REBELLION CASE - PEOPLE v.

CRUZ

a. This case concerns the complex crime of multiple murder, robberies and arsons
committed by a large group.
b. Among the accused are Benito and Paterno Cruz, as well as Fermin Tolentino,
among others.
c. According to the Information filed, the accused who are ranking officers and
members of the Communist Party of the Philippines and Hukbong Magpalaya ng Bayan or
Hukbalahap along with 31 others are charged for the "complex crime of rebellion,
with multiple murder, robberies and arsons," that they conspired and took up arms
against the Government of the Republic of the Philippines for the purpose of
removing from the allegiance of the government and laws the territory of the
Philippines.
d. It was done through armed raids, sorites, ambushes, and attacks on the
Philippine Constabulary, the Civilian Guards, the Police and Army patrols and other
detachments constituted and organized by the government of the Philippines as well
as some civilians of the Philippines.
e. They allegedly committed wanton acts of murders, pillages, lootings,
plunders, arsons and planned destructions of private and public properties to
create and spread disorders, terrors, confusions, chaos and fear among the
population and by the use of force and intimidation, organized different barrio
organizations to secure supplies and materials for the support and maintenance of
said uprisings
f. As a result, five criminal cases were instituted with the Court of First
Instance of Manila.
g. Ten events were recorded to have occurred from the year 1949 to 1952.
h. The victims include JOHN D. HARDIE, IRENE W. HARDIE and DONALD CAPUANO. The
accused entered his house and through force and intimidation with intent to gain
took personal properties belonging to him, including a typewriter, a radio,
jewelry, books, clothing and other articles, proceeded to tie them up and
eventually shoot them.
i. Leading around 70 armed men, they also fought with the Armed Forces of the
Philippines and attacked several detachments resulting to several deaths and
injuries.
j. Attacks were also made on the Philippine Constabulary, the Provincial Capitol
Building.
k. These attacks included several acts of murder, robbery, arson and kidnapping.
l. The Court of First Instance convicted them of the complex crime of rebellion,
with multiple murder, robberies and arsons, imposing the penalty of life
imprisonment.
m. Hence, an appeal was made.
n. ISSUE: WON the CFI erred in convicting them of the charges alleged in the
Informations.

SC: NO! But as to the penalty, the penalty meted out to appellants Benito Cruz and
Fermin Tolentino should be reduced to ten (10) years of prision mayor, with the
accessory penalties prescribed by law, and to pay each a fine of P10,000, and
appellant Paterno Cruz should be sentenced to six (6) years, eight (8) months and
one (1) day of prision mayor, with the accessory penalties prescribed by law.
