1 Brief description Tender of rates to procure commonly used solar and related
equipments in Kuno Wildlife Division
2 NIT No.
5 Bid Offer Validity 365 days from the date of issuing of work order to successful bidder
by Divisional Forest Officer Kuno Wildlife Division.
6 Performance Security Amount and duration shall be determined during issuance of work
order(s) through the contract period.
1. The Bid offer Validity shall be of 365 days calculated from the date of issue of work
order or formal intimation of award of bid whichever earlier. The work order /
intimation shall be issued by the Divisional Forest Officer Kuno Wildlife Division.
2. The Bid Offer Validity / Contract duration may be increased by 90 days subject to mutual
agreement between the successful bidder and Divisional Forest Officer Kuno Wildlife
Division.
3. The Divisional Forest Officer Kuno Wildlife Division (Client) may terminate the Request
for Proposal (RFP) process at any time and without assigning any reason. The Client
makes no commitments, express or implied, that this process shall result in a business
transaction with anyone. This RFP does not constitute an offer by Client. The bidder's
participation in this process may result in the Client selecting the bidder to engage in
further discussions and negotiations toward execution of a contract. The
commencement of such negotiations does not, however, signify a commitment by the
Client to execute a contract or to continue negotiations. The Client may terminate
negotiations at any time without assigning any reason.
4. The Earnest Money Deposit (EMD), Tender Fee/ Cost of Tender Document and
Processing Fee shall be submitted online on e-procurement portal. Offline submission
shall not be considered.
5. Scanned copy of receipt of successful EMD submission should be included along with
the bid.
6. Unsuccessful Bidders' EMD shall be discharged/returned as promptly as possible.
7. The EMD may be forfeited:
If a Bidder withdraws their bid or increases their quoted prices during the period of
bid validity or its extended period, if any; or
During the bid process, if a Bidder indulges in any such deliberate act as would
jeopardize or unnecessarily delay the process of bid evaluation and finalization; or
In case of a successful bidder, if the Bidder fails to submit Performance Security within
15 days of issue of work order by Divisional Forest Officer Kuno Wildlife Division,
Sheopur; or
During the bid process if any information is found wrong / manipulated / hidden in the
bid.
8. The decision of Division Forest Officer Kuno Wildlife Division, Sheopur regarding
forfeiture of the EMD and rejection of bid shall be final & shall not be called upon
question under any circumstances.
9. Complete bidding process shall be online through the Portal in a three cover system. All
the notification & details terms and conditions regarding, this tender notice hereafter
shall be published online on web site.

25. The Client shall have the right to invoke and appropriate the proceeds of the
Performance Security in whole or in part, without notice to the successful bidder in the
event of breach of this Contract or for recovery of any penalty as may be applicable in
terms of this Contract. For the avoidance of doubt, the parties hereto expressly agree
that in the event of any default requiring the appropriation of any amounts comprising
the Performance Security, the Client may make deductions from any subsequent
payments due and payable to the successful bidder hereunder, as if it is appropriating
the Performance Security in accordance with the provisions of this Contract. The
reasons for invoking the Performance Security include, but not limited to, below
conditions:
i. Bidder is not able to deliver the material.
ii. The bidder or his employee is involved in any unlawful activity during its
engagement with Client.
iii. If the Bidder is non-responsive to the requirements raised by Client or their
representative for consecutive three times.
iv. Bidder does not settle dues in a timely manner.
27. The Divisional Forest Officer, Kuno Wildlife Division, Sheopur may, without prejudice
to any other remedy under this Contract and applicable law, reserves the right to
terminate for breach of contract by providing a written notice of 30 days stating the
reason for default to the successful bidder and as it deems fit, terminate the contract
either in whole or in part.
28. The contract shall be governed by the laws and procedures prescribed by the Laws
prevailing and in force in India, within the framework of applicable legislation and
enactment made from time to time concerning such commercial dealings/processing.
All legal disputes are subject to the jurisdiction of Madhya Pradesh courts only.
29. The Bid Price shall be inclusive of cost involved in loading, transportation, unloading
stacking (if required) and installation. Bidders shall be liable for transportation and
installation to the entire geographical extent of Kuno Wildlife Division.
30. Warranty period of the supplied products along with their components shall be 1 years
from the date of final acceptance of goods or after completion of installation,
commissioning & testing of goods (if included in the scope of supply), at consignee
location. In case of items having explicit minimum warranty period duration mentioned
in technical specifications contained in Annexure - 4, the explicit warranty period shall
prevail over the general warranty period mentioned in this clause. OEM Warranty
certificates must be submitted by the Successful Bidder at the time of delivery of Goods.
The seller should guarantee the rectification of goods in case of any breakdown during
the guarantee period.
31. Timely Servicing / rectification of defects during warranty period: After having been
notified of the defects / service requirement during warranty period, Seller has to
complete the required Service / Rectification within 7 days time limit. If the Seller fails
to complete service / rectification within a defined time limit, a penalty of 0.5% of Unit
Price of the product shall be charged as penalty for each week of delay from the seller.
Seller can deposit the penalty with the Buyer directly else the Buyer shall have a right
to recover all such penalty amount from the Performance Security (PBG).Cumulative
Penalty cannot exceed more than 10% of the total contract value after which the Buyer
shall have the right to get the service / rectification done from alternate sources at the
risk and cost of the Seller besides forfeiture of PBG. Seller shall be liable to reimburse
the cost of such service / rectification to the Buyer.
32. In case of AC/Solar Submersible pumps, while quoting the rate, bidders must provision
for length of HDPE pipes, AC/DC Cables , hoisting Ropes to be sufficiently long to
account for maximum shut-off head. Bidders must keep provision for the maximum
possible number of stages and solar wattage, which is readily available in the open
market for each category of pumps.
33. All prospective bidders are required to visit the area under Kuno Wildlife Division and
familiarize themselves with the working conditions. A certificate (Annexure - 3) in this
regard needs to be filled by the bidder and countersigned by the respective range
officer. Completed certificate to be uploaded along with the bid documents.
34. Bid shall be awarded to the firm quoting the lowest rate. If it so happens that lowest
rates obtained for different BOQ items are from different firms, the work order(s) shall
be issued to those respective firm(s) which have respective lowest rates for the said
items.
35. Bidders are required to upload the following documents along with their bid :-
37. The Bidder should have regularly supplied the same, or similar Category Products to any
Central / State Govt Organization / PSU for the past 12 months (calculated from Bid End
Date). Copies of relevant contracts to be submitted along with the bid in support of
having supplied some quantity during the past 12 months.
39. To ensure safety and quality of work, supervision needs to be carried out by a
government certified supervisor authorised to work in any or all of the states/ union
territories across India. Relevant Government issued Certificate to be uploaded along
with the bid.
40. BOQ Items must conform to serial number wise technical specifications as mentioned
in Annexure - 4 of this tender document.
41. Divisional Forest Officer Kuno Wildlife Division or any officer authorised by them may
at random choose any sample of BOQ items supplied and have it tested in a
laboratory. If the quality of items is found to be sub-par, performance security may be
confiscated and the supplier shall be blacklisted.
42. Bidder's offer is liable to be rejected if they don't upload any of the certificates /
documents sought in the Bid document, Terms & Conditions and Corrigendum if any.
43. Power to make decisions regarding provisions which are not accounted for in this
tender notice or work order issued shall lie with the Divisional Forest Officer Kuno
Wildlife Division.
