CL 2025 | SECTION 1
CYBER CRIME INVESTIGATION
CASE SCENARIO # 2
1. Assuming that this occurred in the Philippines, what cybercrime(s) were
committed? Why do you believe that? Give an explanation and cite the exact
laws violated.
The cybercrimes committed in this scenario could include:
Cyberbullying and Online Harassment: The online attacks, harassment, verbal
abuse, and threats directed at Kim Soo Hyun and Kim Ji Won constitute
cyberbullying and online harassment under the Philippine Cybercrime Prevention Act
of 2012 (Republic Act No. 10175). The law prohibits acts of cyberbullying, defined as
the use of information and communication technology to intimidate, harass, or cause
harm to others.
Defamation: The spread of false and damaging information questioning the honesty
and integrity of Hyun and Won, along with their family members, constitutes
defamation. Defamation through electronic means is covered under the Philippine
Cybercrime Prevention Act of 2012, particularly in its provisions on libel and cyber
libel.
Under Philippine laws, these cybercrimes can be cited as follows:
a. Republic Act No. 10175 or the Cybercrime Prevention Act of 2012: This law covers
cyberbullying, online defamation, and hate crimes committed through information
and communication technologies.
b. Republic Act No. 10173 or the Data Privacy Act of 2012: This law may apply in
cases of identity theft, as it protects the privacy rights of individuals and regulates the
processing of personal data.
c. Republic Act No. 9262 or the Anti-Violence Against Women and Their Children Act
of 2004: This law may be applicable if the cybercrimes committed resulted in
physical or psychological harm to women and their children, including Kim Ji Won
and her family.

2. What pieces of digital evidence you will need to investigate the cybercrimes
committed if any? Explain the importance of each evidence.
To investigate the cybercrimes committed in this scenario, several pieces of
digital evidence would be crucial. These pieces of evidence help establish the
facts, identify the perpetrators, and understand the motives behind the online
harassment and defamation of Kim Soo Hyun and Kim Ji Won. The importance of
each evidence is explained below:
 Online Posts and Messages: Copies of the online posts, messages,
comments, and threats made against Hyun and Won would serve as
crucial digital evidence.
 IP Addresses and User Data: Identifying the IP addresses and user data
associated with the accounts responsible for the cyberbullying and
defamation would aid in tracing the perpetrators.
 Digital Forensic Analysis: Analysis of digital footprints, metadata, and
timestamps on the defamatory content can provide insights into the origin
and dissemination of false information.
3. Would your answers to the above questions change if you were in a different
country? Please justify your explanation.

The answers to the questions related to safeguards against cybercrimes and the
situation faced by Kim Soo Hyun and Kim Ji Won might change if we were in a
different country. The specific cybercrime laws and legal frameworks vary from
country to country. In the Philippines, cyberbullying and defamation are explicitly
addressed under the Cybercrime Prevention Act. However, in different countries, the
legal definitions and penalties for these offenses may differ. Therefore, the
application of laws and procedures in investigating and prosecuting cybercrimes
would vary depending on the jurisdiction.

The reasons for potential changes are as follows:

a. Legal Frameworks: Different countries have varying legal frameworks and

data protection laws that may impact the implementation of safeguards
against cybercrimes. For example, in the European Union, the General Data
Protection Regulation (GDPR) imposes strict requirements on data
processing and privacy, which may influence the way organizations handle
sensitive information and respond to cyber incidents.
b. Cultural Differences: Cultural differences across countries can affect the way
people react to situations like the one faced by Hyun and Won. In some
cultures, privacy and personal space might be valued more, leading to less
public scrutiny and harassment of individuals in similar circumstances.
c. Media Landscape: The media landscape can also vary significantly across
countries, which may impact how such incidents are reported and the level of
public attention they receive. In some countries, the media might be more
responsible and fact-checking oriented, while in others, sensationalism and
speculation may dominate the news.
4. Create a conceptual framework diagram based on the cybercrime(s) you
identified on the case study/scenario and their iinter-relationship with one
another if more than one cybercrime was identified. Explain your conceptual
framework minimum of 300 words.
The following is the conceptual framework diagram, which is based on the
cybercrimes found in the case study of Kim Soo Hyun and Kim Ji Won:
Cyberbullying and Online Harassment: Hyun and Won experienced verbal abuse,
physical harm, threats to their public personas, and social exclusion online. Their
families were also subjected to intimidation, including accusations of infidelity and
defamation.
Spread of False Information: The cybercriminals propagated false information
characterizing Hyun and Won as dishonest while ignoring proof of their genuine
qualifications, which included degrees from Harvard University. As a result, the
public began to perceive them as being dishonest and unreliable.
Threats and Endangerment: Hyun and Won were the targets of death threats
because of the cybercrimes that got worse. They had to deal with social isolation and
fear for their safety because their safety was in jeopardy both online and offline.
Lack of Media Fact-Checking: Without thoroughly verifying their reporting, South
Korean media outlets repeated the accusations, spreading misinformation and
making Hyun and Won's harassment worse.
An important finding of this case study is how these cybercrimes are related to one
another. Cyberbullying and harassment of Hyun and Won resulted from the
dissemination of false information by online attackers, making them more susceptible
to threats and danger. By promoting the unfounded allegations and cultivating a
hostile atmosphere for the couple, the absence of fact-checking in the media made
matters worse.
Ultimately, the conceptual framework shows how a toxic cyber environment that can
have real-life repercussions for victims is created by a confluence of factors such as
threats, false information spreading, online harassment, and absence of media
accountability. In order to effectively address these cybercrimes, it emphasizes how
interconnected they are and the necessity for comprehensive solutions.
5. Recommend the appropriate safeguards against the type of cybercrime you
identified to a) prevent being victimized and b) investigate the cybercrime
properly.
People should take the following precautions to avoid becoming victims of
cybercrime, particularly attacks on their credentials and reputation:
Be safe when using the internet by creating strong, one-of-a-kind passwords for
all of your accounts and, if possible, turning on two-factor authentication.
Keep an eye on online activity: Frequently check social media pages, search
engine results pages, and online discussion boards for any disinformation that
might be spreading. Become knowledgeable: Keep up with the latest tactics and
common online frauds employed by cybercriminals to fend off potential assaults.
Verify information: Examine any accusations made against you again, and obtain
proof to disprove any untrue allegations. Law enforcement and individuals can
take the following actions to properly investigate cybercrime: To report a crime,
get in touch with the appropriate authorities, like the police or cybercrime units.
