Statement

As you know Eurasia S.A., is dedicated to the import of computer components that after the corresponding
assembly it transforms into computer equipment: from desktop and laptop computers to printers, external
hard disks, even software, etc.

Their customers are currently located in Argentina and France, although they will also have to serve different
customers in other locations such as the United States and Morocco.

Ana and Ahmed have been preparing all the information on transport contracts and have identified the need
for each type of contract depending on the means of transport used.
For the transport to the French customer, it has contracted a rail transport company to move the goods from
Madrid to Paris. In the case of the Moroccan customer, he has contracted a multimodal company that moves
the goods from Madrid to Algeciras by road, from there to Tangier (by ship) and from there to Casablanca (by
road again).

In the case of Argentina, it has decided to contract the different phases each with a different company. The
goods are transported from Madrid to Buenos Aires by air and from Buenos Aires to Córdoba by road.

In the case of the U.S. customer, he has also contracted a company for each phase of the relocation. The
goods will be shipped by road from Madrid to Algeciras by road, from Algeciras to Boston by sea, and from
Boston to New York by train and to Chicago by road.

What type of contractual document will cover each of the operations and which professionals may be
involved in each operation? What is your opinion of the means used? Argue your answer.

Contract for customer in France

Madrid-Paris uses the contract of international land transport by rail in which the CIM document and the TIF
carnet are used.

The professionals involved in this operation are the shipper, the consignee, the freight forwarder and the rail
operators.

Given the proximity between the two countries, this is a good way to save transport costs and all the goods
can travel at once.

Contract for customer in Morocco

Madrid-Casablanca, calling at Algeciras and Tangier, a multimodal transport contract is used in which the FBL
document is used.

The professionals involved in this operation are the MTO, the consignee, the freight forwarder and the
carriers.

For this customer, I consider that the means used have been correct since, by providing all the transport to a
single company, in addition to saving costs, you make sure that if there is any problem during the transport
of the goods you can complain to the company in charge of it.

Contract for customer in Argentina

In the case of the Argentinean customer, he has contracted a company for each phase of the transfer, so
there are two contracts since he contracts two companies, one for each transshipment. Madrid - Buenos
Aires, the first contract of carriage used is the international air transport contract, using the Montreal
Convention and the AWB document, and Buenos Aires - Cordoba, which uses the road transport contract and
the CMR document.

The professionals involved in this operation are the IATA agent, the shipper, consignee, freight forwarder,
transport agencies and carriers.

In my opinion, I believe that the means used could have been less if they had contracted a single company
for the transfer instead of two, using multimodal transport.

Contract for U.S. customer

In the case of the U.S. customer has also hired a company for each phase of the transfer so there are four
transportation contracts, Madrid-Algeciras contract of land transport by road in which the CMR document is
used, Algeciras-Boston contract of international maritime transport in which several documents are used: the
maritime bill of lading, the charter party and the cargo manifest, Boston - New York contract of international
land transport by rail in which the CIM document is used, if it is dangerous goods it must be accompanied by
the RID document, and New York - Chicago contract of international land transport by road in which the CMR
document is used.

The professionals who may be involved in such an operation are the shipper, consignee, freight forwarder,
forwarding agents, shipowner, consignee, stevedore, charterer, carriers and a rail operator.

I believe that the means used are too many, since some stopovers could have been avoided with another
type of transport contract, in addition to unifying the entire transfer in a single company to save costs and
thus avoid possible incidents. Therefore, as in the case of the Argentine customer, multimodal transport
would have been the most logical option.
