    MOTION FOR
    RECONSIDERATION

    COME NOW, RESPONDENT, most respectfully state and aver that:

    1. On 5 November 2014, Respondent was apprehended by a traffic


    enforcer while he was traveling in Panabo City. It was found out that
    several violations were listed and recorded. As a result, the
    apprehending officer issued a Temporary Operator’s Permit and
    confiscated his Driver’s License;

    2. Respondent is the registered owner of the aforecited motorcycle


    registered in the record of the Land Transportation Office;

    3. Because Respondent has no means to pay the imposed penalty to


    him, he was not able to pay the amount of the violation and secure his
    confiscated driver’s license;

    4. Respondent struggled in financial means and he decided to sell his


    motorcycle. Unfortunately, the buyer did not bother to process the
    transfer of ownership to his name. The reason that Respondent’s name
    is still the registered owner on the record file in the system of the Land
    Transportation Office;

    5. On 19 September 2019, the TOP issued to Respondent was lost. He


    was not able to locate such document. As a result, he caused the
    recording of the incident in the Police. Respondent also executed an
    Affidavit of Loss of T.O.P to prove such claim. Attached is a copy of the
    said Police Blotter and Affidavit of Loss for refence;

    6. It was only for today that Respondent had save money for the
    payment of the violation however went he received the assessment of
    the penalty such amount has balloon to Fourteen Thousand Six
    Hundred Seven and 63/100 Pesos (Php 14,607.63);

    7. The breakdown of the assessment is hereunder listed, to wit

    Violations Penalty
    Expired OR and/or CR 10,000.00
    Reckless 2,077.63
    Arrears 2,530.00
    Total 14,607.63

    8. The amount above-mentioned is very excessive and exorbitant that I
    cannot settle or pay;

    9. I am indigent and could not afford the penalty imposed.

    10. As such, I am respectfully praying that the Arrears in the amount of


    Two Thousand Five Hundred Thirty Pesos (Php 2,530.00) be
    condoned to mimimize the amount of penalty I should pay.

    WHEREFORE, it is most respectfully prayed from the Honorable District Head


    that, the instant motion be GRANTED and an Order be issued condoning the
    amount of Arrears so that Respondent could raise the money to pay the remaining
    balance.
