“AN ORDINANCE INSTITUTIONALIZING, PROMOTING, AND DEVELOPING
ORGANIC AGRICULTURE IN THE MUNICIPALITY OF SULTAN DUMALONDONG”

WHEREAS, Republic Act 10068 otherwise known as the “Organic Agriculture
Act of 2010” is in recognition of and pursuit of the policy of the state to promote,
propagate, develop further, and implement the practice of organic agriculture in the
Philippines that will cumulatively condition and enrich the fertility of the soil, increase
farm productivity, reduce pollution and destruction of the environment, prevent the
depletion of natural resources, further protect the health of farmers, consumers, and the
general public, and save on imported farm inputs;
WHEREAS, sustainable food security entails producing and consuming food in a
manner that conserves the regenerative capacity of the natural resource-based and
maintains biodiversity for present and future generations;
WHEREAS, Rule 14.4 of the RA 10068 Implementing Rules and Regulations
states that the Local Government Units as the front liners in the implementation of the

program shall pass appropriate ordinances and/or resolutions, thereby specifying the
participatory and bottom-up approach to grass root organic agriculture programs and
projects;
WHEREAS, organic farming will cumulatively condition and enrich the fertility of
the soil, increase farm productivity, reduce pollution and destruction of the environment,
prevent the depletion of natural resources, further protect the health of farmers,
consumers, and the general public, and save program for the promotion of community-
based organic agriculture systems;
WHEREAS, Section 14 of the R.A. No. 9729 otherwise known as the “Climate
Change Act of 2009” provides that the LGUs shall be the frontline agencies in the
formulation, planning, and implementation of the Local Climate Change Action Plans in
their respective areas, consistent with the provisions of Local Government Code, the
Framework, and the National Climate Change Action Plan;
WHEREAS, organic agriculture reduces non-renewable energy use by decreasing
agrochemical needs, organic agriculture contributes to mitigating the greenhouse effect
and global warming through its ability to sequester carbon in the soil;
WHEREAS, the impact of organic agriculture on natural resources favours
interactions within the agro-ecosystem that are vital for both agricultural production and
nature conservation.
NOW, THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED BY THE
SANGGUNIANG BAYAN OF SULTAN DUMALONDONG, LANAO DEL SUR, BY THE
VIRTUE OF POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED; THAT:
Section 1. Short Title. This Ordinance shall be called “Organic Agriculture
Ordinance of Sultan Dumalondong, Lanao del Sur”.
Section 2. Scope and Coverage. This shall be applicable to all persons, natural or
judicial, residents within the territorial jurisdiction in the Municipality of Sultan
Dumalondong.
Section 3. Definition of Terms. In this Ordinance, the following terms shall
mean:
a) Bio-pesticides –are naturally occurring substances and microorganisms that control pests.

b) Buffer Zones - are defined areas on the boundary of an organic farm that has land use
controls and allows only activities compatible with the protection of the organic farm. It
serves as a barrier that surrounds or separates an organic farm from other traditional or
conventional farms where plants are not designated as organic. The area of the buffer
zones shall be determined in the
Implementing Rules and Regulations depending on the total situation on the ground.

c) Consumer Groups- are organized consumer group patronizing and advocating organic
products.

d) Conversion- is the process of transforming a traditional or conventional farm into an


organic farm for a period of three (3) to five (5) years.

e) Food Security- is the ability of the individual, household and community to produce
and/or access/acquire appropriate, abundant, nutritious and safe food on a regular basis
using socially
acceptable means.

f) Organic Agriculture- is a production system that sustains the health of soils, ecosystems,
and people. It relies on ecological processes, biodiversity, and cycles adapted to local
conditions, rather that the use of inputs with adverse effects. Organic agriculture
combines tradition, innovation and science to benefit the shared environment and
promote fair relationships and good quality of life for all involved (IFOAM).

Section 4. Regulation. Every farmer in the municipality is encouraged to practice


the organic farming method.
Section 5. Organic Agriculture Zones. For the effective implementation of this
Code, there are hereby set aside agriculture zones that will be protected from
encroachment and
contamination of using chemical-based farm inputs, mining, including contamination of
genetically- engineered crops and other similar activities. These zones shall be organized
according to ecological districts based on existing categories of land tenure instruments
and arrangements such as the ancestral domain, the protected area, and the agrarian
reform communities; the community-based forest management zones, and similar
instruments and arrangements.
These zones shall be set up according to the following minimum criteria:
a) Presence of actual organic agriculture practitioners;
b) Presence of natural or man-made water formations, including areas covered by irrigation
and similar facilities;
c) Identified buffer zone to shield organic agriculture from other land uses that impact the
integrity of the practice if organic agriculture;
d) Areas suited for agricultural production as defined in the Sultan Dumalondong Land Use
Plan. To be submitted to the Sanggunian for approval in an Ordinance.
Section 6. Conservation of Indigenous Farm Practices. Measures shall be
established, by the farming communities, including indigenous people’s communities, to
conserve and protect indigenous knowledge relating to organic agriculture, including

those that relate to seed conservation and propagation and the various ways in which on-
farm and ex-situ mechanisms are established and sustained.
Section 7. Support Service to Organic Farmers. The Municipal Government of
Sultan Dumalondong shall ensure support to organic farmers who wish to engage in
organic agriculture, such as training, production, marketing and branding, including
financial management and accounting, among other necessary skills to develop an
organic agriculture product that will secure a market niche, including the practice of fair
trade.
Support services shall also be primarily extended to small and marginalized
farmers and women’s groups including the promotion, enhancement and fulfilment of
their rights as defined in national laws.
Section 8. Funding. In order to realize the purposes of this ordinance, the
municipal government shall integrate the program into the Annual Investment Plan and
allocate funds to the Annual Budget of the municipality.
Section 9. Organic Farming Day. For the purpose of promoting organic
agriculture/farming, an Organic Agriculture/ Farming Day shall be held every January
21st of the year.
Section 10. Repealing Clause- all previous ordinances, rules, and, regulations or
parts that are inconsistent with this ordinance are hereby repealed and modified
accordingly.
Section 11. Separability Clause- if, for any reason or reasons, any part or
provisions of this ordinance shall be held unconstitutional or invalid, other parts or
provisions hereof which are not affected thereby, shall continue to be in full force and in
effect.
Section 12. Effectivity- this Ordinance shall take effect immediately after the
required posting and publication is satisfied.
APPROVED, on motion of Hon. ANSARY M. KURANGKING and unanimously
seconded by other Sangguniang Bayan members of Sultan Dumalondong, Lanao Del Sur,
in its Inaugural Session held on January 31, 2022.
