Annexure 1 (Hazardous)
1.1 Company’s Transportation Committee shall periodically measure the performance of the
Road Truck Operator on the basis of pre-determined criteria and shall be entitled to claim
damages from the Road Truck Operator by way of reduction in the volume to be carried by
the Road Truck Operator in case of non-performance.
1.2 If it is found that the Road Truck Operator has carried material other than what was loaded
at Company's loading points on the Vehicles, then Company shall be entitled to charge
penalty of 200% of Freight for such consignment.
1.3 The Road Truck Operator shall ensure that prior to the Vehicle leaving the consignors
premises or any other loading location with the Goods, all requisite documents required to
be carried in the Vehicle including consignors invoices, stock transfer notes, challan, packing
list, Road Permit/E-Waybills and relevant documents etc., have been handed over to the
driver with his acknowledgement, who shall ensure the safe keeping and delivery of the same
at the delivery destination and any loss/ penalty imposed due to loss or not carrying these
documents shall be borne by the Road Truck Operator . On Road Truck Operator failure to
hand over these documents to the Company representative at delivery destination, the Road
Truck Operator shall pay to Company Rs.1,000/- as liquidated damages per document in
addition to recovery of loss of any statutory benefit or any financial loss to the consignee. In
the event of loss of any such document, the driver shall file FIR at the nearest police station
& give a copy of the FIR to Company. GST as applicable shall be recovered additionally from
Road Truck Operator .
1.4 The Road Truck Operator shall obtain and keep with the vehicle necessary documents related
to valid PUC (Pollution under Control) and should ensure that the Drivers carry valid driving
license along with documents related to Road tax, Vehicle Insurance along with Third party
Liability coverage etc. Failing this a penalty of Rs.1,000 per document will be charged in
addition to recovery of loss of any statutory benefit or any financial loss to Company/
Consignee.
1.5 If the Road Truck Operator fails to inform the Company of any diversion from routes
prescribed by the Company, Company shall be entitled to damages of Rs.10,000/- per
consignment.
1.6 If the Road Truck Operator tranships the products without the prior permission of the
Company, the Company shall be entitled to charge penalty of Rs.10,000/- for every
consignment transhipped or partly delivered.

1.7 The quantity and value stated in the work order are only an indication and Company does
not commit itself or guarantee the said value of work order or the quantity stated therein.
1.8 If the Road Truck Operator fails to provide the Vehicle within 24 hours of the intimation or
within the date and time mentioned on the Work Order, Company shall be entitled to:
i. Any Pending order will be treated as non-placement and vehicle from open market will
be hired and penalty will be charged as per below mentioned table
ii. And any extra cost paid, loss or damage (including consequential loss or damages) that
may be incurred by the Company shall be debited to the account of the Road Truck
Operator and the Road Truck Operator shall indemnify the Company against the same.
1.9 Any instance of Seal breakage / Seal tampering / ribit or welding tampering will be penalized
Rs.10,000 per instance.
1.10 Any instance of materials getting wet because of improper tarpaulin coverage, no tarpaulin,
holes in the container will be penalized Rs.5,000 per instance along with any consequential
loss as liquidated damages for default under this clause.
1.11 GST as applicable shall be recovered additionally on such penal charges from Transporter.
1.12 Company shall be entitled to recover from the Road Truck Operator, the full value and any
other charges / statutory levies if applicable on the shortage quantity of products caused
inter alia, due to any damage, pilferage and theft in transit or non- delivery etc.
1.13 For Vehicles taking more than the standard transit time prescribed by the Company from
time to time, the Company shall levy fines for each day of transit delay at the rate of Rs.35/
MT/day. Such amount shall be deducted from the bills due and payable to the Road Truck
Operator.
1.14 In case any Vehicle does not reach its destination beyond 5 days from the agreed TAT at the
consignee’s place it will be deemed to have been lost / stolen and full value any other charges
/ statutory levies of the Consignment shall immediately be recovered from the Road Truck
Operator. For eg. Say TAT of 4 days is agreed, then vehicle not reporting at destination
beyond 9th day, the entire Freight will not be payable.

1.15 In case of any accident, damage, shortage, pilferage, Vehicles having been lost or stolen,
Vehicles meeting any untoward incident and theft in transit or non- delivery of Goods, all
losses and costs incurred by the Transporter shall be the sole liability of the Transporter only.
Also, Company shall be entitled to deduct from the amounts payable for bills raised by the
Transporter in case of loss occurred to Company. The amount of deduction will be calculated
by Company and such calculation shall be final and binding on the Transporter. GST as
applicable shall be recovered additionally from Transporter.
1.16 In the event of rejection of any products by the consignee on account of contamination or
damage to the quality of the Goods, irrespective of whether the same is due to any act of
omission or commission, Company shall recover the entire cost of the Goods & any other
charges / statutory levies from the Road Truck Operator. The Road Truck Operator shall not
be entitled to claim transportation charges for the futile trip during which the products were
contaminated and the subsequent trip for transportation of the adulterated products to a
location nominated by Company.
1.17 If a Vehicle used by the Road Truck Operator under this agreement is found to be involved
in any malpractice by the Road Truck Operator, vehicle owner or the Driver or any other
person, Company shall black list the Vehicle and immediately suspend its operation and the
Road Truck Operator shall not then engage the Road Transport Carriage of such Vehicle
owner for any further transaction under the terms of this Agreement without prejudicing the
rights of Company or Road Truck Operator to take necessary action in this regard. If it is
found that the Road Truck Operator is also involved in the malpractice by the Vehicle owner,
then Company may, at its sole discretion terminate this Agreement.
1.18 Allocation of multiple vendors for the same lane is completely under discretion of Company.
1.19 The terms and conditions of payment and / or reimbursement of expenses by Company and
/ or detention charges payable to Transporter as mentioned herein above may be modified
by Company with mutual consultation with Transporter from time to time by agreement or
amendment to the agreement / exchange of letters in writing, duly signed by Transporter in
token of acceptance thereof. Such agreement or amendment to the agreement or accepted
letter modifying the terms and conditions of payment and / or reimbursement of expenses
by Company to Transporter shall form an integral part of, and be read into this Agreement.
1.20 Tolerance Limit for Liquids Transportation: The tolerance limit available varies from product
to product and hence given hereunder the tolerance limit against each of the product and
the deduction therein: -

Road truck operator should maintain Public liability insurance as required by the law.
It is road transporters obligation to ensure that the applicable laws relating to HSE are respected, complied
with and monitored during the entire performance of transportation of COMPANY Products. This shall also
include:
Applicable Laws
Road Transportation vendor shall comply and ensure compliance by any of its subcontractors with all
applicable laws relating to HSE throughout the transportation contract period e.g. laws relating to
Environment, Health and Safety and Logistics.
Government Authorization
Road transport vendor shall be responsible for obtaining any permits, licenses etc. from relevant
governmental authorities to the extent required for the transportation of COMPANY Products.
Transporter has to carryout route related formalities as laid by Goods and Service Tax Authorities,
RTO, Govt. Agencies like "Transit Pass/Baheti" or other legal and statutory formalities connected
with the transportation of goods etc. to avoid detention due to non-compliance of the same. Any
penalty arising out of the same due to non-compliance shall be have to bear by the Transporter.
Transporter should comply and carry all the documents which may be required by various agencies
in GST.

HSE Plan
Road transport Vendor shall follow COMPANY HSE policy and shall ensure:
Documentation
COMPANY Road transportation vendor shall have a documentation management system to ensure
that records are identified, verified, up to date and available at point of use to support the
transportation. Vendor documentation shall otherwise satisfy the requirements of this agreement.
Management of Change
The road transport Vendor shall have a change management system to manage and control changes
in personnel, materials, procedures and equipment’s. Changes which may impact upon HSE shall be
routed through COMPANY Logistics HSE.
Road transport vendor shall address the potential risk associated with following activities:
• Fire.
• Spill /loss of product/ contamination of product
• Route selection
• Driver selection and training.
• Fatigue Management
• Enroute Emergency response

Road Transport Carriage Agreement
Road transport vendor shall have and implement a procedure and shall use it to select, evaluate and
implement measures to suppress HSE risk identified above during transportation of COMPANY Products.
Incidents
The road transport vendor shall report all the transportation incidents and near misses during
transportation of COMPANY Products within 24 hrs of the incident to the nearest site /loading site of
COMPANY. The transport vendor shall make necessary arrangements like arrangement of cranes, fire
tenders, police etc. to bring the situation under control at the earliest. The road transport vendor shall
assist logistics business/loading site in investigation of all the incidents and shall implement all the
learning from the incidents shared to them.
III. People
Transporter representative should be informed and competent for completing the work. The road
transport vendor shall continually reinforce his performance of transportation activity by:
• Driver awareness on risks during transportation within and outside Reliance.
• Knowledgeable personnel for maintenance of the vehicle used for transportation
Medical Fitness
Fitness certificates of Drivers shall be maintained by the road transport vendor and provided upon
company request. Contractor shall provide COMPANY with details of its system for assessing the
medical fitness of its drivers. All the drivers should comply with driver fitness program as mandated
by COMPANY
Following items should be available in the Emergency kit inside the Vehicle all the time.
V. Contractors to report and investigate incidents, including injuries, vehicle accidents and oil spills
occurring in the conduct of business.
• Transporter shall immediately notify Company for all transport related incidents, but not limited
to, accidents, death, injuries requiring medical treatment beyond first aid, industrial illnesses,
vehicle accidents, chemical spills, damage to Property or the environment, significant gas
releases, and significant near misses (e.g., incidents that may have resulted in serious injury,
death, or substantial property or environmental damage) enroute. Providing notice to Company
does not relieve Contractor’s responsibility to notify appropriate regulatory agencies when
applicable.
• Incident details shall be communicated to Company’s onsite representative immediately and
also to the COMPANY logistics control room Toll free number (18001210090). Transporter can
also report the incident information on the emergency number mentioned in TREM Card/Driver
policy cards.
• Transporter shall fully investigate all incidents and shall provide Company with a written report
that identifies the contributing factors and the corrective actions that shall be taken to prevent
reoccurrence. In certain circumstances, Contractor may be required to participate in a joint
incident investigation with Company or others.

• Except to cooperate with rescue personnel and to address imminent safety hazards, transporter
shall not disturb the scene of any incident that may require investigation by Company or a
regulatory agency until authorized to proceed by Company.
VI. The transporter to have an emergency response plan that links with plans, where appropriate
• Transporter shall develop, implement, and enforce its own emergency response plans for its
workers and subcontractors.
• Transporter emergency response plan shall include provisions covering personal injuries, fires,
explosions, and other major emergencies. Transporter shall immediately notify Company of any
emergency situation.
• Release of information about any emergency to the news media shall be done in conjunction
with Company and only with the sole permission of Company’s management.
• Transporter shall post and/or make available all applicable ambulance, hospital, fire, police, and
crane operator telephone contacts.
VII. Transporter has to follow the recommendation mention in following four major area,
• Contractor Management
• Vehicle Management
• Driver Management
• Journey Management incl off site emergency response
Contractor Management
• Transporter to identify and nominate a responsible person for transportation safety. This person
should be reporting to owner/senior management. Personal commitment from Transporter is
vital.
• Every driver must have transporter emergency response number.
• Transporter should have their emergency response system like emergency vehicle with tools and
tackles, and related en-route emergency response information like crane service, towing station
number etc.
• Transporter should have their own driving behavior monitoring system like over speeding, Night
Driving, following rest stations, harsh braking during journey, Harsh Maneuvering , Continuous
Driving ,journey brake place and time, monitoring night driving, Stoppage alert (Maximum
stoppage time at one location is 2 hrs other than restricted night time) etc.
• The Transporter has to ensure that Driver who are assigned for COMPANY product movement in
Gas Tankers should pass through a third party verification process for driver background
checking.

Road Transport Carriage Agreement
• Transporter shall comply with the requirements of state and local laws, rules, and regulations
pertaining to safe vehicle operation and shall only use the vehicle for the purposes for which it
was designed.
• Transporter shall train all drivers in and make use of safe driving and backing techniques.
• Transporter shall not overload trucks or other vehicles with passengers or materials.
• All loads shall be properly placed and secured; projections that extend over 24 inches shall be
properly flagged with a red flag.
• Contractor shall not allow persons to ride in the bed of a flatbed truck, dump truck, or pickup. No
one shall be allowed to ride on the top, running boards, fenders, or hood of the vehicle.
• When practical, it is recommended that vehicles be parked so they can be driven forward when
next moved. If backing, the operator shall check for potential hazards behind the vehicle before
backing. This may require the operator to walk around the vehicle or use a spotter.
• While transporting overweight, high, wide, or long loads, Contractor shall contact the appropriate
regulatory agencies or utility companies and obtain any necessary approvals or permits.
Vehicle Management
• Tankers should be placed according to Company specifications for the corresponding product.
• Vehicle Age to be less than 10 years at the time of placement
• Vehicle to have all valid permits and licenses as per statutory requirement
• Vehicle to be provide with proper seat for driver and Helper with three-point retractable seat
belt.
• Vehicles to be provided with two wipers.
• To Have side and rear underrun protection.
• To be provided with COMPANY approved VTS system
• All the vehicles provided for transportation of goods should be equipped with Vehicle tracking
system.
• Company may nominate vendor for providing VTS/ SIM based Tracking system, the charges for
which may have to be borne by the Road Truck Operator
• COMPANY wants the VTS solution setup to be hosted at its location.
• To have a reverse horn in working condition.
• Tankers to be provided with anti-Lock braking system (ABS)
• Reflective tapes on all sides.
• Painting as per COMPANY specification.
• EIP as per statutory requirement.
• Larger and wide side view mirror.
• Cabin should be of Steel construction (OEM cabin recommended).
• Rule 18, 19 certifications from COMPANY approved agency for gas tankers.
• Battery isolation switch in working condition.

Driver Management
• To possess a valid HTV License or HGV License and should have valid 3 day Hazardous chemicals
transportation training certificate endorsed by RTO.
• Every driver of HAZCHEM tanker must be able to read and write at least one Indian language and
English.
• Driver should be medically fit. To possess a medical certificate from COMPANY approved certified
Medical practitioner (Should undergo Physical examination, Eye sight Test including color
blindness, and Diabetes test yearly).
• Driver of tanker is responsible for keeping required PPE’s, Emergency response equipment and
emergency tool kit in good condition all the time in vehicle and all the things must be ready for
use condition.
• Tanker drivers should not consume alcohol and any banned abusive drugs while on duty.
• Driver & the attendant shall wear safety belt while driving the vehicle.
• Cell phone usage during driving is strictly prohibited.
• Gas Tanker drivers to undergo antecedent verification by a COMPANY approved third party.
• Transporter shall identify safe rest stops for drivers on the routes his vehicles are plying. He
should ensure that vehicles are parked in this identified rest stops & not parked on the road at
any point of time.
• Prior to departure, the vehicle operator shall conduct a “safety circle check” by walking around a
vehicle to ensure there are no hazards that may prevent safe operation of the vehicle.
• All new drivers should have at least 2 years of driving experience for driving a heavy motor
vehicles (HMV). This would have calculated from issuance of HMV license.
• All inexperienced new drivers of gas and liquid distribution system should attend the three days
driver training programme at DTI Vadodara.
• Maximum allowable age limit for the drivers for operation in COMPANY distribution system is 65
years.
Journey Management
• No night driving between 12:00 am to 5:00 am. Exception to have prior approvals.

• Tankers to ply on COMPANY authorized route only. Consequence Management to be applied for
violations.
• Speed of transit vehicle should always be as per road /traffic condition. However maximum speed
permitted would be 60 km/hr.
• Continuous driving hours permitted – Max 4 hrs. Followed by minimum 30 min rest.
• Tankers should halt only at authorized and approved rest stations.
• Transporter should do Route Hazard Mapping for the major routes and ensure that Drivers are
updated about the same.
• Every driver should a Journey Plan for the route before undertaking the trip
VIII. Any sub-contractors hired by the Contractor to meet these same expectations.
Transporter shall conduct assurance activities like audits and inspections of Sub Contractor
operations and facilities.
