PEOPLE VS.

ERNESTO PUNO
G.R. No. L-33211 June 29, 1981

FACTS: This case is about murder wherein the accused interposed insanity as a defense.
On September 8, 1970, Ernesto Puno entered in the bedroom of his neighbour Francisca Col (Aling
Kikay), a 72 year old woman. Upon seeing Aling Kikay, Puno insulted her saying Mangkukulam ka,
mambabarang mayroon kang bubuyog. Then he repeatedly slapped her and struck her several times on
the head with a hammer until she died.
After the killing, Puno went to the room of Lina and Hilaria, borders of Aling Kikays house, and told
them not to call the police because he already killed Aling Kikay and if ever they will call the police, he
will revenge on them. Puno then fled and went to his parents house at Bario Tugatog Malabon.
Lina notified the Malabon Police and thereafter Puno was turned over to the police by his father. Puno
was brought to the National Mental Hospital in Mandaluyong on September 10, 1970. On October 21,
1970, he was indicted for murder in the circuit Criminal Court at Pasig.
Three Psychiatrist was presented by the defense but instead of proving that Puno was insane at the time of
the killing, experts testified that Puno acted with discernment, that Puno was an outpatient whou could
very live well with society although he was afflicted with schizophrenic reaction.
Issue: Is the accused was sane when he committed the killing and could he be exempted from the killing?
Ruling: Based on facts and testimonies of the experts on the issue of the case, Puno was sane at the time
he killed Aling Kikay. The court held that Puno was not legally insane when he killed the victim.
Psychiatrists revealed that on the tragic event he was not completely deprived of reason and freedom of
will. In fact, after the killing he managed to threat the borders of the house not to call the police. This
action is a proof that he knows the consequences of his acts when he killed Aling Kikay.
In the INSTANT CASE, THE TRIAL COURT CORRECTLY CHARACTERIZED THE KILLING AS
MURDER.
