Part-I
Q1 Only Short Answer Type Questions (Answer All-10) (2 x 10)
a) Explain the concepts of unilateral mistake and bilateral mistake with examples for
each.
b) What is consensus ad idem? What happens if it is absent?
c) Discuss the legal effect of a counter offer
d) Can a contract be terminated on the ground of non-fulfillment of one of the major
objectives for which it is entered into? Explain with example
e) Distinguish between general lien and particular lien.
f) Explain perpetual succession of a company.
g) How could you ascertain that a company is a public limited company and not a private
company?
h) If the Company has not mentioned the names of First Directors in its AOA, then who
will be the directors?
i) What is deficiency in service? What are the services considered as covered under
COPRA?
j) What do you mean by hire purchase sale?

Part-II
Q2 Only Focused-Short Answer Type Questions- (Answer Any Eight out of Twelve) (6 x 8)
a) Discuss the legality relating to making an agreement with a boy of 15 years old who
wants to sell a portion of his property
b) It is often said that consideration is the price of a contract. Is it true? State when there
can be a co tract even without any price?
c) You cannot always take the plea that the contract could not be performed due to
impossibility subsequent to the contracting date. State when you can avoid a contract
validly on this ground.
d) If your counterparty failed to discharge his responsibility under the contract, what types
of damages you can claim against him?
e) A seller has sold you defective goods to you. What actions you can take against him?
Also write when and how?
f) You have given your bike to your friend who has desired to go to Puri. You have not
charged any money from him. He meets with a road accident and the bike got severely
damaged. What action you can take against him? Your friend claims that you should
have warned him about the defects in brake and horn.
g) While going on a pilgrimage, your neighbor has left a cow with you. On return he finds
that the cow has given birth a calf. He demands return of the cow and the calf. You say
“I would give both on one condition that you must compensate all expenses incurred
for the maintenance of the cow and the calf.” He says no. during absence he has
consumed milk and sold milk items too, So he would not pay anything. Decide the
case.
