Article 4. Table 4 Density, Intensity and Parking - T6 - Urban Core Zone - Open
Parking ratio may be reduced within mile radius of TOD or within mile radius of a Transit Corridor by
thirty percent (30%) by process of Waiver, except when T6 is within 500 feet of T3.
Notes
The proposed design is situated on a site that allows for and promotes the use of public transit by its users.
Therefore, a waiver for reduction of 30% in required parking due to proximity of 857 feet to Metromover is requested
(1/2 mile / 2,640 feet).
7.1.2.5 Waiver
28. As appropriate to the nature of the Waiver involved and the particular circumstances of the case,
Waivers up to ten percent (10%) of any particular standard of this Code except Density, Intensity and
Height, may be granted when doing so promotes the intent of the particular Transect Zone where the
proposal is located; is consistent with the guiding principles of this Code; and there is practical difficulty in
otherwise meeting the standards of the Transect Zone,
or when doing so promotes energy conservation and Building sustainability. The inability to achieve
maximum Density, Height, or floor plate for the Transect shall not be considered grounds for the granting of
a Waiver. This Waiver cannot be combined with any other specified Waiver of the same standard.
The proposed design accommodates the intent of the code by providing a distance of 54'-0" between the proposed
new building and the existing adjacent building. This allows for the availability of light and air for both uses.
Therefore, a waiver is requested to allow the distance between the buildings to be 54'-0" in lieu of the required
minimum 60'-0".
7.1.2.5 Waiver
28. As appropriate to the nature of the Waiver involved and the particular circumstances of the case,
Waivers up to ten percent (10%) of any particular standard of this Code except Density, Intensity and
Height, may be granted when doing so promotes the intent of the particular Transect Zone where the
proposal is located; is consistent with the guiding principles of this Code; and there is practical difficulty in
otherwise meeting the standards of the Transect Zone,
or when doing so promotes energy conservation and Building sustainability. The inability to achieve
maximum Density, Height, or floor plate for the Transect shall not be considered grounds for the granting of
a Waiver. This Waiver cannot be combined with any other specified Waiver of the same standard.
The proposed design accommodates the intent of the code by providing a setback of 27 feet from the new proposed
tower to the property line to the North. The side setback required is 30 feet. However, providing more separation
between the two towers on site will allow for better views and access to light and air for both. Therefore, a waiver is
requested to allow the side setback at the North property line to be 27'-0" in lieu of the required 30'-0".
7.1.2.5 Waiver
28. As appropriate to the nature of the Waiver involved and the particular circumstances of the case,
Waivers up to ten percent (10%) of any particular standard of this Code except Density, Intensity and
Height, may be granted when doing so promotes the intent of the particular Transect Zone where the
proposal is located; is consistent with the guiding principles of this Code; and there is practical difficulty in
otherwise meeting the standards of the Transect Zone,
or when doing so promotes energy conservation and Building sustainability. The inability to achieve
maximum Density, Height, or floor plate for the Transect shall not be considered grounds for the granting of
a Waiver. This Waiver cannot be combined with any other specified Waiver of the same standard.
The proposed design accommodates the intent of the code by providing a floorplate that is well under the maximum
allowed 18,000 sf of area. Additionally, the floorplate has a wedge design that allows for more access to views of the
bay from the city. However, to achieve a minimum feasible floor plate area for the design, a length of 198'-0" is
proposed for the new building. Therefore, a waiver is requested to allow the floorplate to be 198 feet long.
7.1.2.5 Waiver
28. As appropriate to the nature of the Waiver involved and the particular circumstances of the case,
Waivers up to ten percent (10%) of any particular standard of this Code except Density, Intensity and
Height, may be granted when doing so promotes the intent of the particular Transect Zone where the
proposal is located; is consistent with the guiding principles of this Code; and there is practical difficulty in
otherwise meeting the standards of the Transect Zone,
or when doing so promotes energy conservation and Building sustainability. The inability to achieve
maximum Density, Height, or floor plate for the Transect shall not be considered grounds for the granting of
a Waiver. This Waiver cannot be combined with any other specified Waiver of the same standard.
The proposed design accommodates the intent of the code by providing 65% Frontage at front Setback. The
required Frontage percentage is 70%. However, by including the two vehicle entry/exits to the site from the Principal
Frontage (Brickell Bay Dr), this reduced the amount of allowable area for retail storefront. Therefore a waiver is
requested to allow the Frontage at front Setback to be 63% in lieu of 70%.
