Dear Chief Pickwith:

Your statement regarding the matter originated on February 19, 2010, that "No further
investigation will be conducted in the matter," is likely to be deemed by any reasonable person
as false and deliberately misleading, since no investigation had ever been conducted in the
case.

To start out, no CR# was ever issued, and Lt Garcia refused to take an application for a
California crime report in the matter, regardless of the facts, the essence of which was detailed
in the email notice, copied below.

Conduct of the La Verne Police Department in this and related matters, previously detailed,
would surely be viewed by any reasonable person as disregard of the legal mandate for
Honest Services.

Thank you for what may be a helpful response re: Case 2010-0584, copied below.

Perhaps you would also reconsider the conduct of LVPD on related events that took place on
February 19, 2010. The same individual named as "leads" in case 2010-0584, together with an
armed man named Javier were involved in events that took place on February 19, 2010.

The matter was brought to your attention in notice dated February 23, 2010, copied below.
However, I have no response by you on file. Possessions that were robbed at gun point on the
parking lot of 1825 Foothill Blvd, La Verne, on February 19, 2010, including my wallet, credit
cards, California ID, keys to my car and other keys, and a pricey watch, were never returned to
this date.

Your response on the matter, issuance of a DR# and a California Crime Report on events that
took place on February 19, 2010 on the parking lot at 1825 Foothill Blvd, La Verne, would be
appreciated, as part of what should be expected under honest services by law enforcement.

Sequence of Events

1) On February 6, 2010, Dr Zernik was stopped by Officer McKindley of La Verne


Police, and was informed that two warrants for his arrest were outstanding.

2) In Booking records Officer McKindley likewise listed two warrats, one from a
Beverly Hills Court, with bond of $30,000, the other from a Burbank Court, with bond
of $5,000, both for violation of the vehicle code.

3) Officer McKindley denied access to the executed warrants, to inspect and to copy,
and likewise, La Verne Police denied all later requests to access to the warrants, to
inspect and to copy, in disregard of the California Public Records Act.

4) On Sunday, February 7, 2010, Dr Zernik called Erika Higgins, Bond Services, and
asked to issue bond for $35,000. Erika checked the Los Angeles Sheriff's online
Inmate Information Center, and confirmed that the bond would have to be for $35,000.

5) On Sunday, February 7, 2010, Erika in formed Dr Zernik that his file was "updated"
and that the bond was "reduced" to $30,000.

6) Dr Zernik was alarmed, since it appeared as potentially deceitful manipulation of


the records, allowing a warrant that was purported to have been executed to remain
outstanding, requiring him to post bond of $30,000, but at the same time, leaving him
subject to another arrest at any time. Therefore, Dr Zernik stipulated with Erika
Higgins by phone that he would pay an initial payment by cash, and that Erika Higgins
would provide the paperwork to support the legal foundation of the arrest and bail, and
in particular the "bond reduction". After such paperwork was supplied, Dr Zernik was
to pay the balance. Erika Higgins promised to provide the paperwork immediately
upon release.

7) Erika Higgins never provided that paperwork upon release on February 7, 2010,
but promised to fax or email it first thing in the morning on February 8, 2010.
However, to this date, Erika Higgins never provided the paperwork to support the legal
foundation of the arrest, bail, and "bond reduction". Therefore, by Saturday, February
13, 2010, Dr Zernik place stop payment on his payment check.

8) On Sunday, February 7, 2010, in the evening, and all further times, the Sheriff's

online Inmate Information Center listed the Burbank Warrant as issued by the
Burbank Municipal Court, which no longer existed for almost a decade. The system
also listed the bond at $0.00. The false listing of bond at $0.00 was a common
feature of the system, and subject of a previous complaint to the Los Angeles
Ombudsman, alleging corruption of bond/bail services, and likely large-scale
embezzlement of public funds.

9) On Tuesday, February 16, 2010, Dr Zernik attempted to access his court file in
Beverly Hills, access was denied, in disregard of First Amendment rights.

10) On Tuesday, February 16, 2010, Dr Zernik attempted to access his court file in
Burbank. No valid warrant was found in the file. However, the manager of the Clerk's
Office advised Dr Zernik that a warrant for his arrest was outstanding, and was never
executed.

11) On Wednesday, February 17, 2010, in the afternoon/evening, Dr Zernik's car tires
were punctured at his parking place - Monte Vista Apartments, 1825 La Verne,
California. Dr Zernik was subjected to violent attack on his residence, where an
unknown person threaten to break the door in, and he received a threatening fax from
Erika Higgins, Richard Rodriguez, and Javier.

12) On Thursday, February 18, 2010, Dr Zernik called the La Verne Police
Department and requested to file an application for a California Crime Report
regarding the puncturing of his tires and the attack on his door. Application DR#2010-
0584 was taken by Officer Matt Hadan. Dr Zernik provided the names of Erika
Higgins, Richard Rodriguez, and Javier as suspect, with their phone numbers. One of
the officers who accompanied Officer Matt Hadan called Richard Rodriguez, and then
informed Dr Zernik that Rodriguez was a "retired bounty hunter", that the conduct that
Dr Zernik was subjected to was merely "business transactions", and that Dr Zernik
was supposed to open the door under the violent attack the previous night. Dr Zernik
informed the officer that he was not in the habit of opening his door to uninvited,
unidentified violent intruders. Officer Matt Hadan advised Dr Zernik to call police if
such conduct recurred.

13) On Thursday, February 18, 2010, Dr Zernik explained to Officer Hadan the
problem with Erika Higgins, surrendered, and requested to be arrested by La Verne
Police. Officer Matt Hadan refused to arrest Dr Zernik. Dr Zernik also informed Erika
Higgins in writing of his surrender to La Verne Police, and refusal of La Verne Police
to arrest him.

14) On Thursday evening, Dr Zernik fixed his car at a cost of about $800.00.

15) On Friday, February 19, 2010, Dr Zernik appeared in the Burbank Court and
resolved any matter pending there. At that time, no valid warrant was found on file, but
a printout listed a previous warrant was "recalled" - not executed.

16) On Friday, February 19, 2010, around noontime, upon returning home, Dr Zernik
was held at gun point by Richard Rodriguez and Javier, dressed in a black ninja outfit,
and armed with a Beretta, and a shortened barrel M.A.C. 56 rifle.

17) On Friday, February 19, 2010, around noontime, at his parking in Monte Vista
Apartments, 1825 Foothill Blvd., Dr Zernik was held by Richard Rodriguez and Javier,
at gun point. Dr Zernik was also robbed at gun point of his wallet, his California ID, his
credit cards and other records in his wallet, and his home and car keys.

18) On Friday, February 19, 2010, around noontime, Richard Rodriguez and Javier
handcuffed Dr Zernik and held him handcuffed for the next eight hours.

19) On Friday, February 19, 2010, Richard Rodriguez informed Dr Zernik that he was

going to surrender Dr Zernik to LA Sheriff, for refusal to pay the bond fees, and that
they were going to transport him to Twin Towers jail in Los Angeles.

20) On Friday, February 19, 2010, from La Verne, Richard Rodriguez and Javier did
not transport Dr Zernik to Twin Towers jail. Instead, they transported him to a location
in Southgate, California, and while handcuffed, attempted to extract moneys from him.
Dr Zernik refused to pay any moneys whatsoever.

21) Around 4:00 pm 2010, Richard Rodriguez instructed Javier to transport Dr Zernik
to Twin Towers jail. Javier was uninformed regarding the address or driving direction
to the jail, and Dr Zernik, upon noticing that he was driving in wrong direction, on 10
freeway, heading west past Culver City, had to argue with Javier every turn of the
way, directing him back to Twin Towers jail.

22) Upon arriving at Twin Towers jail Javier had obvious problems in completing the
required paperwork. Eventually it turned out that he had no license/authority to
conduct an arrest. Although the Sheriff's Department took his papers and issued a
booking number time 16:53pm, the Sheriff's Department refused to accept Dr Zernik
into custody from Javier.

23) On its online Inmate Information Center, the Sheriff's Department falsely listed the
arrest as:

24) Upon rejection of the unlawful arrest by Javier, Javier called Richard and asked
Richard to come over to Twin Towers and complete the surrender. As it turned out,
Richard had no license/certificate/authority to conduct such arrest either, and
therefore, Richard refused to come to Twin Towers.

25) Javier then transported Dr Zernik back to the Southgate location, still handcuffed.
Again, attempt was made to extort moneys from Dr Zernik, and again, Dr Zernik
refused to yield to armed extortion.

26) On Friday, February 19, 2010, around 6:00pm, Richard Rodriguez finally called
and hired a person identified as "Dave", who introduced himself as a "private
investigator" to execute the surrender. Dave and his companion, Albert, then
transported Dr Zernik to Twin Tower again, arriving there around 8:00pm.

27) On Friday, February 19, 2010, around 8:00pm, upon entering custody by LA
Sheriff''s Department, Dr Zernik still had in his possession a Braun brand tungsten
wrist watch, replacement value about $500.00. The Unnamed Sheriff Deputy who
accepted Dr Zernik into custody removed the watch from Dr Zernik's possession and
passed it on to Dave.

28) Less than a minute later, the same Sheriff Deputy demanded that Dr Zernik sign
that he entered sheriff's custody with no possession at all except for his clothing. Dr
Zernik refused to sign the form, part of the sheriff's standard records.

29) The Unnamed Sheriff's Deputy then violently pushed Dr Zernik into a solitary
confinement cell, where Dr Zernik was handcuffed to a 2-3 feet chain on the floor, and
where he was left barefoot, insufficiently dressed at the prevalent temperature of
about 65 F. Log of the solitary confinement was created, posted outside the door, and
Sheriff Deputies signed it every 30 minutes or so.

30) Dr Zernik was left in the solitary confinement cell for about 4 hours. Two times
during that period, Sheriff's Deputies entered the cell, and tried to extort his signature
on the possessions form, calling him "asshole", and yelling at him for his refusal to "go

along with the program". One of the deputies also threatened to "split your head open"
with his flashlight/club. The Deputies also refused to allow Dr Zernik to urinate in the
toilet provided in the solitary confinement cell. Therefore, at around 11:00-12:00
midnight Dr Zernik finally urinated on the floor of the cell.

31) Around midnight, Dr Zernik was finally violently removed from the solitary
confinement cell, and a his "reception" process was continued.

32) Booking time was falsely listed in the online Inmate Information Center as:

33) On Monday, February 22, 2010, Dr Zernik was transported to Beverly Hills Court,
where he resolved his outstanding matter. Upon review and repeat review of the court
file at that time, no valid warrant was found in the court file. No record of execution of
a warrant by the La Verne Police was found either.

34) On Monday, February 22, 2010, around 4:30pm, Dr Zernik was released by the
Beverly Hills Sheriff's Deputy.

35) On Tuesday AM, February 23, 2010, Dr Zernik called the La Verne Police
Department and requested to filed an application for a California Crime Report, for
armed abduction, armed robbery, armed extortion, and false arrest by Erika Higgins,
Richard Rodriguez, and Javier, and collusion by Dave in the false arrest and armed
robbery. La Verne Police was provided with phone numbers:

Erika Higgins: Cell: 323.564.5000; Office: 323.350.6493

Richard Rodriguez: 562.833.2149

36) La Verne Police was also requested to facilitate the return of robbed possessions.

The Notification states:

An investigation has been conducted and all available leads have been exhausted.
Therefore, the case will be placed in an inactive status unless or until additional

leads are obtained.

For you information, on the date of filing the complaint I furnished Officer Hadan with the
names of the leads, who issued threats before. They were:

(562) 833-2149

However, Officer Hadan refused to take the names of the leads upon filing the complaint.

Therefore, upon review of conduct of the La Verne Police Department as a whole, a reasonable
person is likely to conclude that the February 23, 2010 Case Notification, like previous records
- is false and deliberately misleading.

Please also consider this letter as "additional leads" for the purpose of re-activating the
investigation in the case.
