An
Act
to amend the Provincial Motor Vehicles Ordinance , 1965.
is amend the Motor Vehicles Ordinance , 1965 (XIX of 1965)
It necessary to Provincial for the
purposes of registering and regulating the electric and hybrid vehicles , and for the ancillary
matters .
Be it enacted by Provincial Assembly of the Punjab as follows:
1. Short title and commencement.— ( 1 ) This Act may be cited as the Provincial Motor
Vehicles (Amendment ) Act 2023 .
(2) This Act shall come into force at once .
2. Amendment of section 2 of Ordinance XIX of 1965.- In the Provincial Motor Vehicles

Ordinance , 1965 (XIX of 1965 ) , for brevity referred to as 'the Ordinance ', in section 2 , in clause
(23 ), for the words " mechanically propelled vehicle ", the expression "vehicle propelled
mechanically or electrically either partially or completely , and any hybrid vehicle ," shall be
substituted .
3. Amendment of section 25 of Ordinance XIX of 1965.- In the Ordinance , in section 25:
(a) in subsection ( 1 ) , after the word “prescribed ” , the words “ documents and " shall
be added ; and
(b) in subsection (1 ) , for the full stop at the end , a colon shall be substituted and
thereafter the following proviso shall be inserted :
" provided that application may also be submitted through the motor
vehicle transaction licensee licensed under the Punjab Motor Vehicle Transaction
Licensees Act 2015 (XXVII of 2015) .".

4. Amendment of section 30 of Ordinance XIX of 1965.- In the Ordinance , in section
30 , for subsection ( 1 ) , the following shall be substituted :
* (1 )
If a motor vehicle not required to be registered in the Province under section 29
is kept in that Province , the owner may apply to the registering authority concerned for
new registration mark by submitting the existing certificate of registration and the
number plates containing the registration mark issued by the previous registering
authority.".
5. Amendment of section 32 of Ordinance XIX of 1965.– In the Ordinance , in section
32 , after subsection ( 1d ) , following subsections ( 1e ) and ( 1f) shall be added :
"( 1e ) A registering authority may , on its own motion or on the application of any
person , after giving the transferor and transferee an opportunity of making
representation , and for reasons to be recorded in writing , pass an order for cancellation
of transfer of a motor vehicle made under subsection ( 1 ) in case such transfer has been
made on the basis of false documents or information .
( 1f) The registering authority passing an order for cancellation of transfer of a
motor vehicle under subsection ( 1e ) shall communicate such order to the original
registering authority . ".
6. Amendment of section 34 of Ordinance XIX of 1965.– In the Ordinance , in section
34 :
(a) in subsection ( 5 ) , for the full stop at the end , a colon shall be substituted and
thereafter the following proviso shall be inserted :
"“provided that any order for cancellation of registration under subsection 5
shall be made in accordance with the procedure laid down in section 35 of this
Ordinance ."; and
(b ) after subsection (6 ) , the following subsection (7) shall be inserted :
* (7)
A motor vehicle shall not be deemed to be validly registered for the
purposes of section 25 of this Ordinance , after passing of a suspension order
under this section and no such vehicle shall be used in any public place until the
order for suspension is rescinded ." .
7. Amendment of First Schedule of Ordinance XIX of 1965.- In the Ordinance , in the
First Schedule , for form F. the following shall be substituted :
