concrete window sills , lift machine room, overhead water tank , lofts, lintels, window sills etc .

Elevational features like cornices /round columns / flower beds etc.

All civil works connected with the erection of lifts such as foundation pedestal for buffers in lift pit, plum
concrete in lift pit if any.

Hacking of all RCC works wherever plastering is required.

Curing of all RCC work.

3. PAYABLE AREA (WORK QUANITY) :

The payable area for the contract is 88748 Sft. It includes all out to out slab areas of all slabs including
projections & lift ducts, lifts machine room top & bottom slab, OHWT top & bottom slab. Service ducts
of areas less than 30 Sqft area are not deducted. The detailed area calculation is as per annexure I.

4. QUANTITY VARIATION:

If due to any reasons, this area changes as per the actual executed work on site, then the revised actual
area shall be considered for the final payable amount calculation. The change in the area shall be jointly
certified by the contractor and our site in charge.

5. PAYABLE AMOUNT:

The rate agreed for the completion of the work as mentioned in the scope of the work is Rs. 170/- per
slab area as per annexure I. As per this rate, the total amount of this contract comes out to
Rs.1,50,87,160/-(In words Rs One crore fifty lac fifty eight seven thousand one hundred and sixty only)
6. TIME OF COMPLETION:

Time is the essence of the contract. The entire work in your scope shall be completed in all respects and
handed over to us before the targeted date of completion. Contractor shall adhere to the schedule fixed
by the site in charge to suit the site conditions. It shall be the contractor’s responsibility to jointly
workout the detailed program along with the site in charge so as to complete the work within the time
period.

Date of start of work: 15/03/15

Targeted date of completion of the work: 28/02/16

Slab cycle for typical floors shall be of 18 days including all holidays.

7. LIQUIDATED DAMAGES FOR DELAYS:

Amount of Rs. 5000/- per day will be deducted from each slab billing if the slab work gets delayed than
the targeted slab to slab cycle days, if the delay is due to any reasons attributed to contractor except
Force Majeure or any reasonable cause beyond control.

8. BONUS FOR EARLY COMPLETION:

Amount of Rs.7000/- per day will be paid as bonus, if the slab work is completed before the targeted
slab to slab cycle days.

9. TERMS OF PAYMENTS:

a. No mobilization advance shall be paid to contractor.

b. Contractor shall submit his R.A bill after each payment stage along with abstract /measurements on
the company’s standard format.

c. 5% retention shall be deducted from each R.A bill 50% of this retention amount shall be released after
completion of LMR & OHWT. OHWT and rest 50% shall be released after successful completion of
defects liability period of 6 months from the completion of LMR & OHWT.
d. Payment of R.A bills will be made be to contractor within 15 days on submission of technically &
commercially correct invoice to our project manager. Contractor shall get the R.A bills scrutinized and
certified at site from the site in charge.

e. Debit notes , if any , shall be attached along with each R.A Bill duly signed by site in charge and
accepted by the contractor .Decision of director / project manager /site in charge will be considered as
final in case of discrepancies.

f. Applicable TDS will be deducted from each payable amount and TDS certificate for the same will be
handed over to the contractor at the financial year end.
g. Service tax shall be paid extra on each RA bill (Service tax registration shall be provided to claim
service tax)

9. PAYMENT STAGES:

The payment stages of the contractor shall be per attached annexure II.

10. GENERAL CONDITIONS REGARDING WORKMANSHIP AND WORK PROCEDURES:

1. All the concreting shall ne machine mixed and as per the mix design provided by the company.
2. For the works required quantity of nails and binding wire .Shuttering should be of the approved
and standard quality as decided by the builder / owner.
3. All planks , ply boards / steel centering plates shall be applied with de-shuttering oil , as
approved by the engineer , before reinforcement .The black oil or waste motor oil shall not be
used.
4. Binding wire for holding the form work / centering in position shall be purchased by the labour
contractor at his cost.
5. The tie rod holes (if any), shall be filled with non – shrink grout. Grouting material will be
supplied by the company.
6. Casting of minimum 12 cubes for each major concreting and shifting the cubes from the place of
concreting to the curing tank.
7. The contractor shall provide and place sleeves, pockets, inserts etc., in R.C.C for plumbing,
electrical, firefighting, lift etc.
8. The labour contractor is responsible for the proper utilization of the steel lot supplied to him.
9. Bars shall be cut, bent, hooked, and placed in position as per schedule /detailed R.C.C drawings
or directed.
10. Covers blocks as required shall be made and cured by the labour contractor .Material for the
same shall be supplied by the company.
11. All R.C.C surfaces shall be absolutely vertical / horizontal with a perfect smooth finish .In case of
honeycombing , it shall be cleaned with a wire brush, watered and repaired by the contractor at
his cost.
12. For all R.C.C work de shuttering period will be as specified by the structural consultant.
13. All R.C.C work shall be adequately and sufficiently cured by the labour contractor. The tools and
materials for the curing like pipes , buckets , drums shall be brought by the contractor .Curing of
slab shall be done with ponding method by making ponds in cements and sand mortar (1:10) of
size around 5’ X 5’ .Curing of columns shall be done by heissan cloth.
14. The labour contractor shall provide wooden plant railing at his cost.It should be fixed firmly on
bullies @ 2.4 m (8FT ) c/c embedded in concrete and at 1.5m (5ft) distance all around the
building . The planks shall be 15 cm (6”) wide and shall be in one level , with right angels at
corners.
15. All R.C.C works shall be hacked with tacha by the labour contractor at his cost while the concrete
is green. It understood that the hacking shall be at least 500 notches per sq.m (50 nos/ s.ft) of
surface area.
16. The grid lines should be marked on plinth P.C.C and on every slab for proper line out of columns
above the plinth / slab level by the contractor at his cost. Starter shall be filled for each column
as per the column grid.
17. The labour contractor shall fix premoulded bituminous sheet and / or any expansion joint
materials supplied by the builders / owners for expansion joint (If any) in the R.C.C works at his
cost.
18. The dowers bars for steel reinforcement are required to be provided at any junctions for future
work .They shall be provided by the labour contractor as part of the steel reinforcement work.
19. For all R.C.C works , the cover blocks for covers as specified by the consultants , shall have to be
made by the labour contractor and fixed in all R.C.C work. Material for making cover blocks shall
be supplied by the builders / owners.
20. Scaffolding for all R.C.C works, hoist and lift shall be done and dismantled by the labour
contractor, along with the material, at his cost.
21. Space for mixture or lift shall be cleared by the labour contractor at his cost.
22. The labour contractor shall return all empty cement bags to the storekeeper before demanding
further cement for any work for that / next day’s work .
23. The contractor shall co ordinate with plumbing and electrical contractors for their related work
during RCC work.
24. Care shall be taken during the execution of work to avoid nuisance and disturbance to the
neighborhood.
25. Main distribution boards and electrical switch boxes wherever provided shall be protected and
thoroughly cleaned.
26. Any departmental work directed by company’s site in charge (not in scope of civil contractor)
shall be paid at actual .Contractor to keep proper record of the same duly certified by site in
charge with supporting reason , usage of labour , area of work etc.
27. All work of R.C.C shall be machine mixed and properly vibrated with suitable vibrators.
28. For all defective work, lobour contractor shall be solely responsible and shall bear the cost
material and labour for redoing same as directed by the engineer in charge.
29. The labour contractor shall not remove any material from site either belonging to the company
or the labour contractor without prior knowledge, consent and written instructions from site in
charge.
30. One copy of material requisition note (MRN) for the material which is brought on site by the
contractor must be given to the company.
31. No extra cost shall be paid to the labour contractor for any work that is carried out beyond the
working hours of the day by day of night shift.
32. Contractor or his representative shall give daily labour report to the site in charge.
33. The company reserves right to debit the contractor for the cost of ->a) any company material
damaged during the work, b) excessive wastage of material supplied by the company for the
work, c) The cost of rectification of the defective work if the same has not been rectified by the
contractor at his cost.
13. SAFETY AND SECURITY NORMS:

Contractor should take adequate precautions for safety at sit by providing, safety helmets, safety shoes,
goggles, hand gloves, reflector jackets, safety belts etc. to all the workmen who are working or present
at site, All electrical lines temporary/permanent at site should be checked before usage t5o ensure
leakage.

If any accident occurs at site due to negligence of the above mentioned safety norms, the contractor will
be solely responsible for all the consequences arising out of the above and the client is abso9lved of any
claims/Compensation if any payable by the contractor to his workman.

Company/client shall be indemnified for any theft, damages, accident for the plant & machinery. Entire
responsibility of safety, storage of machinery; consumables etc. shall be with the contractor after the
issue of material

14. CLEANLINESS AT SITE:

Contractor shall keep the site in a clean and tidy manner as instructed by site in charge and if contractor
fails to maintain the desired cleanliness, contractor interim payment shall be withheld and the site shall
be cleaned by other agencies appointed by site in charge and the cost of the same shall be recovered
from contractor’s interim payment.

15. SHUTTERING MATERIAL &SUPPORTS:

All RCC formwork for beams and columns shall be with 12mm thick plastic coated ply of approved
quality. Formwork for slabs should be either in 12mm thick plastic coated ply of approved quality or
good quality metal plates as decided by the company. 16mm dia Tie roads shall be used for
columns/retaining wall & beams where depth exceed or as instruction by site incharge. Contractor shall
give fairly good quality finish for RCC members.

Steel props/wooden props along with metal spans shall be engaged for supporting the form work,
wooden props which are out of plum by more than 5mm shall not be permitted to use as the support to
the formwork. All shuttering materials should be new, and shall be subjected to inspection and
acceptance by company’s Site in charge. Contractor shall provide required shuttering to achieve the
progress of work. In case, if additional shuttering is required for achieving the targeted work schedule,
it shall be brought by contractor at no additional cost to the company.

16. ELECTRIC SUPPLY FOR WORK EXECUTION/LABOURS:

Electricity for construction and labour hutment shall be provided free of cost by us at one point. Further
distribution shall be at your cost. Electricity for labour camps shall be arranged by us at one point in
labour camp. It shall be your responsibility to ensure that there is no misuse/wastage of electricity.
17.WATER FOR WORK EXECUTION/LABOURS:

Water for construction shall be provided free of cost by us at one point at every floor, further tapping
shall be done by you at your cost. Curing pipe will be provided by company. Water for labour camp shall
be supplied at one place and further distribution shall be at your expenses. Water taps shall be kept shut
each day from 9.00a.m to 7.00p.m at the labour colony. It shall be your responsibility to e3nsure that
there is no misuse/wastage of water. You shall make adequate arrangements for curing of concrete, to
the satisfaction of site in charge at no extra cost to us.

18. ESCALATION IN RATES:

Contractor’s contract rate shall remain same till the completion of the work as mentioned in the scope
of work herein. No extra charges shall be paid towards extra working hours , increase in labour wages ,
material tools and machinery rates , operator charges etc even though the work is delayed due to some
reasons .

Company shall only bear the additional charges due increase statutory taxes, if any.

Similarly in case, if the taxes are reduced corresponding reduction shall be applicable for the payable
amount.

20. GUARANTEE /DEFECTS LIABILITY PERIOD:

The total work executed shall be guaranteed for quality of workmanship etc. for a period of 6 months
from the date of handing over of the entire works to the satisfaction of the company .During the
guarantee period, if any defective workmanship is noticed , you shall rectify the work at your own cost
including the required material cost.

21. SPACE FOR THE LABOUR CAMP ETC:

Land for Labor Camp, office, stores etc. will be provided at site free of cost as and when it is available at
site or nearby. Contractor shall provide hutments for his labor at site at his own cost including materials
required for the same at a suitable location identified by the Project Manager. No workmen will be
allowed to stay within the building under construction.

It shall be responsibility of Contractor to maintain the cleanliness and hygienic condition at labor camp
and at full site as well. You shall take the necessary action in this regards, as directed by our Project
manager at no extra cost to the company. In case contractor fails to maintain the requisite hygienic
conditions in labour camp as per the local authority’s health dept's requirements, company shall get the
same done & debit an amount of Rs. 500/- per labour per month deployed by contractor. Contractor
shall be responsible for his labor management thereof and upon completion of work you shall remove
labor camp etc. outside of the site.
22. WEEKLY/FORTNIGHTLY MEETINGS:

Weekly / Fortnightly Co-ordination and progress monitoring meetings will be held at site along with
Contractor.

23. MAN POWER, PLANT / MACHINERY REQUIREMENTS:

The contractor shall submit a comprehensive manpower, plant , machinery schedule , which shall
include the dates of arrival on and removal from site of each major activity . Minimum plant and
machinery expected is included for guidance .However , contractor to verify sufficiency for himself and
arranges additional plant and machinery required to complete the work .None of the equipments and
materials brought to site shall be removed from the site without the permission of the site in charge

Contractor’s staff at site (per wing / building):

Contractor shall provide following minimum staff equipments per building at site for the period of
contract subject to approval of our director / site in charge .

Site in charge / Site engineer :- 1 No.

Supervisor :- 1 No.

Carpenter:- 25 No or as required for timely completion.

Fitter :- 15 No or as required for timely completion.

Labour’s for concreting -: 7 No or as required for timely completion.

24. RECONSILIATION OF MATERIALS:

Contractor shall assist Site Engineer in reconciliation of Cement, steel received on site at following
stages.

First Reconciliation shall be done after completion of plinth.

Second Reconciliation shall be done after completion of 4th slab.

Third Reconciliation shall be done after completion of 8th slab.

Fourth & final Reconciliation shall be done along with submission of final bill.

Permissible wastage limit for cement and steel shall be 3%.

In case wastage identified at intermediate stages as mentioned above is more than these limits,
contractor shall make all the efforts to bring wastage within the permissible limits. Contractor shall take
care to see that the wastage of material does not exceed the standard consumption norms.

24. NON PERFORMANCE AND TERMONATION OF CONTRACT:

The developer / company reserve the right to terminate this subcontractor with immediate effect either
wholly or in part without payment of compensation to the contractor in case of following circumstances.

a) If the contractor fails within three day notice from the developers to proceed diligently with the
work to his satisfaction and at all times in such a manner as will not in the developers opinion ,
prejudice the completion of the whole or any portion of the work under the principal contract in
accordance therewith.
b) If the contractor refuses / delays or fails within three days notice to rectify any defective
workmanship to the developer’s satisfaction.
c) If the contractor fails to complete and deliver any work or portion of the work by the time or
times specified in the work schedule or by such extended time or times as may be allowed by
the developers in writing.
d) If the contractor fails to withdraw /replace immediately, at developers instructions any one or
more of the employees to whom developer objects o whose presence on the works may not be
good to maintain healthy working environment on site.
e) If the contractor sublets whole or part to this work without developers written prior approval.
f) If the contractor fails within three days notice from developer to take action on any of the
obligations on the part of the contract herein contained.
g) If the contractor fails to mobilize sufficient man power, machineries etc .affecting quality and
progress of work .Company shall engage another agency to complete the work at contractors
risk and cost.
