NEGOTIATION PLAN

FOR PRELIMINARY ROUND – I

1. NEED:
The present need for negotiation is that Sam and Abhi have expressed their intention to
leave the job due to the unresolved problems at the gym. Sam and Abhi wanted to hike
the salary as present salary is insufficient for present need. Swapnil got threatened by
Sam on Abhi for legal consequences in court.
2. INTERESTS:

• Retaining Sam and Abhi in their fiduciary relationship of Gym trainer. They have
experience, well balanced relationship and trust with the members and are undoubtedly
most valuable assents for the gym’s success. Lossing them will be equivalent to losing
huge customer base as they can manipulate and take customer with them.
• The complaints which were raised by the concern member need to be resolved at utmost
priority. It will help in making good reputation and inbuilt the chances of getting more
customers.
• Swapnil needs to avoid legal consequences, which might be faced by him from Sam and
Abhi, which will definitely bring bad reputation with it. Negotiation is best alternative
from him to retain Sam and Abhi and not to losses any trust of his customers.
• Swapnil has problem with equipment management as he is low on finance, he need to
find balance between same and need to give high quality service to his customer and
satisfactory working condition for Sam and Abhi.

3. STRATEGIC STRONG POINTS:

• Swapnil has well established business, he is providing high high-class gym in the city of
Agrabah. Due to his gym goodwill people are coming in huge number.
• His customer base is increasing day by day and by keeping that in mind he has expanded
his business which will bring more good wealth as in the pace everything is growing.
• Swapnil can make huge profit in short span and then he will make more investment to
expand his business.
• Swapnil has huge customer base and his customer are most important component to
business, which is increasing and showing good sign.

4. STRATEGIC WEAK POINTS:

• The customers are having complain due to shortage of equipment and opening one more
branch has increased more problem as equipment were send to other gym which
increased the shortage and grievances of the customers.
• Sam and Abhi are not happy with their salary they need hike for it
• Swapnil can’t manage everything as resource are limited in his hand now.
• Sam and Abhi can go for legal proceeding if the dues are not clear immediately.
5. GOALS AND OBJECTIVES:

• To ask Sam and Abhi to work on same pay and due will be clear in few days but there
pay will hike after getting stability and growth will be seen in the both the Gym.
• Retain of customer by asking Sam and Abhi to get into managerial position and give
creative solution to eliminate any short of query as they are the one who are in great
touch with them.
• Seek more customer base and help Sam and Abhi to create environment for them.
• Ask Sam and Abhi to manage both the Gym, as they are expert in there field.
• Convincing Sam and Abhi to this term and stop them from seeking any legal proceeding
towards him.

6. VIABLE/CONCILIATORY OPTIONS:

• Swapnil can ask his customer to approach the other gym and it will split the customer and
equipment will be used, for doing so he can give discount on cap of customer to enter
from previous gym to new gym.
• Swapnil will take ask Sam or Abhi to join the other gym as trainer and involve them in
decision making process and managerial process.
• Sam and Abhi will be allowed to sell products inside Gym (expect which are forbidden
by law) relating to exercise and they can keep there share just they have to pay the rent of
they space they are utilizing for same.

7. BATNA:

• Swapnil can ask to take 10% of share from first Gym, equally to Sam and Abhi and in
return they have to pay their share and also, they will pay after deducting their salary
(considering the gravity during negotiation interest may / not be included in salary due).
• Working condition and holiday will be increased instead of pay hike and that will be
done by considering that in a week they have to work for 6 days and Thursday as holiday.
So, if we see working day as: M T W F S S
Instead of working Sam and Abhi M T W F S S
Now they will work for 4 days and rest 2 days Swapnil will work in their place
and flexible work culture
• Sam and Abhi will not file any legal proceeding and they will help Swapnil to grow his
business and help as helping aid for the same, they will be getting incentive and bonus for
the same. Target will be allotted and achieving which will increase or boost their
incentive in future.
• Sam and Abhi are hardworking and loyal workers and they should retain not only as
worker but as valuable assets for the Gym.
• Swapnil will take loan against his business and repay due of Sam and Abhi and also
invest huge money to buy equipment for his both Gym.
• Dues will be clear in 14 days with condition that either Sam or Abhi will join the new
Gym and start managing and controlling there and work for customer growth.
• They resolve the negotiation and spread good words in ear of people so the good will of
the Gym will be improved and people will get to know they value there worker too like
their customers.

8. WATNA:

• To sell of the Gym equipment and pay their due of salary.


• To take the matter in court.
• Sam and Abhi will start their own Gym and take out customers from Swapnil gym.
• Swapnil will remove either Sam or Abhi and ask one to work with rise in pay.
