This delivery certificate must be created at the time of the vehicle sale in compliance with legal regulations regarding the duty to inform about vehicle recalls, and in
connection with guarantee and warranty claims.
The delivery certificate must be discussed in full detail by the KTM dealer and the customer, and must be filled out, printed out and signed in the fields provided. With
their signatures, the authorized KTM dealer and the customer confirm that they have understood the conditions of the sale and delivery of the vehicle and have
complied with these. A copy of the form signed by both contracting parties must be handed to the customer.

The object of sale was delivered in perfect condition together with the set of keys and the Owner's Manual. I prefer the electronic Owner’s Manual, with its various
advantages, to the printed version. A printed Owner's Manual can be ordered at any time as a spare part. I am familiar with the break-in regulations. I was advised to
follow the corresponding instructions in the Owner's Manual. Instruction on the proper use of the vehicle was provided by the authorized KTM dealer. I am aware of the
warranty terms and conditions in this document.
My data will be processed for the purposes stated in the "Data protection information sheet", which has been brought to my attention by the authorized KTM dealer.
As part of compliance with the applicable legal regulatory guidelines, vehicle data (vehicle identification number, engine data, software information, kilometers traveled,
sensor data, vehicle condition, maintenance status,country of use, etc.) may need to be read out and, after being prepared in pseudonymised form, transmitted to the
responsible authorities on request.

MANUFACTURER WARRANTY
KTM Sportmotorcycle GmbH (hereinafter referred to as KTM), with its registered office in Stallhofnerstraße 3, 5230 Mattighofen, Austria, provides the customer with a
KTM motorcycle with a warranty that the materials used and the workmanship are free of defects in conformity with the respective state of the art. Accordingly, KTM
warrants that if any defects in the materials or workmanship are found in a brand-new product purchased by the customer, such defects will be repaired, free of charge,
within the warranty period (without any limitation as to mileage or operating hours) set out in the delivery certificate and subject to the conditions and provisions set out
below. KTM Sportmotorcycle GmbH is the warrantor, the manufacturer of the KTM motorcycle remains KTM AG with registered office in Stallhofnerstraße 3, 5230
Mattighofen, Austria.

WARRANTY PERIOD
The warranty period begins on the day on which the vehicle is first put into operation. Any faults or defects must be reported to an authorized KTM dealer within the
warranty period.
The period within which a warranty claim can be made depends on the model and is specified in the delivery certificate. KTM motorcycles that do not have a delivery
certificate are excluded from the manufacturer warranty.
The customer must report faults or defects to an authorized KTM dealer by the end of the warranty period in order to effectively assert a warranty claim.

SCOPE OF THE WARRANTY


The KTM manufacturer warranty applies worldwide. Claims under warranty must be made to an authorized KTM dealer. The manufacturer warranty is linked to the
vehicle. If the vehicle is sold during the warranty period, the provisions shall remain in force and can also be claimed by the new owner subject to compliance with the
respective warranty terms and conditions and warranty periods.

IMPORTANT NOTICE
Regular and proper service by an authorized KTM dealer, complying with the service intervals prescribed in the Owner's Manual is a prerequisite for the warranty
claims to remain in effect. When you take your motorcycle in for service, ensure that the proof of service is properly and fully entered in KTM Dealer.net (service
registration number). You can check the service history via the website http://www.ktm.com in the service section. In the event of incomplete proof of service or if the
service work is not carried out within the specified service intervals, the warranty claims will lapse.

WARRANTY TERMS AND CONDITIONS


KTM shall be entitled to reject warranty claims if and insofar as:
» The customer fails to have one of the services specified in the Owner's Manual carried out or has had it carried out later than specified;
»the service and repair work performed on the motorcycle was not carried out by an authorized KTM workshop;
» Service or repair work has been carried out on the motorcycle that does not comply with the technical requirements, specifications, and instructions of the
manufacturer;
» The service or repair work carried out on the motorcycle made use of spare parts that are not approved by KTM, or the vehicle was operated with fuel, lubricants, or
technical fluids (including cleaning agents) that deviate from the specifications set out in the Owner's Manual;
» The motorcycle has in any way whatsoever been converted, modified, or equipped with parts that have not been expressly approved by KTM;
» The motorcycle was stored or transported in a manner that was technically inappropriate;
» The motorcycle has been used contrary to its intended use.
The above-mentioned exclusions shall not apply if and insofar as the customer establishes that the defect in respect of which the claim is made is not attributable to the
reason for the exclusion.

WARRANTY EXCLUSIONS
The following are excluded from the manufacturer warranty:
» Wear parts such as, in particular, pistons, cylinders, spark plugs, 12-V batteries, fuel filters, oil filter elements, drive chains, sprockets, rear sprockets, air filters, brake
discs, brake pads, clutch plates, bulbs, fuses, footrest rubber parts, tires, hoses, throttle cables, and other rubber parts;
» Lubricants (such as: oils, greases etc.) and technical liquids (such as: battery fluid, coolant, etc.);
» Inspection, adjustment and other periodic service work, and all cleaning work;
» Lacquer or corrosion damage that can be attributed to external influences, such as stone chipping, road salt, industrial emissions, or other environmental influences,
or to improper cleaning (e.g.due to unsuitable cleaning agents).;
» All direct and indirect consequential damage caused by defects and all direct and indirect additional costs arising from a damage or warranty claim (such as:
telecommunication, board and lodging, rental vehicles, public transportation, salvage costs, towing costs, accommodation) and other financial losses (such as: loss of
use, loss of earnings, loss of time);
» Any aesthetic or acoustic phenomena that do not, or only slightly, impair the usability of the vehicle (such as hidden or minor flaws in appearance, normal riding
noises, and vibrations);
» Signs of aging (such as the fading of painted or metal-coated surfaces).

WARRANTY CLAIMS
If your motorcycle develops a malfunction, contact an authorized KTM dealer. Warranty claims must be submitted to the warrantor by an authorized KTM dealer before
a repair or replacement is carried out. KTM will examine the warranty claim and decide at its sole discretion whether and which defective parts are to be repaired or
replaced by the authorized KTM dealer. Parts that have been replaced due to a warranty or guarantee claim become the property of KTM without compensation. The
authorized KTM dealer responsible for rectifying the defect is not permitted to make legally binding declarations on behalf of KTM.
If there is any doubt as to the presence of a defect or if a visual or material inspection is necessary, KTM shall be entitled to requisition the defective parts or to instruct
a KTM expert to inspect the purported defect. For the duration of the inspection as well as the repair or replacement, the customer has no claim to a replacement
vehicle.
There is no cover in terms of the warranty for parts replaced free of charge or for services covered by the warranty that were performed free of charge. For components
that were renewed within the warranty period, the warranty claim ends with the expiry of the vehicle warranty.

IMPLIED WARRANTY
This manufacturer warranty does not affect the customer's statutory warranty rights arising from the customer's sales agreement with the authorized KTM dealer.
Further contractual claims in accordance with the General Terms and Conditions of the authorized KTM dealer shall also remain unaffected and can only be asserted
against the authorized KTM dealer in accordance with the applicable legal requirements.
