TOPIC: Health Information Privacy and Data Security

INTRODUCTION:
In light of Australia's progressive strides in digitizing its healthcare
landscape, the protection of health information privacy and data security emerges as
a pivotal concern. This position paper endeavors to address this critical issue,
navigating the intricate intersection between technological advancements and the
safeguarding of sensitive health data. Offering a contextual overview of Australia's
healthcare system, the paper examines the existing legal and regulatory framework,
scrutinizes the risks associated with technological progress, and analyzes diverse
stakeholder perspectives. Ultimately, the goal is to provide actionable
recommendations that strike a balance between fostering healthcare innovation and
ensuring robust health information privacy and data security in Australia.

INSTANCES OF CONCERN:

1) March 2021 Eastern Health

 A massive breach Eastern Health an operator of 4 Melbourne hospitals, fell victim to a


cyberattack causing certain elective surgeries to be postponed.

 The nature of cyberattack is unknown, but its suspected to have been a ransomeware
attack. This is likely to be true since, according to the Australian Cyber Security Centre
(ACSC), ransomeware attacks targeting the Australian health sector are growing.

 Eastern Health assured the public that no patient data was compromised in the
attack.

2) February 2019 Melbourne Hearth Group


 Melbourne Heart Group, a specialist cardiology unit in Cabrini Hospital, fell victim to a
ransomware attack impacting 15,000 patient files.

 Ransomware attacks are still classified as data breaches because cybercriminals


access sensitive data and hold it hostage unless a ransom price is paid. This data
breach compromised personal patient details and medical data, exposing victims to
potential phishing attacks and identity theft.

 Melbourne Heart Group was locked of it its compromised data for almost 3 weeks.

 A spokesperson for the cardiology unit said that no sensitive data was leaked while it
was in possession of the cybercriminals.

 But such a claim assumes ransomware criminals are true to their promise that
damages will be completely reversed if demands are obeyed

 Melbourne Heart Group, reportedly, paid the bitcoin ransom.

MEASURES TAKEN BY FRANCE: To address these concerns, Australia


has always taken significant steps to enhance data privacy and security:
 Legal Framework: Strengthen Australia's health privacy laws to align with
international standards, emphasizing GDPR principles.
 Consent Mechanisms: Enhance procedures for obtaining informed
consent, ensuring individuals have meaningful control over their health
data.
 Security Standards: Enforce robust security measures, including
encryption and regular audits, to protect health information from cyber
threats.

STRATEGIES FOR INTERNATIONAL COOPERATION: Australia


proposes the following strategies for international cooperation in addressing health
information privacy and data security:
 Establish and promote Global Standards and Guidelines
 Information Sharing Protocols During Emergencies
 Employee Training and Awareness
