KNOW ALL MEN BY THESE PRESENTS :
This EXTRAJUDICIAL SETTLEMENT OF ESTATE AMONG HEIRS WITH

SIMULTANEOUS WAIVER, QUITCLAIM AND TRANSFER , made and executed in
the City of Tagbilaran , Bohol, Philippines by the Heirs of the late TIMOTEO
BATINGAL, namely;
MARK TIMOTHY BATINGAL (son) married and resident of 55A H. Brunidor

Street, Cogon District, Tagbilaran City, Philippines :
CECILE EVEMARY BATINGAL (daughter) single and resident of 55A H. Brunidor

PACE MICHILLE BATINGAL (daughter) single and resident of 55A H. Brunidor

all Filipinos and of legal age/s hereinafter referred to only as
HEIRS/TRANSFERORS;
-IN FAVOR OF –
CELIA S. BATINGAL (surviving wife) Filipino, of legal age, widow and resident of
55A H. Brunidor Street, Cogon District, Tagbilaran City, Philippines , hereinafter
referred to only as HEIR/TRANSFEREE :
WITNESSETH:
WHEREAS, the above-named parties are the children, surviving wife, only heirs
and successors of the late TIMOTEO BATINGAL who died intestate or without any
will , on September 2, 2023 at Tagbilaran City, Bohol, Philippines;
WHEREAS, at the time of his death, the deceased , left certain Savings
Deposits with banks, more particularly detailed as follows :

WHEREAS , the above-mentioned Savings Deposits are free from any and all liens
and encumbrances whatsoever ;
NOW THEREFORE, premises considered, and invoking the provisions of Section 1,

Rule 74 of the Rules of Court, the HEIRS/TRANSFERORS hereto hereby agree, as
they have in fact agreed, to settle extrajudicially and adjudicate unto themselves the
above-described Savings Deposits , subject however, to the liabilities imposed under
Section 4, Rule 74 of the same Rules of Court in favor of any possible heir/s, creditor/s,
or co-owner/s who might been deprived of his/her lawful participation and share over
the subject money deposits for a period of two (2) years from and after the date of
execution of this instrument ;
-AND WITNESSETH FURTHER-:
WHEREFORE, for and in consideration of the love and affection which the
HEIRS/TRANSFERORS have for the HEIR/TRANSFEREE , the said
HEIRS/TRANSFERORS HEREBY FORMALLY WAIVE, QUITCLAIM AND TRANSFER
unto the HEIR/TRANSFEREE , the above-mentioned Savings Deposits ;
