HARM
Aboriginal Heritage Act 2006
In relation to Aboriginal Cultural Heritage, harm includes to:
• Damage,
• Deface,
• Desecrate,
• Destroy,
• Disturb,
• Injure, or
• Interfere with Aboriginal cultural heritage

Prior to any works commencing within the extent of an Aboriginal cultural


place, approval must be gained under the Aboriginal Heritage Act 2006

Cultural Heritage Management Plan 12192
• Cultural Heritage Management Plan (CHMP) 12192 was prepared under the
Aboriginal Heritage Act 2006 in 2014, and was amended in 2019.
• The CHMP requires the Sponsor to ensure that all construction managers
and earthworks foreman, whether employees or contractors working within
the Activity Area prior to the commencement of the activity to undergo a
Cultural Heritage Induction.
• In addition, a Cultural Heritage Induction Booklet must be provided by a
Heritage Advisor that can be used to induct any new employees or
contractors who are not present at the commencement of the activity and
the Cultural Heritage Induction.

CHMP 12192 Activity Area

The CHMP Activity Area covers


477.16 ha including the parcel of land
at 4a Field Street, Aintree.
Activity Description
CHMP 12192 was completed for the subdivision, residential/retail
development, recreation and education facilities and all associated
infrastructure requirements as detailed in the Growth Areas Authority
(GAA) (2002) Rockbank North Precinct Structure Plan.

The construction of a Government SES facility is covered under this


wide description.

These activities have the potential to impact cultural heritage.


CHMP Investigation
The CHMP including the completion of:
• Desktop Assessment - background research and predictive model
Artefact scatters and isolated artefacts are the most commonly
occurring site types in the area. Artefact scatters have the potential
to be large, particularly adjacent to natural water sources (swamps,
soaks, marshes, springs, drainage channels and creeks).

• Standard Assessment – pedestrian ground survey


• Complex Assessment – manual and mechanical excavation
Results
Ten Aboriginal places were identified
during the field assessment
consisting of six large place
‘complexes’ and four low density
artefact scatters.

within the extent of the property at 4A
Field Street, Aintree.

VAHR 7822-3707 is a promionent
rise overlooking the Kororoit Creek
basin and creek, wit a smaller rise to
the south providing excellent vantage
to the south and east. The place
consists of six previously recorded
Aboriginal places and additional
surface and subsurface cultural
material of locally sourced quartz,
silcrete and quartzite stone materials
representative of the Australian
Stone Tool Tradition. The place is
interpreted as a transitional
landscape.
Management Conditions
CHMP 12192 includes 20 specific management conditions which must be
complied with before, during and after works occur within the Activity Area.
These conditions relate to:
• Salvage of Aboriginal places
• Reporting on salvage activities
• Requirements for further studies including useware, reside, radio carbon
dating and Paleoenvironmental studies
• Specific works in reserve areas
• Specific works for land restoration, landscaping, fencing and linear
infrastructure
• Artefact curation and management
• Cultural Heritage Training
• Provisions for Aboriginal people to visit cultural heritage places within the
Activity Area
Management Conditions
Relevant to the current works at 4a Field Street, Aintree are the following
conditions:
• 10.2.1 Salvage Report
• 10.2.3 Surface Salvage Methodology
• 10.6 VAHR 7822-3707 (Rockbank Outlook Site Complex)
• 10.20.1 Recommendation for Cultural Heritage Training

These are listed in full within Part 2 of CHMP 12192 and within the within the
Cultural Heritage Induction Booklet.
Contingencies
In accordance with Section 61 of the Aboriginal Heritage At 2006, a CHMP
must consider contingency plans in relation to disputes, delays and other
obstaclse that may affect the conduct of the activity. The contingencies listed
below are presented in Part 2 of CHMP 12192 and within the Cultural Heritage
Induction Booklet and include:
• Section 61 matters;
• Regarding Dispute Resolution;
Discovery of Aboriginal Cultural Heritage / Other Cultural Heritage;
• Unexpected Discovery of Human Remains;
• Reporting the Discovery of Aboriginal Cultural Heritage During the Activity
• Removal, Curation, Custody and Management of Aboriginal Cultural
Heritage (Artefacts) Discovered During the Activity; and
• Compliance with the CHMP
Salvage and Compliance with Management
Conditions
In accordance with CHMP 12192, an
archaeological salvage was completed by
Archaeological & Heritage Management
Solutions (VAHR Report 4739) in 2015, meeting
the requirements of the CHMP. This includes the
required surface salvage and associated
activities associated with Aboriginal place VAHR
7822-3707 (Rockbank North Rim Site Complex).

No further archaeological salvage is required


prior to works commencing for the Caroline
Springs SES facility.
