(9) Sujeto a estas condiciones, el Transportista será responsable de tas
mercancías durante el tiempo en que estas estén a su cargo o a cargo de su agente.
(10) (a) Excepto cuando el Transportista haya concedido crédito al destinatario
sin el consentimiento por escrito del expedidor, éste garantiza el pago de todos los
cargos debidos por transporte de acuerdo con las nes del Transportista, condiciones

(11) El aviso de llegada de las mercancías se dará con prontitud al destinatario
o a la persona irxjicada en el Conocimiento Aéreo como persona con derecho a ser
notificada. A llegar las mercancias al m.nto de destim la entrega se hará siguiendo las
instrucciones del expedidor. todo ello sujeto a la aceptación de otras instrucciones del
consignatario antes de llegar las mercancías al lugar de destino. Si el destinatario se
negara a tas mercancias o no se le pudiera notificar, se actuará conforme a las
instrucciones del expeódor.
(12) (a) La persona con derecho a la entrega deberá reclamar por escrito al
transportista en (i) de evidente a las mercancias inmediatamente
después del descubrimiento del daño y a lo sum dentro de 14 dias desde la fecha
de recepción de las mismas. (ii) de otros daños a las mercancías. en un plazo
14 días a partir de la recepción de las mismas, (iii) de retraso, en un plazo de 21 dias a
partir de la fecha en que las mercancías fueron puestas a su disposición, (iv) de falta
de entrega de las mercancías, en un de 120 días a partir de la fecha de emisión del
Conocimiento Aéreo. (b) A los efectos del subpárrafo (a) se hará ta reclamación por
escrito al transportista cuyo Conocimiento Aéreo fue empleado o al primer
Transportista. o al último transportista, o al transportista que efectuó el transpone
donde ocurrió la pérdida. daño o Cualquier derecho a indemnización contra el
transportista no se extinguirá a menos que se efectúe en el plazo de dos años desde la
fecha de llegada al punto de destino o desde ta fecha en la cual deberia llegado la
aeronave o desde la fecha en que se suspendió el transporte.
(13) El expedidor cumplirá con todas las leyes aplicables y las normas de los
gobiernos de cualquier pais a. desde, o a través del cual puedan transportarse las
mercancías, incluyendo aquellas relativas a su errtulaie. transporte o entrega, y
deberá proporcionar cualquier información y adjuntar a este Conocimtento Aéreo
tantos documentos como sean necesarios para cumplir con tales leyes y normas. El
transportista no será ante el expedidor por cualquier pérdida o gasto
debidos al no cumplimiento por parte de este de requisitos.
(14) Ningún agente, empleado o representante del Transportista tiene
autoridad para alterar. modificar o renunciar a cualquiera de las disposiciones de este
Contrato.
(15) En caso de que el Transportador ofrezca un seguro. y este acepte. y se
pague la prima registrándose tal hecho en la presente, los bienes
incluidos en esta Guía Aérea son asegurados a través de una póliza abierta por la
suma solicitada e indicada en la presente (limitándose el reintegro al valor de la
mercancía perdida o dañada. siempre y cuando dicho valor no sea superior al valor
asegurado). El seguro esta sujeto a OS términos, condiciones y cobertura (dentro de
los cuales ciertos riesgos estan excluidos) de la pOliza abierta. la cual puede
inspeccionar el interesado en la oficina del Transportador que ofrece el servicio. Los
reclamos amparados por dicha póliza deben reportarse inmediatamente a una oficina
del Transportador.
(16) La total responsabilidad del transportador será limitada a USD 50 por libra
para cargamentos domésticos U.S. (Puerto Rico incluido) 0 9.07 por libra para
cargamentos internacionales. a menos que el valor adicional sea negociado y
aprobado antos dol embarque. Una prima o seguro adicional serán cobrados por
aumento del valor declarado, si son requeridos por el embarcador.
